After the site review was completed, Mr. Smith met with Mr. Kevin Martin on September 2, 1994 in order to address some remaining questions and concerns with the subject project. As a result, written correspondence addressing the following issues or concerns is required: -As per your permit application you have requested 0.49 acres under a Nation Wide 12 (utility easements). Therefore, impacts to wetlands (noted on your site plans) on Lot #s 7, 8, 12, 13, 14, 22, 23, 25, 26, 27, 28, 30, 31, 39, 54, 55, 56, 57, 58, 60, 61, 62, 63, 64, 65, 66, 83, 84, 85, 86, 87, 88, 89, 90, 91, 92, 93, 94, 95, 96, 134, 135, 136, 141, 271, 272, 273, 274, 275, 296, 297, 298, 299, 300 are only permitted for utility line easements, which are required to be returned to grade after construction is completed. No additional impacts to wetlands on these lots are approved and no additional wetland impacts have been requested. As a result this office will require a deed restriction which prohibits respective home owners from additional wetland impacts to the aforementioned lots. -Lot #s 169, 170, 238, 247, 248, 249 house wetlands which have not been proposed to be impacted. We have instructed our attorney to prepare the necessary recordation documents to insure that these areas will not be impacted by future property owners. Copies of these documents will be provided to your division once they are prepared. Enclosed for your review are the preliminary sedimentation and erosion control plans prepared by our consulting engineers. These plans encompass phases one through three of the development. Provided below is our response to each of the items referenced as 1 through 5 of the compliance evaluation inspection. The first three items in the CPI address specific issues associated with various lots within the subdivision. After a review of the files it became apparent the lot numbers identified in your correspondence pertain to the original wetlands impact map rather than the subsequent revised plan. To assist you in the lot review process I will reference the original lot numbers as well as the revised numbers. 1. Parmalee Court • The lot opposite 243 (now 223) is lot 622 subject to the wetland deed restriction. • Lot 243 (now 223), piped for approximately 100 feet. • Lots 237 thru 239 (now 227 thru 229), impacts approved. • Lots 248, 247, and 236 (now 218, 219, and 230), subject to the wetland deed restriction. Lot 218 is the subject property that precipitated the NRB vested rights request of April 1, 2002. I. Parmalee Court Any impacts associated with the above referenced lots were performed by subsequent owners. We are investigating; the pipe installation on lot 243 (now 223) to determine when that segment of pipe was installed. Initial approval of this phase of Preston Village North by the 'T'own of Cary occurred in 1994, however, due to Town of Cary sewer capacity constraints, construction activities were not initiated until 1997. 3. Since the required changes involved a redesign of the lot layout, lot numbers referenced in DEM's 9/8/94 letter do not correspond to the current plan. To clarify things the attached map has a tabular listing of previous lot numbers and new lot numbers for lots that are to contain deed restrictions. These lots are also highlighted. We would like to point out that DEM listed lot 238 (currently Lot 228) as one which had no proposed impacts and required a deed restriction. S&EC did request impacts to this lot and an adjacent lot originally and would like these proposed impacts to remain which alleviates the need for such a deed restriction. Original impacts proposed for lots 182 and 183 have been omitted as requested. The revision resulted in a few new minor impacts being necessary (see attached map). That established sediment and erosion control practices are utilized to prevent violations of the appropriate turbidity water quality standard (50 NTUs in streams and rivers not designated as trout waters by DEM;.25 NTUs in all saltwater classes, and all lakes and reservoirs; and 10 NTUs in trout waters) ; 5. Work plans must be legible and sized to 8 1/2 by 11 inches; 6. Measures shall be taken t.o prevent live or fresh concrete from coming into contact with waters of the state until the concrete has hardened; 7. That additional site-specific conditions may be added to projects proposed under this Certification in order to ensure compliance with all applicable water quality and effluent standards; 8. Concurrence from DEM that this Certification applies to an individual project shall expire three years from the date of the cover letter from DEM.
