Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The 32 -acre project area is located approximately 2,300 feet southeast of the intersection of Erza Moore Road and Bay Road in Teachey, Duplin County, North Carolina. The site is comprised of three parcels. Grey Outdoors, LLC owns Parcel 09-3160 (9.35 acres) and Parcel 09-1813-1 (9.61 acres). The Willoughby -Townsend, LLC owns Parcel 09-7000 (36.4 acres). The site includes all of Parcel 09-3160 (Tract 1) and Parcel 09-1813-1 (Tract 3), and a portion of Parcel 09-7000 (Tract 2). The area west of the electrical easement along Tract 2 is excluded from this assessment. Access Road 1 extends south from Bay Road to the site. Access Road 2 extends north from High School Road to the southern portion of the site. The site consists of a wooded pine flat wetlands and hardwood flat wetlands. Cleared wetlands and debris piles are located on the northern portion of the site. An approximate 100' wide electrical easement traverses the site from north to south. The electrical easement is dominated by herbaceous species and it routinely maintained by Duke Energy. Skid areas (mechanically cleared areas) and organic debris piles are located on the northern portion of the site. A seasonally inundated wetland is located on the north -central portion of the site. Three upland islands are located on the central portion of the site. Jurisdictional wetlands are located on the central and southern portions of the site. Wooded and residential land are located north of the site; 1-40 bounds the site to the east; wooded land bounds the site to the south and west. In June/July 2018, Grey Outdoors, LLC retained a clearing/grading contractor to begin removing vegetation and constructing the lateral access road to the northern most proposed billboard. Construction of the lateral access road began at the southern terminus of Access Road 1. Additionally, a ditch was excavated parallel to the lateral access road. An excavator was utilized to excavate the ditch. The dredged material was sidecast parallel to the ditch to create the lateral access road. Off-site material was not utilized to construct the lateral access road during the construction efforts. A "skid area" was created on the southern portion of Tract 1 and northern portion of Tract 2. The blade of a bulldozer was used to push the upper layer of soil and organic debris to create the skid area. The lateral access road, ditch, dredged material, and skid area all transect jurisdictional wetlands. There are no streams within the site boundary. At the time, the wetlands had not been delineated by a consultant, nor verified by U.S. Army Corps of Engineers (USACE). In July 2018, the USACE observed the wetland impacts via Interstate 40. Mr. Tom Charles of the USACE and Mr. Chad Coburn with DWR performed a site visit with Mr. Grey Vick in July 2018 and July 2019. The USACE and DWR confirmed the construction activity occurred in jurisdictional wetlands. It is our understanding Mr. Vick verbally agreed to restore the wetlands and submit a permit application for the billboard construction project. A violation letter was not issued. 4b. Explain the purpose of the proposed project:* The proposed use of the site is to construct eight (8) billboards along 1-40. Billboard placement is limited to along the eastern boundary as it parallels 1-40 East. Each billboard will be 10' x40' and sit atop three three-foot pilings. Access roads, permanent and temporary, will be constructed to the proposed billboard locations for construction and maintenance purposes. Temporary access roads will be returned to grade after construction is complete. ATVs and 4x4 vehicles will be used to access the site for future maintenance. Refer to site plans for details. A seasonally inundated area on the central portion of the site inhibits access between the northern and southern portions of the site. Therefore, two separate access roads are needed 41. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:* The proposed project involves constructing eight billboards (10' x 40') on the eastern portion of the site along 1-40 East. The billboards will each utilize three 3 -foot diameter pilings for support. Access to three signs on the northern portion of the site will utilize existing Access Road 1. A temporary lateral access road will be utilized to reach Billboard #1. Billboard #2 will utilize an upland access road. In order to reach Billboard #3, a temporary access road will be constructed, traversing wetlands and uplands. The seasonally ponded wetland is located between Billboard #3 and #4. Access Road 2 extends north from Highschool Road and enters the southern portion of the site. The electrical easement is currently maintained and utilized by Duke Energy. The electrical easement serves as an extension of Access Road 2. Primary access to Billboards #4 through #8 will be provided via the electrical easement. Vehicle and equipment access along the easement is routine and performed by Duke Energy. The lateral access roads to Billboards #4 and #5 traverse uplands. The lateral access roads extending east towards Billboards #6, #7, and #8 traverse wetlands and will be permanent. The temporary and permanent access roads wall be eight feet wide. Native earthen material will be utilized to construct the temporary and permanent access road. The temporary access roads will be returned to grade after construction. Utility trucks, pickup trucks, bulldozers, an industrial sized auger, and a crane will be used for construction. Permanent wetland impacts include less than 0.10 -acre of PEM/PFO wetlands that will be cleared and/or filled for billboards and access roads. Noise impacts associated with equipment use will be temporary and negligible as the site is located adjacent to 1-40 and consistently receives road noise from the interstate. Impacts to air quality from diesel powered equipment Wil be temporary and limited to the construction phase. It is our understanding The Willoughby -Townsend, LLC shall retain timber rights to Tract 2. Therefore, the future clearing of Tracts 2 and 3 are not associated with the construction of the billboards. Grey Outdoor, LLC intends to begin construction of Billboards #1, #2„ and #3 as soon as the permit is issued. Construction of Billboards #4 through #8 will not commence until the timber is cleared by deeded entities. The timbering activity is expected to occur within the next two years. Construction of the billboards and access roads will occur during the drier summer months. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Original site plans were to construct permanent access roads without regard for wetlands on site. Impacts to wetlands mould have been near two acres with the original site plan. The second site plans were designed around the wetland delineation completed by Headwater. These site plans were designed to minimize and avoid impacts to the delineated wetlands. Additionally, the lateral access road extending to Billboard #1 has already been constructed without a permit. The revised site plans involved permitting this lateral access road "after the fact. Impacts would have been 0.22 -acre. The final round of site plans minimizes permanent wetland impacts to 0.097 -acre. The unpermitted access road leading to Billboard #1 will be restored to natural grade. The access roads will be limited to 8' wide and partially utilize existing utility easements to reduce impacts. The access roads are to remain "natural" with no fill or gravel anticipated. ATVs and/or 4x4 vehicles will be utilized along the lateral access roads for future maintenance. Grey Outdoor will utilize existing access roads and the Duke Energy electrical easement for primary access to the project area. Upland islands located on the central portion of the site were selected for the placement of three billboards to minimize impacts. A second access road extending north from High School Road will be used to access the southern portion of the site and avoid impacting a seasonally inundated area on the central portion of the site. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Proposed construction of access roads will native earthen material. Access road width will be limited to 8 feet wide to minimize impacts. ATVs and/or 4x4 vehicles will be used along the access roads for future maintenance. Upland islands were utilized for the placement of temporary and permanent access roads to reduce impacts to adjacent wetlands. Dozers, backhoes, and other construction equipment will be used to return temporary access roads back to grade. Access roads will utilize existing roads and the Duke Energy electrical easement as much as possible to minimize wetland impacts. 2.
