After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 2664, 2732 and 2671. These certifications allow you to use Nationwide Permit Numbers 12, 14 and 26 when they are issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Deed restrictions shall be included on all lots with wetlands not proposed to be filled. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Environmental Management under Section 401 of the Clean Water .pct. If you have any questions, please telephone John Domey at 919-733-1786. The purpose of this letter is to request Nationwide Permits 12, 14, 26 and a Section 401 Water Quality Certification for Phase VI and VII of the project know as Preston Village. The project is located near Morrisville, NC (Wake County) and is bordered by Phase IV, 1, III and V of Preston Village as shown on the enclosed plans and vicinity maps. (Please note the phase #'s referred to reflect the order of permitting and are not the same as the internal phase numbers used for the project because, from the agencies stand point, this is one project, but from a development stand point it is one.) The Corps approved detailed wetland delineation is shown on the attached map. These delienaitons have been approved by Mr. Eric Alsmeyer of the U.S. Army Corps of Engineers. The Corps and DEM previously issued authorizations for Nationwide permits 12,14 and 26 for Phases I, II, and III and IV and V of this project. The enclosed application is for Preston Village phases VI and VII. Fill in wetlands will be required for road crossings, sewerlines, and lots in a residential subdivision (phase VII) and apartment complex (Phase) (see attached maps). Roads crossings are perpendicular to wetlands to minimize impacts as well. It will be necessary to impact a total of 0.505 acres (see maps) of jurisdictional wetlands for placement of the proposed facilities. (See attached joint Application form for acreage impacts by permit type). Previous wetland impacts from Phases I, II, III, IV, V of this project are shown in Table 1 by permit type. To expedite the permitting process and to ease the process for on everyone involved, the folloNving individuals/ agencies have been provided with a complete copy of this entire application package: David Franklin (Wilmington Corps), USF&WS, National Marine Fisheries Service, and Cultural Resources.
