On February 11, 1991, we renewed general permit No. CESAW-CO80-N-000-0291
(copy enclosed), which provides Federal authorization for construction
activities that receive authorization from the State of North Carolina.
A review of your application received February 14, 1994, for Department
of the Army authorization to reconstruct a hunt/fish camp over waters/wetlands
of Roanoke Sound, Virgin Island, one-half mile south of the Manteo-Nags Head
Causeway, Dare County, North Carolina, indicates it to be a candidate for
Federal authorization under this general permit. Accordingly, the
administrative processing of your application will be accomplished by the
North Carolina Division of Coastal Management. Comments from Federal review
agencies will be furnished to the State.
If your application must be withdrawn from this general permit process
for any reason, you will be informed regarding its further management. If
there are no unresolved differences in State-Federal positions or policies,
the final action taken on your application by the State will result in your
receiving written notice from us that your application is consistent with the
general permit and you may commence your activity. Only after receiving such
confirmation should you begin work.
Your application, pursuant to Section 10 of the River and Harbor Act, has
been assigned Action ID No. 199401523 and will be coordinated by Mr. Mickey
Sugg in our Washington Field Office. He is available at telephone (919) 975-

Dear Ms. Sawyer,
The referenced fishing camp had been in existence for
many years until destroyed by a recent storm. It is my
understanding that they wish to rebuild and they understand
that current rules now apply.
For sewage disposal they propose to use an incinolet
toilet to handle black waste. This is a state approved
system and we have permitted some of them for certain limited
use situations where a conventional ground absorption cannot
be installed. Thus far, we have experienced no problems with
the use of the incinolets we have previously permitted.
There is no potable water available at this site and
there will be no water using facilities. As they have always
done, they intend to carry potable water for drinking and
cooking purposes. They will be expected to carry back with
them any other waste generated. The camp receives very
limited, occasional use and I anticipate no environmental
harm. The incinolet is an improvement over prior sewage
disposal practices.

INCINOLET uses electric heat to reduce
human waste (urine, solids, paper) to a
tablespoonful of clean ash, dumped
periodically into the garbage. INCINOLET
remains immaculately clean because waste
never touches the bowl surface: a plastic
insert, dropped into the bowl prior to use,

content drop into the incinerator chamber

SETTING
The applicant, Fred Wescott currently owns Virgin Island, an approximate four (4) acre marsh island
located approximately 1/2 mile south of the Nags Head-to-Manteo causeway in Roanoke Sound, Nags
Head, Dare County. Virgin Island is one of the many marsh islands which are located in this area of
Roanoke Sound. The Island is vegetated primarily with coastal wetland vegetation consisting of salt reed
grass (Spartina cynosuroides) and black needlerush Quncus roemerianus). The low elevation of the Island
subjects it to regular flooding by wind-driven waters of Roanoke Sound. Waters of Roanoke Sound
adjacent to Virgin Island are very shallow with scattered patches of submerged aquatic vegetation.
Virgin Island is one of three adjacent islands which have had hunting/fishing camps located on them
since the early 1960's. The hunting/fishing camp that was located on Virgin Island was constructed in
1960 and purchased by the applicant and current owner in 1967. The hunting/fishing camp was maintained
and utilized by the applicant and his family for recreation and retreats. The hunting/fishing camp was
located on the southwestern tip of Virgin Island, with approximately one half of the structure over the
shallow waters of Roanoke Sound and the other half located over the marsh island. Although the stricture
was elevated on pilings, no vegetation existed beneath the structure except around the edges of the structure
where sunlight could penetrate. No toilet or wastewater treatment facilities existed in the structure or on
the Island.
The March, 1993 storm ("Storm of the Century") completely destroyed the applicant's
hunting/fishing camp located on Virgin Island. Only the foundation pilings and a low-elevation, free-
standing, wooden bulkhead along the shoreline of the Island in the vicinity of the structure were left on the
Island. The applicant has not been able to locate any sections or parts of the destroyed structure.
Hunting/fishing camps located on adjacent islands were not. totally destroyed, but were significantly
damaged.
DEVELOPMENT PROPOSAL
The applicant proposes to replace the destroyed 2025 square foot hunting/fishing camp with a new
1768 square foot structure. The new structure is proposed to be located within the foot print of the old,
destroyed structure. The new structure will be elevated 9 feet above MHW on 8" by 8" pilings. The
applicant proposes to install an electric or chemical toilet to handle the structure's wastewater. The
applicant proposes to moor his 16', aluminum, shallow-draft boat beneath the elevated structure.
ANTICIPATED IMPACTS
The proposed construction of a new 1768 square foot structure is proposed within the footprint of the
old structure. This should prevent any further impacts to wetlands or shallow water habitat than what was
occurring with the old structure. Wetlands or shallow water habitat will not be excavated or filled to
construct the new structure. The waters of Roanoke Sound, classified as SA by DEM, will receive some
short-termed increase in turbidity from the placement of the foundation pilings.
