Dear Mr. Lastinger,
Timmons Group received USACE’s Request for Additional Information (RAI) via email on July
12, 2019. In response to the RAI, please find below the numbered responses that correspond to
the USACE observations and comments. For clarity, the specific information requests in your
email have been restated below in italics with the responses following in plain text.
1) Based on the submitted PJD request and site visit on March 26, 2019 requested impacts
do not match aquatic features on site. Proposed impacts within the PCN indicate open
waters, based on the delineation and site visit proposed impacts to aquatic features are
wetlands within an existing drained pond. Please adjust these within the PCN to accurately
reflect proposed impacts on site.
The proposed project requires 2,577 linear feet of road construction, resulting in a
permanent impact of 0.205-acres of a PEM wetland along the proposed road to be named
Cabernet Franc Drive.
Per DWR guidance, Neuse River Buffers were measured off of the delineated former
pond boundaries. Per these boundaries, the aforementioned impacts for the Cabernet
Franc Drive road crossing and associated grading will involve a total of 0.121-acres of
permanent Zone 1 buffer impacts and 0.078-acres of permanent Zone 2 buffer impacts.
The road crossing will involve the installation of a 30-inch Reinforced Concrete Pipe
(RCP) culvert, which will be countersunk underneath Cabernet Franc Drive to maintain
the hydrologic connection between the up gradient and down gradient portion of the
drainage system. The culvert outfall is designed with an energy dissipater pad constructed
of class B riprap.
An additional 0.015-acres of permanent Zone 2 buffer impacts associated with grading
for Grenache Lane will occur.
Temporary impacts associated with the project will include 0.150-acres of temporary
Zone 2 buffer impact for temporary sediment and erosion control measures at two
locations, Sediment Basin #1 (totaling 0.113-acres) and Sediment Basin #3 (totaling
0.037-acres). The temporary impacts consist of sediment basins, which are required to
satisfy sedimentation and erosion control requirements without disturbing areas with
useable septic soil. At the conclusion of construction, the sediment basins will be
removed per the basin removal sequence on the construction drawing set (Sheet C5.0).
The contractor will then complete fine grading and perform seedbed preparation, seed,
and mulch all disturbed areas within 7 days per the ground stabilization schedule on the
construction drawing set (Sheet C5.0).

2) Proposed impacts are greater than 0.1 acre of wetlands on site. Per the NWP conditions a
mitigation proposal is required for wetland losses greater than 0.1 acre. No mitigation
proposal was submitted with the PCN. Please submit a mitigation proposal for wetland
impacts associated with this project.
The applicant proposes to provide 2:1 mitigation for impacts to 0.205 acres of wetland.
Total compensation for the project is as follows:
Wetland mitigation credits will be purchased using the Neu-Con Wetland & Stream
Umbrella Mitigation Bank at ratios of 2:1 for PEM wetland impacts (0.205 acres x 2 = 0.41
acres) for a total of 0.41 acre of riparian wetland mitigation credits.
Additionally, the proposed project involves 652-sq. ft. (0.015-acres) of permanent impact
to Zone 2 Buffer areas resulting from road impacts not associated with a stream crossing.
Therefore, Zone 2 Buffer mitigation for this impact is required at a 1.5:1 ratio. Therefore,
the applicant proposes to purchase additional mitigation credits using the Neu-Con
Wetland & Stream Umbrella Mitigation Bank for a total of 978-sq. ft. of Zone 2 Buffer.

4.STOCKPILE SLOPES SHALL BE 2:1 OR FLATTER.
5.APPROVED BMPS SHALL BE SHOWN ON A PLAN TO CONTROL ANY
POTENTIAL SEDIMENT LOSS FROM A STOCKPILE.
6.STOCKPILING MATERIALS ADJACENT TO A DITCH, DRAINAGEWAY,
WATERCOURSE, WETLAND, STREAM BUFFER, OR OTHER BODY OF
WATER SHALL BE AVOIDED UNLESS AN ALTERNATIVE LOCATION IS
DEMONSTRATED TO BE UNAVAILABLE.
7.ANY CONCENTRATED FLOW LIKELY TO AFFECT THE STOCKPILE
SHALL BE DIVERTED TO AN APPROVED BMP.

GROUND STABILIZATION

DIVERSION CHANNELS, SILT FENCE, SEDIMENT BASINS AND CHECK DAMS AS SHOWN ON THE APPROVED
PLAN. CLEAR ONLY AS NECESSARY TO INSTALL THESE DEVICES. SEED ALL DISTURBED AREAS IMMEDIATELY
AFTER INSTALLATION.
3.CALL THE ENVIRONMENTAL CONSULTANT FOR AN ONSITE INSPECTION TO OBTAIN A CERTIFICATE OF
COMPLIANCE.
4.BEGIN CLEARING AND GRUBBING. MAINTAIN DEVICES AS NEEDED THROUGHOUT CONSTRUCTION.
5.INSTALL STORM CULVERTS AND HORSESHOE INLET PROTECTION AS SHOWN ON THE APPROVED PLAN.
6.STABILIZE SITE AS AREAS RE BROUGHT UP TO FINISH GRADE. SEED AND MULCH DENUDED AREAS PER
GROUND STABILIZATION TABLE.
7.WHEN CONSTRUCTION IS COMPLETE AND ALL AREAS HAVE BEEN STABILIZED, CALL THE ENVIRONMENTAL
CONSULTANT FOR AN INSPECTION.
8.WAKE COUNTY MUST GRANT PERMISSION TO CONVERT SEDIMENT BASINS TO PERMANENT STORMWATER
CONTROL MEASURES PRIOR TO COMPLETING ANY RELATED WORK.
9.IF SITE IS APPROVED, REMOVE SEDIMENT BASINS PER BASIN REMOVAL SEQUENCE.
10.REMOVE TEMPORARY DIVERSION DITCHES, SILT FENCE, HORSESHOE INLET PROTECTION AND SEED OUT OR
STABILIZE ANY RESULTING BARE AREAS. INSTALL ANY REMAINING PERMANENT EROSION CONTROL DEVICES
SUCH AS VELOCITY DISSIPATORS.
11.WHEN VEGETATION HAS BECOME ESTABLISHED, CALL THE ENVIRONMENTAL CONSULTANT FOR A FINAL SITE
INSPECTION BY THE ENVIRONMENTAL CONSULTANT TO OBTAIN A CERTIFICATE OF COMPLETION.
CONSTRUCTION SEQUENCE
1.THE GRADING CONTRACTOR SHALL COMPLY WITH ALL
STATE AND LOCAL CODES IN OBSERVING EROSION
CONTROL MEASURES BOTH ON AND OFF-SITE.
2.THE GRADING CONTRACTOR SHALL MAINTAIN ALL
EROSION CONTROL DEVICES AFTER EACH RAINFALL
EVENT OR AS DIRECTED BY LOCAL AUTHORITIES OR THE
ENGINEER.
3.THE GRADING CONTRACTOR SHALL BE RESPONSIBLE FOR
OFF-SITE DISPOSAL OF ALL CLEARING AND GRADING
WASTE MATERIALS GENERATED DURING HIS PHASE OF
WORK AND FOR OBTAINING ALL APPLICABLE PERMITS FOR
OFF-SITE STOCKPILES AND/OR WASTE AREAS.
4.THE CONTRACTOR SHALL BE RESPONSIBLE FOR CLEANING
ANY TRACKED SOIL FROM ALL ADJACENT ROADWAYS THAT
ARE IMPACTED BY CONSTRUCTION TRAFFIC.
1.ALL EROSION AND SEDIMENT CONTROL MEASURES
SHALL BE CHECKED FOR STABILITY AND OPERATION
FOLLOWING EVERY RUNOFF-PRODUCING RAINFALL
BUT IN NO CASE LESS THAN ONCE EVERY WEEK.
ANY NEEDED REPAIRS SHALL BE MADE
IMMEDIATELY TO MAINTAIN ALL MEASURES AS
DESIGNED.
2.REMOVE SEDIMENT FROM SEDIMENT SKIMMER
BASINS WHEN STORAGE CAPACITY HAS BEEN
APPROXIMATELY 50% FILLED. CLEAN OR REPLACE
GRAVEL FILTER WHEN THE SEDIMENT POOL NO
LONGER DRAINS PROPERLY.
3.REMOVE SEDIMENT FROM BEHIND SILT FENCE
WHEN DEPTH REACHES 6-INCHES AT THE FENCE.
REPAIR SILT FENCE AS NECESSARY TO MAINTAIN A
BARRIER.
4.ALL SEEDED AREAS SHALL BE FERTILIZED,
RE-SEEDED AS NECESSARY, AND MULCHED
ACCORDING TO PROJECT SPECS TO MAINTAIN A
VIGOROUS, DENSE VEGETATIVE GROWTH.
5.MAINTAIN SILT/TREE PROTECTION FENCING
THROUGHOUT DURATION OF CONSTRUCTION.
DISTURBED AREA = 6.50 ACRES
THE SEDIMENTATION POLLUTION CONTROL ACT WAS AMENDED IN 2006 TO REQUIRE THAT
PERSONS RESPONSIBLE FOR LAND-DISTURBING ACTIVITIES INSPECT A PROJECT AFTER
EACH PHASE OF THE PROJECT TO MAKE SURE THAT THE APPROVED EROSION AND
SEDIMENTATION CONTROL PLAN IS BEING FOLLOWED.
RULES DETAILING THE DOCUMENTATION OF THESE INSPECTIONS TOOK EFFECT OCTOBER
1, 2010.
THE SELF-INSPECTION PROGRAM IS SEPARATE FROM THE WEEKLY SELF-MONITORING
PROGRAM OF THE NPDES STORMWATER PERMIT FOR CONSTRUCTION ACTIVITIES. THE
FOCUS OF THE SELF-INSPECTION REPORT IS THE INSTALLATION AND MAINTENANCE OF
EROSION AND SEDIMENTATION CONTROL MEASURES ACCORDING TO THE APPROVED
PLAN. THE INSPECTIONS SHOULD BE CONDUCTED AFTER EACH PHASE OF THE PROJECT,
AND CONTINUED UNTIL PERMANENT GROUND COVER IS ESTABLISHED.
THE SELF-INSPECTION REPORT FORM IS AVAILABLE AS AN EXCEL SPREADSHEET FROM
THE LAND QUALITY WEB SITE,
HTTP://PORTAL.NCDENR.ORG/WEB/LR/EROSION
NCDENR SELF-INSPECTION PROGRAM
1.SEEDING OR COVERING STOCKPILES WITH TARPS OR MULCH IS
REQUIRED AND WILL REDUCE EROSION PROBLEMS. TARPS SHOULD BE
KEYED IN AT THE TOP OF THE SLOPE TO KEEP WATER FROM RUNNING
UNDERNEATH THE PLASTIC.
2.IF A STOCKPILE IS TO REMAIN FOR FUTURE USE AFTER THE PROJECT IS
COMPLETE
(BUILDERS, ETC.), THE FINANCIAL RESPONSIBLE PARTY MUST NOTIFY
WAKE COUNTY OF A NEW RESPONSIBLE PARTY FOR THE STOCKPILE.
3.THE APPROVED PLAN SHALL PROVIDE FOR THE USE OF STAGED
SEEDING AND MULCHING ON A CONTINUAL BASIS WHILE THE STOCKPILE
IS IN USE.
4.ESTABLISH AND MAINTAIN A VEGETATIVE BUFFER AT THE TOE OF THE

This document confirms that Stancil Builders, Inc. (Applicant) for the Adam’s Vineyards (Project) has
expressed an interest to utilize 0.41 Riparian Wetland Mitigation Credits from the EBX-Neuse
sponsored Neu-Con Wetland & Stream Umbrella Mitigation Bank, specifically 0.41 from the Meadow
Spring Site in the Neuse HUC 03020201. As the official Bank Sponsor, EBX-Neuse I, LLC, attests to the
fact that mitigation is available for reservation at this time.
These mitigation credits are not considered secured, and consequently are eligible to be used for alternate
purposes by the Bank Sponsor, until payment in full is received from the Applicant resulting in the
issuance of a Mitigation Credit Transfer Certificate by the bank acknowledging that the Applicant has
fully secured credits from the bank and the Banker has accepted full responsibility for the mitigation
obligation requiring the credits/units.
The Banker will issue the Mitigation Credit Transfer Certificate within three (3) days of receipt of the
purchase price. Banker shall provide to Applicant a copy of the Mitigation Credit Transfer Certificate and
