After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 2732 and 2671. These certifications allow you to use Nationwide Permit Numbers 14 and 26 when they are issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Stormwater management shall be done on lots south of Tom Starling Road by sheetflowing stonnwater into wetlands remaining on these lots. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Environmental Management under Section 401 of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786. Drawer 1829 Fayetteville, NC 28302 Re: Compliance Inspection Dear Sirs On November 28, 1994 you were issued General Water Quality Certification Nos. 2671 and 2732 authorizing 2.9 acres of wetland impacts for road crossings and lot fill needed to develop the Cumberland County Industrial Center located off Tom Starling Road south of Fayetteville. This certification was issued only for the impacts shown in your original application. The certification carried the additional condition that stormwater from the lots south of Tom Starling Road shall be directed to sheetflow across the remaining wetlands on those lots. As part of an ongoing compliance monitoring and enforcement program for 401 Water Quality Certifications, Ken Averitte from the Division's Fayetteville Regional Office and myself made a compliance inspection of the Cumberland County Industrial Center on January 16, 1997. From our inspection it appears that your project is not entirely in compliance with the conditions of the certification. We found that a number of the lots had been developed, but much of Technology Drive and Production Drive had not been completed. The problems we found include the following: 1. The plat submitted with the application (dated June 1994) is not accurate with what has been constructed. Only one cul de sac has been constructed on the north side of Tom Starling Road and it is located across from Corporation Drive. 2. Along this cul de sac on the east side is a roadside ditch which cuts through the headwater forest wetland just north of the Cutter Hammer facility. The ditch probably serves to carry water from the stormwater pond but is also serving to drain the wetland. 3. There is a perennial stream running along the north side of Tom Starling Road from Lot 42 through Lot 40 that is not shown on the plat. Will additional road crossings be needed for access to these lots? 4. Although it is stated in your original application that the plat represents the USACOE approved wetland delineation, I question the straight line wetland boundaries shown on Lot 29, the Purdue Foods lot, and the Swift lot. S&EC submitted revisions to NW14 and NW26 permits to the Corps and your office consistent with the existing road alignment in June 1996 (copes attached). Your office approved the change on 6/11/96 and the Corps approved it on 8/12/96 (copies attached). 2. I would like to discuss this with you further by phone or at your office. I do not understand exactly where you are talking about. Do you mean at the end of Distribution Drive under the CP&L R/ W (which is east) or on the north side of Distribution Drive? The ditch under the CP&L R/W has been in existence since the mid-80's and was present when we began our work. 3. Again, I am not quite sure where you mean and would like to discuss this with you. 4. Enclosed is a copy of the Corps signed delineation for the project The straight lines on Lot 29 and the Swift lot are associated with older ditches where water table monitoring justified the approved delineation. The Perdue Foods and Sonfast, Inc. lots were not included in our delineation because they were not owned by our client when we did our work. We do not know the extent of wetlands (if any) on those tracts. Our files indicate that you did not receive a letter of verification for this nationwide permit. The project is located near Fayetteville, NC (Cumberland County) at the NE, SE and SW quadrants of the intersection of SR 2220 (Tom Stalling Rd) and I-95 as shown on the enclosed plans and Hope Mills, N.C. USGS Topo Quad vicinity map. The Corps approved wetland delineation is shown on the attached map. The delineations of impact areas have been approved by Mr. Scott McLendon of the U.S. Army Corps of Engineers. Fill in the wetlands will be required to construct roads and utilize a lot. It will be necessary to fill 2.91 acres (see map) of jurisdictional wetlands above headwaters for placement of some of the proposed roadways and a lot utilizing Nationwide Permits 14 and 26. A total of 1.16 acres (see map) will be impacted for road crossings under Nationwide Permit 14. Road crossings are perpendicular to wetland alignments, in order to minimize impacts. Impacts to lot 42 total 0.35 acres under Nationwide Permit 26. Additional acreage (1.39 acres) requested for under Nationwide Permit 26 is derived from road crossings that do not qualify for Nationwide Permit 14. Please note that the wetland area on lot 42 is of low quality and is an old agricultural field. The wetland was created by grading operations on the site. To expedite the permitting process and to make "life easier" on everyone involved, the following individuals/ agencies have been provided with a complete copy of this entire application package: U.S. Fish and Wildlife Service, National Marine Fisheries, N.C. McLendon and Dorney: The purpose of this letter is to request Nationwide Permits 14 and 26, and a Section 401 Water Quality Certification for the project to be known as Cumberland Industrial Center. The project is located near Fayetteville, NC (Cumberland County) at the NE, SE and SW quadrants of the intersection of SR 2220 (Tom Stalling Rd) and I-95 as shown on the enclosed plans and Hope Mills, N.C. USGS Topo Quad vicinity map. The Corps approved wetland delineation is shown on the attached map. The delineations of impact areas have been approved by Mr. Scott McLendon of the U.S. Army Corps of Engineers. Fill in the wetlands will be required to construct roads and utilize a lot. It will be necessary to fill 2.91 acres (see map) of jurisdictional wetlands above headwaters for placement of some of the proposed roadways and a lot utilizing Nationwide Permits 14 and 26. A total of 1.16 acres (see map) will be impacted for road crossings under Nationwide Permit 14. Road crossings are perpendicular to wetland alignments, in order to minimize impacts. Impacts to lot 42 total 0.35 acres under Nationwide Permit 26. Additional acreage (1.39 acres) requested for under Nationwide Permit 26 is derived from road crossings that do not qualify for Nationwide Permit 14. Please note that the wetland area on lot 42 is of low quality and is an old agricultural field. The wetland was created by grading operations on the site.
