Upon review of your request for Water Quality
Certification to place fill material in a wetland area
adjacent to a tributary of Sugar Creek, we have determined
that the proposed fill can be govered by General Water
Quality Certification No. 2176 issued November 4, 1987. A
copy of the General Certification is attached. This
Certification may be used in qualifying for coverage under
Corps of Engineers' Nationwide Permit No. 26.

As we discussed today we are proposing to develop an
approximately 11 acre site in Charlotte at the intersection
of South Boulevard and Sharon Lakes Road which has a man
made pond of less than two acres in an area which we plan
to fill with soil. I met on the site with Mr. Mr. Hugh
Heine and Mr. David Baker today and they informed me that
the prper procedure is to request from your office a
general certification to allow fill in a headwater area.
I am hereby requesting that you provide arse with such a
general certificate. Enclosed is an area map and
topographic map of the site. If you have questions, please
call Mr. Ted Glimp of Trammell Crow Company, 704 342-7919,
for he is now taking charge of this project. His address

On October 26, 1988, you met with Mr. David Baker and Mr. Hugh
Heine of my staff regarding your client's plans to develop
property on an unnamed tributary to Sugar Creek near Pineville,
Mecklenburg County, North Carolina.
Your client owns a 11.1-acre tract at the corner of Sharon
Lakes Road and South Boulevard. A small 2- to 3-acre pond is
located on this property. Before any fill material is placed in
any waters or wetlands, the required Department of the Army permit
must be obtained. Since you plan to fill greater than 1 acre of
water/wetlands (within headwaters), this activity will require a
pre-discharge notification under nationwide permit No. 26 (copy
enclosed). Please read this material carefully.
