After reviewing your application, we have decided that this fill is covered by General Water Quality Certification
Number 3108, This certification allows you to use Nationwide Permit Number 26 when the Corps of Engineers
issues it. This approval is also valid for the Neuse River Buffer Rules. In addition, you should get any other
federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and
Erosion Control, Coastal Stormwater, Non-Discharge'and Water Supply Watershed regulations. This approval will
expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General
Certification.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application for a new certification, If the property is sold, the new owner must be given a copy of this Certification
and approval letter and is thereby responsible for complying with all conditions, If total wetland fills for this
project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H ,0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and
any additional conditions listed below,
I, Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas
within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact.
These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is
later),
2, An additional condition is that stormwater shall be directed to sheetflow at non-erosive velocities
through the protected stream buffers,
We understand that you have chosen to contribute to the Wetland Restoration Program in order to compensate
for these impacts to wetlands and/or streams, In accordance with 15A NCAC 2R .0402, this contribution will
satisfy our compensatory mitigation requirements under 15A NCAC 2H ,0506(h). According to 15A NCAC 2H
.0506(h), feet of restoration will be required. Until the Wetland Restoration Program receives and clears your check
(made payable to: DEHNR - Wetland Restoration Program), wetland or stream fill shall not occur. Mr. Ron Ferrell
should be contacted at 919-733-5219 if you have any questions concerning the Wetland Restoration Program. You
have one month from the date of this Certification to make this payment. For accounting purposes, this
Certification authorizes the fill of 1.018 acres of stream butTers in 030402 river and subbasin and 2.907acres

Eric F. and I went to this site on Thursday afternoon 12/26/99 to respond to a
complaint about cutting trees, We determined that they haven't impacted any buffers or
wetlands at that time. The land is being logged by Jim Young / Young Logging Co. Mr.
Young told us that the engineer was John Edwards. Mr. Young stated that they were not
going to be impacting any of the buffers, except for a temporary crossing.
On 12/28/99, I called John Edwards to check on their permit approvals. Mr.
Edwards stated to me that the name of the project was Summit Overlook Apartments and
that the project was approved in October with mitigation. He stated that they were
currently working on finding a buffer restoration site rather than paying into the fund. He
stated that they would not be clearing any buffers until they worked out the mitigation.
On 12/28/99, I checked the files for this project. We issued an approval on 10/7/99
with the condition that they mitigate for 2.907 acres of buffers (or -$121,004). They were
supposed to notify us within 60 days. There's nothing in the file about them notifying us.
They still owe mitigation.
Also, when I looked at the PCN I realized that I submitted it for Kevin/S&EC. I did
not work on the project before that time and only submitted it because Kevin was
swamped. However, I don't think it's a good idea for me to be following up on this one.

The purpose of this letter is to request the use Nationwide Permits 26 and exemption from the Neuse River
Buffer Regulations for the construction of the proposed Summit Overlook Community located west of
Lead Mine Road (SR 1820), east ofCreedmoor Road (Hwy 50) and approximately 0.2 miles northeast of
Glenwood Road (S.R. 1793)(see site vicinity map)(UTM Coordinates; Zone 17, 0709500 E 3969500 N).
Proposed impacts to waters for the construction of the residential community will total 0.06 acres and 431
l.f. for the construction of two access roads. Construction of the subdivision will comply with the general
conditions stated within Nationwide Permits 26.

The total permanent impacts under Nationwide Permit # 26 equal 0,06 acres (i,e., less than 1 acre) and \ ./
the total linear feet of impacts to streams equal 431 feet. If for some reason wetland mitigation is required, )
our client proposes payment into the North Carolina Wetland Restoration Fund.

The proposed impacts to the Neuse River Riparian Buffers are allowed under the current Neuse Ri~'ver
Buffer regulations without requiring a variance from the Environmental Management Commission", ~L
Proposed impacts to the buffers have been limited to two road crossings with a total of 0.92 acres ' U
impacts to Zone 1 and 0,098 impacts to Zone 2. Iffor some reason buffer mitigation is required, ur
client proposes payment into the Riparian Buffer Restoration Fund,

Included are: (1) a completed Pre-Construction Notification Application, (2) Agent Authorization Form,
(3) USGS Site Vicinity Map, (3) Construction Plans, (4) Wetland Delineation Forms and (6) a check for
$475.00 to cover the permit application fee.
