Dear Mr. Howard:
On February 10, 1995, I purchased 10.42 acres of real property
located on U.S. Highway 17 South at Rocky Run Road (S.R. 1221)
from Raleigh Federal Savings Bank, and I was assigned the bank's
rights in the State's certification issued on December 16, 1994
allowing the filling of 1.22 acres of wetlands. Earlier this
week I received from the Land Quality Section of your Washington
Regional Office a certificate approving the erosion and
sedimentation control plan submitted. I have not started filling
the wetlands, but I anticipate doing so in the near future. In
the meantime, I wanted to advise you of my acquisition of this
property and of the rights in the above referenced certification.
I am also advising the Wilmington District Corps of Engineers by
separate letter. Enclosed is a copy of the bank's assignment to
me which I would appreciate your filing with your records
pertaining to the filling of these wetlands.

The undersigned, RALEIGH FEDERAL SAVINGS BANK, (Seller) hereby
assigns, transfers and conveys to KENNEDY W. WARD, (Buyer) all of
its right, title and interest in and to any rights or permits it
has for the filling of the subject property described on attached
Schedule A, or for the installation of a septic tank thereon.
This assignment includes those permits marked as Schedules B
& c attached hereto. Seller agrees to execute any additional
documentation necessary to transfer said rights or permits to
Buyer.

The proposed fill will'facilitgte yQnstruction for an office building and
parking area.
For the purposes of the Corpse of Engineers, Regulatory Program, Title 33,
Cade of Federal Regulations (CI'R) , part 330 , 6
Register on November 22, 1991,' lists natzonwide ppermitsa zAuthorization was
provided, pursuant to Section 404 of the Clean Water Act,,for discharges of
dredged or fill material into headwaters and isolated waters provided:
a. the discharge does not cause the loan of more than 10 acres of waters
of the United States;
C. the discharge, including all attendant features, both temporary and
permanent, is part of a single and Complete project.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions. This
nationwide permit does not relieve you of the responsibility to obtain any
required State or local approval.
This verification will be valid for two years from the date of this
letter unless the nationwide authorization is modified, reissued or revoked.

RE: DEM ID# 941010, Nationwide Permit Application for an activity located off NCSR
1221, in Craven County.
Dear Mr. Cox:
The North Carolina Division of Coastal Management has reviewed the above referenced application for
a Nationwide Permit pursuant to Section 307 of the Coastal Zone Management Act of 1972 as amended.
Based upon our review, we have determined that the proposed activity is consistent with the North
Carolina Coastal Management Program provided the following conditions are met:
1. The activity described in the above referenced application qualifies to receive one of the
Nationwide Permits described in 33 CFR Part 330 with the exception of Numbers 17,
21, 24, and 34 which were found inconsistent with the North Carolina Coastal
Management Program.
2. A 401 Water Quality Certification is received, where required, from the North Carolina
Division of Environmental Management.
This letter does not relieve you of the responsibility to insure that all other State authorization and/or
permit requirements are met prior to implementation of the project. Please feel free to contact me at
