The Application provides adequate assurance that the discharge of fill material into the waters of North Toe River in conjunction with the proposed development in Avery County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92- 500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the stream is 25 NTU's or less are not considered significant). A siltation fence shall be installed around the disposal site to prevent off-site sedimentation. Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made conditions of the Federal 404 and/or Coastal Area Management Act Permit. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Region Coordinator Habitat Conservation Program DATE: September 28, 1994 SUBJECT: U.S. Army Corps of Engineers Public Notice No. 199404666, Application by Toe River Club for a permit to excavate accumulated sediment from the North Toe River, Avery County. The North Carolina Wildlife Resources Commission (NCWRC) has reviewed the information provided by the U.S. Army Corps of Engineers, and I conducted a site visit 26 August 1994. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.), and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d.). The applicant proposes to remove approximately 1800 cubic yards of sediment from six pools in the North Toe River (0.2 acre) using a track hoe operated from the bank. Excavated material will be deposited on an approved community dump site one quarter of a mile from the river and a nearby parking lot that experienced severe erosion during recent flooding. Material placed on the parking lot will be contained with a silt fence. Work will be completed by November 1 to avoid the trout spawning season. The purpose of this work is to remove sediment from various pools in the river to restore more favorable habitat for trout and macroinvertebrates. The North Toe River is Hatchery Supported Designated Public Mountain Trout Water upstream and downstream of the river section managed by the Toe River Club. The river also provides good habitat for wild trout. DEWEY WELLS, Post Office Drawer 84, Winston-Salem, North Carolina 27102 has applied for a Department of the Army (DA) permit TO EXCAVATE BY TRAC HOE APPROXIMATELY 1,800 CUBIC YARDS OF ACCUMULATED SEDIMENT FROM THE NORTH TOE RIVER, ALONG S.R. 1157, APPROXIMATELY 3 MILES WEST OF NEWLAND, IN Avery County North Carolina. The following description of the work is taken from data provided by the applicant. Plans submitted with the application show THAT AS A RESULT OF ACCUMULATED SEDIMENT IN THE ABOVE MENTIONED STRETCH OF THE TOE RIVER, IT HAS BECOME NECESSARY TO REMOVE THE SEDIMENT IN ORDER TO IMPROVE INSTREAM HABITAT FOR TROUT SPECIES. APPROXIMATELY 1,800 CUBIC YARDS OF SEDIMENT IS PROPOSED TO BE REMOVED BY A TRACHOE WORKING FROM THE BANKS OF THE RIVER. SIX POOL AREAS WITHIN THE RIVER CHANNEL ARE PROPOSED TO BE EXCAVATED WITH THE TOTAL EXCAVATED AREA TO BE APPROXIMATELY 0.2 ACRES. THE EXACT LOCATION ON THE RIVER WHERE THE PROPOSED WORK IS TO TAKE PLACE IS DEPICTED ON THE ENCLOSED MAPS (INCLUDING THE NEWLAND QUAD SHEET). THE EXCAVATED MATERIAL WILL BE DEPOSITED ON TWO CONTAINED HIGH GROUND LOCATIONS. THESE LOCATIONS INCLUDE A PREVIOUSLY APPROVED COMMUNITY DUMP SITE ONE QUARTER MILE FROM THE RIVER AND A NEARBY PARKING LOT WHICH EXPERIENCED SEVERE EROSION AS A RESULT OF RECENT FLOODING. THE PARKING LOT AREA WILL BE CONTAINED ALONG ITS PERIMETER WITH A SILT FENCE. The purpose of the work is to remove sediment from various pools in the river to restore more favorable habitat for fish spawning and cover and to improve the conditions for the growth of aquatic insect life. Plans showing the proposed work are included with this public notice. Please note that comments for this public notice will be received for a 14 day period rather than the usual 30 days in order that the work not interfere with trout spawning which commences around November 1. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No DA permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management (NCDEM) has determined the applicability of a Water Quality Certificate as required by PL 92-500. Approval of this permit will give Federal authorization for maintenance dredging for a period of time not to exceed 10 years from the date of permit issuance. The permittee will be required to present plans to the District Engineer a minimum of 2 weeks prior to commencement of such maintenance work. All maintenance would be performed in accordance with Federal, State, and local permits and regulations governing such activities at the time the maintenance is undertaken. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware;of the presence of such resources. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Generally, the decision whether to issue this DA permit will not be made until the NCDEM issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the DA permit serves as application to the NCDEM for certification. I Additional information regarding the Clean Water Act certification may be reviewed at the offices of the Environmental Operations Section, NCDEM, Salisbury Street, Archdale Building, Raleigh, North Carolina. Except for a small area to be filled at the "X" location on the second pave of the attached map, the material to be removed from the river will be placed on a previously approved community dump site approximately one-quarter mile from the river. The aforesaid "X" is the location of a parking lot which suffered severe erosion on account of the mid-August 1994 flood. That erosion occurred because the private, low-level bridge across the river acted as a dam and caused the parking area to be washed over by water which otherwise would have remained,"ithin or the near south river bank.. While no run-off into the river is anticipated, we will be prepared to install a silt fence, if necessary, to prevent it. To avoid a recurrence of such over-wash, we plan to remove that low level bridge and replace it with one much higher and which does not require a support or column in the river. THE EXACT LOCATION ON THE RIVER WHERE THE PROPOSED WORK IS TO TAKE PLACE IS DEPICTED ON THE ENCLOSED MAPS (INCLUDING THE NEWLAND QUAD SHEET). THE EXCAVATED MATERIAL WILL BE DEPOSITED ON TWO CONTAINED HIGH GROUND LOCATIONS. THESE LOCATIONS INCLUDE A PREVIOUSLY APPROVED COMMUNITY DUMP SITE ONE QUARTER MILE FROM THE RIVER AND A NEARBY PARKING LOT WHICH EXPERIENCED SEVERE EROSION AS A RESULT OF RECENT FLOODING. The purpose of the work is to remove sediment from various pools in the river to restore more favorable habitat for fish spawning and cover and to improve the conditions for the growth of aquatic insect life. Please note that comments for this public notice will be received for a 14 day period rather than the usual 30 days in order that the work not interfere with trout spawning which commences around November 1. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No DA permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management (NCDEM) has determined the applicability of a Water Quality Certificate as required by PL 92-500. Approval of this permit will give Federal authorization for maintenance dredging for a period of time not to exceed 10 years from the date of permit issuance. The permittee will be required to present plans to the District Engineer a minimum of 2 weeks prior to commencement of such maintenance work. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. (y . _'t?rll„I In keeping with your request, this office has circulated to interested state review agencies U. S. Army Corps of Engineers Public Notice and Action ID. No. 199404666 dated September 22, 1994 which describes a project proposal by the Toe River Club, L.L.C., c/o Mr. Dewey Wells of Winston Salem. The project, involving the removal of sediment from sections of a Designated Public Mountain Trout Water, is located on the North Toe River, along SR1157, west of Newland, in Avery County. Based on a coordinated agency review, the state interposes no objection provided the recommendations of key review agencies are included in the permit. These comments are as follows: Wildlife Resources Commission - does not object to the excavation if long term erosion control is provided and permanent herbaceous vegetation planted on all bare soil within 15 days of ground disturbing activities. Mulch should be used to protect the soil before vegetation becomes established; Division of Environmental Management - issued the required Section 401 Water Quality Certification on October 11, 1994. Certification No. 2931 provides important environmental safeguards; Division of Environmental Health - states that the proposed work is upstream of a proposed raw water intake for Spruce Pines and the Town should be noti- fied. It was implied that the work should be quickly done and not ... "proceed over a ten year period" .... , i.e., the life of the permit.
