Westcott Rt. 1, Box 278A Manteo, N.C. 27954 Dear Mr. Westcott: You have our approval to place fill material in 1456 square feet of waters for the purpose of bulkhead installation at SR 1107, as you described in your application dated 24 March, 1994. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2665. This certification allows you to use Nationwide Permit Number 13 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447: This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: Applicant proposes to stabilize 182 linear feet of shoreline by constructing a 5' wide rip rap bulkhead within the waters of Croatan Sound and backfilling the area lying between the erosion scarp and rip rap bulkhead. John 0. Wescott Rio Report Page Two Site Description The applicant, John G. Wescott, owns an undeveloped 35,000 square foot trapezoidal shaped lot on the east side of SR 1107 (Old Matins Harbor Road), approximately 1,000 feet north of the Matins Harbor Post Office, in Mantis Harbor, Dare County. For a distance of 182 linear feet, the lot fronts Croatan Sound, the waters of which are classified SA by the Division of Environmental Management. The subject lot has no protective bulkhead, but a wooden bulkhead was constructed on the neighboring lot to the north in 1981 and a rip rap bulkhead of undetermined age has been constructed on the abutting lot to the south. Along the 182 linear feet of shoreline of the subject lot is an 8"-12" erosion scarp lying 2 feet landward of the NWL. Approximately 2'-5' waterward of the NWL are stumps of 3 loblolly pines which have been undermined by erosion. At the top of the erosion escarpment is a fringe of salt meadow grass (Spartina patens) varying in width from 2'-12'. The low-lying portion of the lot extends 60'-120' landward of the shoreline and within this area one finds an occasional gall bush (Iva frutescens , sea myrtle (Baccharis halimifolia) or sweetbay interspersed among several cut-over loblolly pine. This low-lying area corresponds closely to the area flagged as "404" wetlands in 1993 by a representative of the U.S. Army Corps of Engineers. The applicant indicated that the "404" wetland line so designated was never surveyed in, but the applicant has attempted to show the approximate location of the limits of the "404" area. As one leaves the low-lying area and walks toward Old Manns Harbor Road, lot elevation slopes steadily upward to a maximum of +6' MSL. The upper portion of the lot is vegetated with a stand of sweetgum and large loblolly pines. The applicant proposes to construct a 5' wide, three' tall rip rap bulkhead which would align with the existing wooden bulkhead on the north and the existing rip rap bulkhead to the south.. The waterward edge of the rip rap bulkhead proposed by the applicant would be placed a maximum distance of 15' waterward of the NWL and an average distance of 6'. Backfill would be placed between the NWL and the landward side of the proposed rip rap bulkhead and not upon any wetlands. Inspections at the site and a review of aerial photos of the site indicate the absence of beds of submerged aquatic vegetation within the SA waters along this shoreline. The application refers to ,a proposed private residence which would be placed outside the 75' wide estuarine shoreline Area of Environmental Concern, but the plat shows no proposed structure.
