managing agent on 28 February 2001. Please accept this letter as a response to your
letter and request for a meeting.
I have reason to believe that through inadvertence of the Association, a mistake
has been made rendering it impossible for the Association to comply with the terms of
your letter. It would be productive to have a meeting involving a representative of the
Board of Directors of the Association, myself and the two of you in order to discuss a
course of action to be taken at this point.

Dear Sirs:
The Division of Water Quality has reviewed your plans to dredge sediment from 1.5 acres of Lake
Loch Lomond located at Lochmere subdivision in Wake County for deepening a portion of the lake as
described in your application dated October 23, 2001 (revised January 30, 2001). Insufficient evidence is
present in our files to conclude that your project must be built as planned in waters and/or wetlands in
accordance with 15A NCAC 2H .0506. Therefore, unless modifications of the proposal are made as
described below, we will have to move toward denial of your 401 Certification as required by 15A NCAC 2H
.0507(e) and will place this project on hold as incomplete until we receive this additional information, we are
requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your project on
administrative hold.
Please provide us with information supporting your position that states your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters and/or
wetlands. Specifically can you remove the spoil from the lake system rather than redepositing it within the
lake? We are concerned about the turbidity violations during this redeposition. Also discuss plan to 1)
stabilize the division ditch to prevent sediment from entering the lake and 2) abandon the ditch once work is
done. Any documentation such as maps and narrative that you can supply to address alternative designs
for your project may be helpful in our review of your 401 Certification.
Please respond within three weeks of the date of this letter by sending a copy of this information to
me and to Steve Mitchell of the Raleigh Regional Office at (919) 571-4700. If we do not hear from you in
three weeks, we will assume that you no longer want to pursue this project and we will consider the project
as withdrawn. I can be reached at 919-733-9646 if you have any questions.

Project DUMBO. WHY?????? Merely moving sediment from shallows to the deeper end
accomplishes nothing. No increase in storage and requires the diversion of a stream in the process.
New sediment basin will require routine maintenance. And what about the buffer along the lake and
the new diversion ditch??

I have attached a pdf file (hopefully you can read it) which has a Corps
Public Notice issued October 23, 2000. The Corps mailed it to us in
October, but we never got it. Finally, Todd Tugwell called in late
January 2001 looking for a response. We've set up a file, and contacted
the applicant, who paid the fee yesterday. I'd like to try and turn
this one around due to the mail glitch (not the applicant's fault) and
it's a relatively innocuous projec It's 1.5 acres of sediment
transferral from the upper end of L ch Lomond to a deeper portion of the
Lake. Please let me know what you t ink. I'll be happy to fax the
Public Notice if you can't read the attachment. There's also an
application, but the PN provides a be ter project description.

Enclosed is the application Lochmere Homeowners Association for Department of the
Army authorization and a State Water Quality Certification to authorize the proposed excavation
of 7,500 cubic yards of accumulated sediments from approximately 1.5 acres of the upper end of
Lake Loch Lomond and discharge of the. excavated material into approximately 1.5 acres of a
deeper portion of the lake, in the Long Branch watershed, associated with Loch Lomond
improvement project, in Cary, Wake County, North Carolina
We are considering authorizing the proposed activity pursuant to Section 404 of the Clean
Water Act, and we have determined that a water quality certification is required under the
provisions of Section 401 of the same law. A Department of the Army permit will not be granted
until the certification has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days after receipt of a
request for certification is a reasonable time for State action. Therefore, if you have not acted on
the request, or asked for an extension of time, by December 16, 2000, the District Engineer will
deem that waiver has occurred.

SUBJECT: Public Notice for Excavation and Construction activities of Lake Loch Lomond, Wake County,
North Carolina, Action ID No. 200021943
Biologists with the North Carolina Wildlife Resources Commission have reviewed the subject document.
Our comments are provided in accordance with provisions of the Clean Water Act of 1977 (as amended), the Fish
and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d), and North Carolina General Statutes
(G.S. 113-i31 et seq.).
The applicant proposes to excavate 7,500 cubic yards of accumulated sediment from approximately 1.5
acres of the upper end of Lake Loch Lomond and discharge the excavated material into approximately 1.5 acres of a
deeper portion (middle) of the lake as part of the Loch Lomond improvement project. This project will impact Long
Branch, a WS-III NSW tributary to Swift Creek, which ultimately drains into the Neuse River.
We have the following comments on this project.
We request that the draining process take place during the cool weather seasons to reduce impacts to
aquatic species.
Sediment will likely become stirred up and suspended during the lake filling process. We request that
discharge from the dam be managed to minimize downstream sedimentation.

project. As we already addressed these issues we have no
problem in trying to implement them.
The regulatory submission did not go into all the
specifics of the project. The following outlines the goals
we already established to safeguard the aquatic life and
discharge flow:
o If this project could not be undertake during periods
of cooler weather we were already going to install
"aerators" to safeguard the aquatic life. The area
to be desilted would require the migration of the
aquatic life from a field which now has a depth of
inches to less than 3 feet to one that will contain a
minimum depth of 6 to 9 feet or more.
o The pond will be drawn down very slowly over a period
of a month or more. The drying process will take
place over a month or more before work actually
begins. Once completed we feel the time to allow
nature to refill the lake could take up to a year.
During all phases we will control the flow of
discharge via managing the dam in order to minimize
down stream sedimentation.

well as, the NC Wildlife Resources Commission of our intent
to undertake this project in the most environm tal safe and
prudent manner.

Enclosed is the application Lochmg re Homeowners Association for Department of the
Army authorization and a State Water Q14ality Certification to authorize the proposed excavation
of 7,500 cubic yards of accuznulatc,-' nts from approximately 1.5 acres of the upper end of
Lake Loch Lomond and discharge of the,Icxcavated material into approximately 1.5 acres of a
deeper portion of the lake, in the Long Branch watershed, associated with Loch Lomond
improvement project, in Cary, Wake County, North Carolina
We are considering authorizing th6 proposed activity pursuant to Section 404 of the Clean
Water Act, and we have determined that.a water quality certification is required under the
provisions of Section 401 of the same la?. A Department of the Army permit will not be granted
until the certification has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days after receipt of a
request for certification is a reasonable time for State action. Therefore, if you have not acted. on
the request, or asked for an extension of'time, by December 16, 2000, the District Engineer will
deem that waiver has occurred.

Lochmere Homeowners Association, c/o HRW Management Corporation, 1183 West
Chatham Street, Cary, North Carolina 27513, has applied for a Department of the Army (DA)
permit TO EXCAVATE 7,500 CUBIC YARDS OF ACCUMULATED SEDIMENTS FROM
APPROXIMATELY 1.5 ACRES OF THE UPPER END OF LAKE LOCH LOMOND AND
DISCHARGE THE EXCAVATED MATERIAL INTO APPROXIMATELY 1.5 ACRES OF A
DEEPER PORTION OF THE LAKt; IN THE LONG BRANCH WATERSHED,
ASSOCIATED WITH LOCH LOMOND-IMPROVEMENT PROJECT, IN CARY, WAKE
COUNTY, NORTH CAROLINA.
The following description of the work is taken from data provided by the applicant and
from observations made during a site visit by a representative of the Corps of Engineers. Plans
submitted with the application show the proposed excavation of 3 feet of accumulated sediments
by bulldozer from approximately 1.5 acres of lake bottom, and the repositioning of the sediments
into 1.5 acres of a deeper portion of the lake bottom to provide for deeper water conditions at the
upper end the lake. The sediments will be moved by bulldozer from the upper portion of the
lake, where existing water depths range from 0 to 6 feet, to the middle if the lake, where existing
depths range from 6 to 9 feet. The 7,500 cubic yards of sediments will be repositioned after
water levels have been lowered to allow dry access to the work areas. Prior to excavation, a
diversion ditch will be dug to transport water entering the lake from Long Branch along the
eastern shoreline to a point below the sediment deposition area. A permanent sediment trap
measuring 10 feet across and 10 feet deep will be excavated immediately downstream of the
discharge of Long Branch into the lake to allow heavier sediments to be trapped before entering
the lake to prevent future sediment accretion. The purpose of the work is to provide for deeper
water at the upper end of the lake. Plans showing the work are included with this public notice.
The State of North Carolina will review this public notice to determine the need for the
applicant to obtain any required State authorization. No Department of the Army (DA) permit
will be issued until the coordinated State viewpoint on the proposal has been received and
reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of
Water Quality (NCDWQ) has determined the applicability of a Water Quality Certificate as
required by PL 92-500.
This application is being considered pursuant to Section 404 of the Clean Water Act (33
U.S.C. 1344). Any person may request, in writing within the comment period specified in the

notice, that a public hearing be held to consider this application. Requests for public hearing
shall state, with particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the National Register of
Historic Places for the presence or absence of registered properties, or properties listed as being
eligible for inclusion therein, and this site is not registered property or property listed as being
eligible for inclusion in the Register. Consultation of the National Register constitutes the extent
of cultural resoftice investigations by the District Engineer, and he is otherwise unaware of the
presence of such resources. Presently, unknown archeological, scientific, prehistorical, or
historical data may be lost or destroyed by work under the requested permit.
The District Engineer, based on available information, is not aware that the proposed
activity will affect species, or their critical habitat, designated as endangered or threatened
pursuant to the Endangered Species Act of 1973.
The decision whether to issue a permit will be based on an evaluation of the probable
impacts, including cumulative impacts, of the proposed activity and its intended use on the
public interest. Evaluation of the probable impacts which the proposed activity may have on the
public interest requires a careful weighing of all those factors which become relevant in each
particular case. The benefits which reasonably may be expected to accrue from the proposal
must be balanced against its reasonably foreseeable detriments. The decision whether to
authorize a proposal, and if so the conditions under which it will be allowed to occur, are
therefore determined by the outcome of the general balancing process. That decision should
reflect the national concern for both protection and utilization of important resources. All factors
which may be relevant to the proposal must be considered including the cumulative effects
thereof. Among those are conservation, economics, aesthetics, general environmental concerns,
wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in
accordance with Executive Order 11988), land use, navigation, shore erosion and accretion,
recreation, water supply and conservation, water quality, energy needs, safety, food and fiber
production, mineral needs, considerations of property ownership, and, in general, the needs and
welfare of the people. For activities involving the placement of dredged or fill materials in
waters of the United States, a permit will be denied if the discharge that would be authorized by
such permit would not comply with the Environmental Protection Agency's 404(b)(1)
guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a
permit will be granted unless the District Engineer determines that it would be contrary to the
public interest.
The Corps of Engineers is soliciting comments from the public; Federal, State and local
agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate
the impacts of this proposed activity. Any comments received will be considered by the Corps of
Engineers to determine whether to issue, modify, condition or deny a permit for this proposal.
To make this decision, comments are used to assess impacts on endangered species, historic
properties, water quality, general environmental effects and the other public interest factors listed
above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an
Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act

306, and 307 of the Clean Water Act. The application and this public notice for the Department
of the Army (DA) permit serves as application to the NCDWQ for certification.
