We wrote to you on 8 February 1994 discussing concerns that we have regarding the design of the project and placing it on hold until those concerns are addressed. As of today, we have not received a response to our earlier letter. Unless we receive a response from you by 21 July 1994, we will consider that you have withdrawn this application and are not interested in pursuing the project at this time. Box 53688 Fayetteville, N.C. 28309 Project #931028 Cumberland County Dear Mr. Maxwell: The Division of Environmental Management, Water Quality Section has reviewed your plans for wetland fill for 0.65 acres of water and wetlands at Reilly Road and Cliffdale Road in Cumberland County for commercial fill. Based on this review, we have identified significant uses which would be removed by this project. These are water storage, pollutant removal and streambank stabilization. Furthermore, insufficient evidence is present in our files to conclude that your project must be built as planned. Therefore, we are moving toward denial of your 401 Certification. Please provide us with information supporting your position that your project must be constructed in wetlands. Specifically can you construct your commercial development on nearby upland? Any documentation such as maps and narrative which you can supply to address upland alternatives may be helpful in our review of your 401 Certification. Please be advised that the Nationwide Permit is not valid until a 401 Water Quality Certification has been issued by the Division. General Certifications have been issue _ by the Division for most of the Nationwide Permits, however, several of the General Certifications require written concurrence from the Division before the Nationwide Permit is valid. Also, this verification will remain valid for the two years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization.
