I have reviewed the information and need clarification before proceeding with verifying the use of Nationwide Permit (NWP) 39. Please submit the requested information below (via e-mail is fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the NWP or consider your application withdrawn and close the file: 1. Section C.3 Stream Impacts: The stream impacts table permit impact drawing Sheet No. IM -2.1 indicates that stream impact S1 will permanently impact 104 linear feet of stream K as a result of installing 82.28 feet of 72 -inch RCP. However, the Grading and Drainage Plan Sheet No. C4.0 indicates a longer culvert (115.7 feet of 72 -inch RCP) with a riprap dissipater pad at the outlet. Please clarify what the impacts will be at impact site S1 and revise plans/permit impact drawings accordingly. Note that impacts resulting from riprap dissipater pads should be accounted for separately from the culvert. Additionally, you requested both a NWP 12 and 39 for this project. All activities associated with this project can be covered under the NWP 39. For simplicity, the Corps will review this project under a NWP 39. The Final 2017 Regional Condition 4.1.7 for Nationwide Permit 39 in the Wilmington District states that "Utility lines authorized by this NWP shall comply with the terms and conditions, including regional conditions, of NWP 12."
