Dear Mr. Spell:
The Division of Environmental Management, Water Quality
Section has reviewed your plans for wetland fill for 0.22 acres
of water and wetlands at Block 43N, S.W. in Carteret County for
residential usage. Based on this review, we have identified
existing uses which would be removed by this project. These are
water storage, aquatic life and wildlife habitat. Furthermore,
insufficient evidence is present in our files to conclude that
your project must be built as planned. Therefore, we are moving
toward denial of your 401 Certification.
Please provide us with information supporting your position
that your project must be constructed in wetlands. Specifically
can you construct your residential development without wetland
fill. A plan showing lot locations is also required by DEM to
complete our evaluation. Any documentation such as maps and
narrative which you can supply to address upland alternatives may
be helpful in our review of your 401 Certification. I understand
that the U.S. Army Corps of Engineers has determined that an
individual permit will be required for this fill. If you pursue
this permit, the information outlined aboved will still be
required.

Dear Sir:
This is to advise that I am in opposition to the request by Mr. Larry
Spell to fill wetland in block 43, Osprey Ridge Subdivision of the beach
area of Emerald Isle. I feel that it is necessary to leave the existing
wetland in order to allow the underground water supply to be
replenished.
The subject of this request is the heir of the Spell estate, one of the
two original developers of the island. The family has fully developed
this island as a business investment and has contributed to the high
density residential lot development. They have done quite well
,however, will have to be regulated to prevent* total exploitation of
the island and their investment. For them its a business , for us it a
matter of health and living standards. The very people that the Federal
Clean Water Act was designed to protect.
In view of the above, I would call upon you to resist the pressure to
commercialize and to allow the wetland to remain untouched.
Your attention to this matter is appreciated.

Dear Mr. Odom:
On September 6, 1989, you met with Mr. Hugh Heine of my staff regarding
your client's plans to develop Block No. 43N, Osprey Ridge Subdivision off
Bogue Sound in Emerald Isle, Carteret County, North Carolina.
The purpose of this onsite meeting was to verify the previously surveyed
wetland alignment. Several points were measured using a 100-foot tape, and
these distances were compared to the scaled drawing. As a result of this
activity it appears that this plat accurately depicts the boundary of the
jurisdiction of Section 404 of the Clean Water Act under the present law and
regulations. Unless there is a change in the law or our published
regulations, this determination of Section 404 jurisdiction may be relied upon
for a period not to exceed two years from this date. Federal permits will not
be required, if all fill material is placed and retained at or landward of the
surveyed wetland line.
This following authorization permits the filling of less than 1 acre of
isolated wetlands. Any additional work will be authorized by pre-discharge
notification under Nationwide Permit No. 26.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations (CFR), Part 330, published in the Federal Register
on November 13, 1986, lists nationwide permits. Authorization was provided
for discharges of dredged or fill material into non-tidal rivers, streams, and
their lakes and impoundments, including adjacent.wetlands, that are located
above the headwaters and other non-tidal waters of the United States,
including adjacent wetlands, that are not a part of a surface tributary system
to interstate waters or navigable waters of the United States.

the purpose of the project is to provide access to the property and to provide
suitable areas for a waste treatment system. It is our understanding that 1.3
acres of fill was authorized pursuant to Nationwide Permit #26 in 1989 to allow
development of the property.
Based on a review of the application, we have concluded that the discharge
would have greater than a minimal adverse environmental impact, including
cumulative impacts, on the aquatic environment.
The wetlands at the project site are part of the larger ridge and swale
maritime forest system that is contiguous with Bogue Sound and the Intracoastal
Waterway. Bogue Sound has been designated an Outstanding Resource Water by the
North Carolina Division of Environmental Management. This designation gives it
and it's drainage area increased regulatory protection as a waterbody with high
water quality.
The wetlands on the project site are typical of a maritime swamp forest
that are contained within a ridge and swale system containing seasonally and
permanently flooded wetland pockets. These wetlands are important for a variety
of reasons in that they are recharge areas for groundwater supplies, they
provide areas where nutrient and pollutant uptake and transformation from
surface runoff can occur, and provide valuable wildlife habitat for various
species of birds, mammals, reptiles and amphibians. In addition, these areas
are particularly susceptible to fragmentation effects that can lead to further
deterioration of the area from exposure to wind and salt spray. Finally, the
cumulative impacts associated with this project are considered to be
unacceptable due to the almost complete removal of the maritime forest system
from Bogue Banks. It is our position that the natural state functions of these
wetlands, as stated above, provide important benefits to Bogue Sound and Emerald
Isle that would be adversely impacted by the proposed fill of 0.22 acres.
Based on the above, we have verified that Nationwide Permit #26 does not
apply to your present proposal as it will result in greater than a minimal,
cumulative impact to the aquatic environment. Should you wish to pursue
Department of the Army (DOA) authorization, you have the option of either
applying for an individual permit or modifying your proposal to minimize impacts
as discussed above. A modified proposal which minimizes wetland impacts should
be submitted for our preliminary review.
