Minor Modification to Major Permit
1. John Robbins has requested a Minor Modification to Major Permit
#51-88, which was originally issued on March 7, 1988, transferred on June
5, 2009, renewed on February 12, 2014 and expires on April 30, 2019. The
original major permit authorized excavation throughout the canal systems
and boat basin.
2. John Robbins has requested to modify Major Permit #51-88 to
construct a Fourth vinyl groin.

3. I conducted a site visit on March 16, 2018 to review the Minor
Modification request pursuant to the provisions of reference (a) and have
determined that the request may not meet all the requirements contained
in 15A NCAC 07H .0208 USE STANDARDS. Specifically, the request to
construct a groin may not comply with 07.0208(a)(2)(A) and (E) because
the current design has the potential to create a stagnant water body
between the proposed groin and existing bulkhead that would be parallel
to the proposed structure. Also, looking at aerial photography the
previously permitted groins have caused significant coastal wetland erosion
along the adjacent shorelines. Furthermore, the design of the groin
request is potentially inconstant with 07.0208(b)(9)(A) and (F) because
the current design is 36 feet which is longer than the 25 feet allowed and
there is an "L" at the end of the proposed groin.
4. The required fee of $100, paid by Check # 61955 was received by
the Elizabeth City District Office on June 28, 2017.
5. It is recommended that the Minor Modification request be denied due
to the concerns with stagnant water and possible coastal wetland erosion.

SUBJECT: Request for a Minor Modification of Major Permit #51-88 issued to P.C.
Homeowner's Association
Ms. Rountree:
The Pirates Cove Homeowners' Association (hereafter 'applicant') request the minor
modification of Major Permit #51-88 to include the construction of a fourth vinyl groin.
On June 12, 2014, DCM modified the subject permit authorizing the construction of three vinyl
groins. Thereafter, the applicant constructed the first groin, the southernmost. In a short
period this groin filled to capacity and the construction of the second groin to the north was
necessitated. The second groin is functioning as planned.
The purpose of the groins is to capture material in the nearshore environment that is migrating
from north to south and shoaling the marina entrance channel.
To the south of the southernmost groin and wrapping to the west into the marina, the entirety
of the shoreline is bulkheaded. The area in front of this bulkhead is subject to the fetch
produced from prevailing southerly winds and boat wakes. This activity is causing the erosion
of the shoreline and the material is migrating from east to west into the eastern most boat slip,
Slip 179. Emergency dredging of Slip 179 was just completed.
The purpose of the fourth groin is to prevent the migration of material into Slip 179 and
adjacent slips, and the need for future maintenance dredging.
The groin would be constructed to the east of the existing bulkhead and run parallel to the
existing boardwalk, and thereafter run at an angle to the south terminating on the waterward
side of the boardwalk. The groin would be thirty-six feet (36') in length.
The groin will be constructed in the same manner as the previously constructed groins. On file
your office has engineered drawings that your office stamped on January 24, 2014 and
Morehead stamped on May 27, 2014.
