A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers, Nationwide Permit No. 14. An additional condition is that deed restrictions shall be placed on all lots with jurisdictional Wetlands. An example is enclosed. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such demands are made, this Certification shall be final and binding. 1786. Dear John: Enclosed are 7 copies of the "Waterways Edge" 17 lot subdivision of the "Rose-Joyner Tract" owned by the Weyerhaeuser Real Estate Co. out of New Bern. As you can see the land plan allowed for enough high ground to be utilized for a house, septic field and yard space without encroaching into 404 wetlands. Each lot has at least one acre of uplands and an access easement through uplands. The average lot size is about 3.5 acres. The reduced map identifies the 404 wetlands as "W" and high ground as "H". We are unable to begin processing your application until seven copies of a subdivision plan are submitted to ensure that suffrent high ground exists for residential lots. Dear John: Enclosed please find seven copies of the 401 Certification Request for Weyerhaeuser Real Estate's (WEYCO) 358 acre "Rose-Joyner Tract" in Craven County. The 404 wetlands were flagged, surveyed and approved by the Corps in April of 1992. Since that date WEYCO desires to improve the existing ± 30'-35" wide dirt road by widening it: to state DOT specs. After building the-r-o-ad, acreage tracts of 5-25 acres in size will be_made available for sale. ALt:er meeting on the property with Norm Sanders of the Corps and David Nobles of CAMA the following 5 road crossings are proposed within the existing road alignment. All fill impacts will occur as specified on the northern side- of the existing roadway often requiring the filling of an existing 3 ft. road ditch. Gravel will be added to the 20' roadway surface and crowned with 2 six foot grassed shoulders according to state specs. There will be no other fill impacts in wetlands other than this 44 ft. wide roadway improvement as follows: "C_rassin ' Site Description & Comments: ?.. TsolaLed 404 wetland crossing with Pine Flatwoods crossing length at ± 240'; need extra width of 14' due to state specs. Ex.isy?ing forestry read crown is 22' with 6' shoulders and 3' cii.?c;zes. Need to disturb 3360 S.F. using NWP #26. E Isolated Pine Flatwoods 404 wetland crossing with length thru wetlands at ± 510'; need extra width of 12' due to state specs. Existing forestry road crown is 24' with 8' shoulders and 3.5' ditches. Need to disturb 6120 S.F. using NWP #26. C. Adjacent semi brackish 404 CAMA wetland south of the existing crossing of 188' in length; the average width of the existing crossing from toe to toe is 24'; a 30" RCP blocks tidal influence above (north) the crossing and is 404 swampland; the 75 ft. estuarine shoreline AEC falls in cattail marsh down stream of crossing; public trust waters end at the RCP; suggest using NWP #14 for minor road crossings and extend 10' width in northerly direction with low level bulkhead sides and two 36" RCP's; both CAMA and the Army Corp staff have approved the 10 ft. filling (1800 s.f.) to the north where there is no "AEC"being impacted. This is the only crossing using the NWP #14 conditions. D. Isolated 404 wetland crossing which extends ± 545' thru Pine Flatwoods; existing roadway width toe to toe is 26' and therefore needs an additional 16' of fill to shape the existing 2 ft. ditches; this will disturb 8720 s.f. using NWP #26. E. This crossing spans a small tributary drain above the headwaters point which measures 274 ft. in length by 30 ft. in width with no ditches. Additional width required for road improvements is 14 ft. thus filling 3836 s.f. of wetlands using NWP #18. This crossing improvement location is the minimum impact location. As you can see the total cumulative impact is the filling of 23,836 s.f. of woody wetland or .54 acres.
