in qualifying for coverage under Corps of Engineers'

Dear Mr. Hudgins:
On June 30, 1987, you met with Mr. Chuck Henkel of Parkway
Associates, and Mr. Jeff Richter of my staff concerning a proposed
dam and pond on a tributary of Crabtree Creek in the Oxford Hunt
subdivision on West Chatham Street, in Cary, Wake County, North
Carolina.
You stated that the work would involve the excavation of a
fairly large area in order to get adequate material for the dam
and create an approximate 4- to 5-acre pond, about 100 yards off
of the main road. Mr. Richter determined that there were no
wetlands which would be impacted by the project other than the
actual creek itself, from bank to bank. The average annual flow
appears to be less than 5 cubic feet per second, but you should
verify this fact, as well as determining the total amount of fill
material to be placed within the creek banks for the dam.
As Mr. Richter discussed with you, this work may be covered by
one of the Corps' nationwide permits. For the purposes of the
Corps of Engineers' Regulatory Program, Title 33, Code of Federal
Regulations (CFR), Part 330, published in the Federal Register on
November 13, 1986, lists nationwide permits. Authorization was
provided for discharges of dredged or fill material into non-tidal
rivers, streams, and their lakes and impoundments, including
adjacent wetlands, that are located above the headwaters and other
non-tidal waters of the United States, including adjacent
wetlands, that are not a part of a surface tributary system to
interstate waters or navigable waters of the United States.
One of the conditions of this nationwide permit is that you
must first apply for and receive a 401 Water Quality Certification

from the North Carolina Division of Environmental Management. The
