Rosman, NC 28772 Terry Allen, The Corps has reviewed the Pre -Construction Notification (PCN) application and attachments for the proposed new lakeshore wall at the Lockhart residence, 85-87 Cardinal Drive (PINs 8513-63-0386-000 and 8513-63-2362-000), Lake Toxaway, Transylvania County, NC. Coordinates are 35.15026 N, 82.96145 W. The PCN request utilization of Nationwide Permit (NWP) 29 for construction of a 299 linear foot lakeshore wall. The stated purpose and need for the wall is for boater access, amenities, and water access for residential use. You are requested to submit rational which supports the need to impact 299 linear feet of open waters for the wall (i.e., why 299 linear feet of impacts is needed for boater access, amenities, and water access for residential use?). Conductance of activities in areas outside of the Corps jurisdiction associated with the development of this property does not imply that this office will necessarily approve any future proposal to impact water of the U.S. (WoUS). The conductance of clearing, grading, and construction activities will not affect the Corps review of future proposed impacts to WoUS. The occurrence of clearing grading, and development activities at the property will not be an adequate justification for authorization of future impacts to WoUS. At this time, the request to utilize NWP 29 for authorization of impacts to WoUS for this project is on hold until the above requested information has been received by the Corps.
