You have our approval to place fill material in 0.07 acres of wetlands or waters for
the purpose of breaker/delivery station development at Bodie Island,. as you described in
your application dated 11 August 1994. After reviewing your application, we have decided
that this fill is covered by General Water Quality Certification Number 2733. This
certification allows you to use Nationwide Permit Number 18 when it is issued by the
Corps of Engineers.
This approval is only valid for the purpose and design that you described in your
application. If you change your project, you must notify us and you may be required to
send us a new application. For this approval to be valid, you must follow the conditions
listed in the attached certification. In addition,,you should get any other federal, state or
local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an
adjudicatory hearing. You must act within 30 days of the date that you receive this letter.
To ask for a hearing, send a written petition which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box
27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and
binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under
Section 401 of the Clean Water Act. If you have any questions, please telephone John

I am enclosing seven copies of a Nationwide Permit 18 application Mickey Suggs gave me
at the U. S. Army Corps of Engineers site visit to the breaker/delivery station at the north
end of Oregon Inlet on Bodie Island.
I have included a site plan of the station. The dimensions are 50' by 60', or 3000 square
feet, which is well under the 0.1 acre limit for a Nationwide Permit.
Feel free to contact me if you have any questions relating to the permit. We have a
contractor on board and ready to start construction at the station site, so we would greatly
appreciate any acceleration or help you could lend to the permit process. I have also
enclosed earlier correspondence about the project.

Dear Mr. Griffins
Thank you for taking the time, during our telephone conversation today,
to discuss the proposed crossing of Oregon Inlet by the 115 kV Hatteras
Transmission Line Upgrade proposed by Cape Hatteras Electric Membership
Corporation (CHEMC) and North Carolina Electric Membership Corporation
(NCEMC). As described during our conversation, and as outlined in the
project description sent to your office on December 13, 1992, the
electric cable associated with this transmission line upgrade is proposed
to be attached in conduit to the new bridge crossing the inlet. Based on
this description, you explained that the proposed crossing would require
a General Permit from the North Carolina Department of Environment,
' Health and Natural Resources. Consequently, CHEMC and NCEMC will be
securing this permit before attaching the electric cable to the bridge.
Should you have any further comments regarding the proposed Oregon Inlet
crossing, please do not hesitate to contact at the address and telephone

North Carolina Electric Membership Corporation (NCEMC) of Raleigh, North
Carolina and Cape Hatteras Electric Membership Corporation (CHEMC) of
Buxton, North Carolina are in the process of preparing an application to
the Rural Electrification Administration (REA) for the approval of a
proposed electric transmission upgrade project which will be located on
Bodie, Pea and Hatteras Islands in eastern Dare County, North Carolina.
