A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 14. An additional condition is that deed restrictions shall be placed on all lots with wetlands to prevent additional fill (example attached). If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for fills for roads crossing waters of the United States (including wetlands and other special aquatic sites) provided: a. The width of the fill is limited to the minimum necessary for the actual crossing; b. The fill placed in waters of the United States is limited to a filled area of no more than one-third acre. Furthermore, no more than a total of 200 linear feet of the fill for the roadway can occur in special aquatic sites, including wetlands; c. The crossing is culverted, bridged or otherwise designed to prevent the restriction of, and to withstand, expected highflows and the movement of aquatic organisms; d. The crossing, including all attendant features, both temporary and permanent, is part of a single and complete project for crossing of a water of the United States; and Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management (NCDEM) and, in the coastal area, a consistency determination from the North Carolina Division of Coastal Management (NCDCM). William and Mary Price, North River, Carteret County, North Carolina. As a biologist on the Wildlife Resources Commission staff, I have reviewed the subject permit application for the purpose of assessing project impacts on wildlife and fisheries resources. This correspondence is provided in accordance with certain provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and the North Carolina General Statutes ( G. S. 113-131 et seq.). The applicant is requesting authorization to fill 0.26 acres of vegetated wetlands adjacent to Davis Bay to access upland areas for residential development. Loblolly and pond pine dominate the overstory with titi, fetterbush and species of bay prevalent in the sub-canopy. The distribution and location of the interspersed wetlands among the live oak-maritime forest plant community and their function as drainages to the adjacent intertidal marsh accentuates their wildlife habitat values. Based upon the site investigation conducted March 17, 1993 and review of the subject permit application information, it is apparent that the selected route attempts to minimize the amount of wetland area traversed, however, it is my recommendation that an additional measure to preserve wetland functions and values be implemented. The installation of draintile allowing for sufficient water exchange between wetland units to preserve the current hydrology, as well as related wetland plant and animal communities, should be included as a stipulation of authorizing the project.
