Toxaway in Transylvania County. The project should not impact wild trout and a trout moratorium is not needed for this project. We offer a few recommendations to minimize impacts to wildlife: Please note that concrete should be allowed to completely cure (at least 24 hours) in the dry in order to avoid dangerous pH levels in the lake. Lakeshore stabilization should only be constructed if there is obvious and severe erosion; if there is, we prefer that natural methods (bank sloping and bioengineering) be used instead of hardening. The shoreline provides important habitat for wildlife. Fallen trees and other large woody debris along the shoreline are especially important, providing cover for various sunfish, largemouth bass, and other fishes in the lake. In addition, trees and shrubs above the waterline not only stabilize banks but also serve as habitat for wildlife such as song birds. Large woody debris should be left in place or moved temporarily and replaced after stabilization work is complete. Thank you for allowing me the opportunity to review this project. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until the following information is received: 1. The purpose of the proposed project is to provide shoreline stabilization covered under Nationwide Permit Number 13. Please provide photos showing active erosion greater than 3 feet or schedule a site meeting with me to review the proposed project. [15A NCAC 02H .0502(c)] 2. In addition, please indicate how many trees greater than 3" DBH will be removed and details of how the trout buffer will be restored after construction. [15A NCAC 02B .0211(18)] 3. Also, please clarify that the .06 acres of open water impact includes the rip rap apron. [15A NCAC 02H .0502 (c)] Pursuant to Title 15A NCAC 02H .0502 (c), the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received within 30 calendar days, of receipt of this email, the Division will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee.
