On August 26, 1994 Danny Smith of the Raleigh Regional Office
met with Mr. Randy Smith for the purpose of a site review for the
above named project. After the site review was completed, Mr.
Smith met with Mr. Kevin Martin on September 2, 1994 in order to
address some remaining questions and concerns with the subject
project. As a result, written correspondence addressing the
following issues or concerns is required:
-As per your permit application you have requested 0.49 acres
under a Nation Wide 12 (utility easements).
Therefore, impacts to wetlands (noted on your site plans) on
Lot #s 7, 8, 12, 13, 14, 22, 23, 25, 26, 27, 28, 30, 31, 39,
54, 55, 56, 57, 58, 60, 61, 62, 63, 64, 65, 66, 83, 84, 85,
86, 87, 88, 89, 90, 91, 92, 93, 94, 95, 96, 134, 135, 136,
141, 271, 272, 273, 274, 275, 296, 297, 298, 299, 300 are only
permitted for utility line easements, which are required to be
returned to grade after construction is completed. No
additional impacts to wetlands on these lots are approved and
no additional wetland impacts have been requested. As a
result this office will require a deed restriction which
prohibits respective home owners from additional wetland
impacts to the aforementioned lots.
-Lot #s 169, 170, 238, 247, 248, 249 house wetlands which
have not been proposed to be impacted. A deed restriction,
prohibiting respective home owners from impacting these
wetlands will also be required.
-Wetland impacts to lots 182 and 183 are required to be
avoided and respective deed restriction prohibiting future
impacts will also be required.

In response to Mr. Tim Donnelly's September 8, 1994 letter, Preston Development
Company agrees to the conditions outlined in paragraphs one through three addressing
restrictive covenants on specific lots. We have instructed our attorney to prepare the
necessary recordation documents to insure that these areas will not be impacted by future
property owners. Copies of these documents will be provided to your division once they are
prepared.
Enclosed for your review are the preliminary sedimentation and erosion control plans
prepared by our consulting engineers. These plans encompass phases one through three of the
development. Applicable notes, stormwater calculations, and erosion control measures are
depicted on these sheets. More detailed plans are not available at this time for other areas
within the subdivision.
After you have reviewed this information, if you have any further questions, or need

Village. Tlie project is located near Morrisville, NC (Wake County) and is bordered by Phase IV
of Preston Village as shown on the enclosed plans and vicinity maps.
Tlie Corps approved detailed wedand delineation is shown on the attached map. Tlmese
delineations have been approved by Mr. Eric Alsnmeyer of the US. Anny Corps of Engineers. Tlme
Corps and DEM previously issued authorizations for Nationwide Permits 12, 14, and 26 for
phases I, II and III and IV of this project. Tlme enclosed application is for Preston Village North.
Fill in wetlands will be regtired for road crossings, sewcrlirmes, and lots in a residential subdivision
(see attached map). Roads crossings are perpendicular to wetlands to rtinitnize impacts as well.
It will be necessary to impact a total of 2.81 acres (see map) of jurisdictional wetlands for
placement of the proposed facilities. (See attached Joint Application form for acreage impacts by
pernt type). Previous wedand impacts from Phases I, II, III, amid IV of this project total 3.00
acres.
Most of die Nationwide 26 permit impact acreage is to an old farm pond (see plans).
To expedite the pennitting process and to case the process for on everyone involved, die following
individuals/agencies have been provided widen a complete copy of dmis entire application package:
David Franklin (Wihmington Corps), USF&WS, National Marine Fisheries Service, and Cultural
Resources.

On May 9, 2002 I received your May 1, 2002 correspondence concerning the above
referenced project. Provided below is our response to each of the items referenced as 1
through 5 of the compliance evaluation inspection. The first three items in the CPI
address specific issues associated with various lots within the subdivision. After a review
of the files it became apparent the lot numbers identified in your correspondence pertain
to the original wetlands impact map rather than the subsequent revised plan. To assist
you in the lot review process I will reference the original lot numbers as well as the
revised numbers.

I. Parmalee Court
Any impacts associated with the above referenced lots were performed by
subsequent owners. We are investigating; the pipe installation on lot 243
(now 223) to determine when that segment of pipe was installed. Initial
approval of this phase of Preston Village North by the 'T'own of Cary
occurred in 1994, however, due to Town of Cary sewer capacity
constraints, construction activities were not initiated until 1997.
3. Filtrona Court
• Street addresses 105, 103, and 102 were described as lots 213 and 214 on
the original impact map, modified to lots 295, 296, and a street stub on the
revised map (now 294 thru 296) on Filtrona Court. Filtrona Court was
constructed as a cul-de-sac rather than a street stub as depicted on the
revised impact map. Impacts approved by original and revised maps.
• Lots 276, 294, and 295 revised to 257, 275, and 276, (now 269, 271, and
272) impacts approved by original and revised maps.
• Lot 54 (now 454), subject to the wetland deed restriction.
4. Deed Restrictions: Attached is a copy of a recorded deed with the wetland
notification and deed restriction as required. All other deeds carry a similar
restriction and are a matter of public record.
5. Mitigation: Attached is an overall plan entitled Wetland Mitigation Pan for
Preston Village, dated December 1, 1994, prepared by Withers & Ravenel
Consulting Engineers. Areas numbered 1 thru 6, totaling 5.95 acres, were created
during the construction of the Prestonwood Huntington Golf Course expansion for
holes 5 thru 12. These golf improvements and Preston Village North mitigation
activities were constructed in 1995. If DWQ would like to review these features,

On April 12, 2002, Steve Mitchell of the Raleigh Regional Office, Bob Zarzecki
and Danny Smith of Central Office of the Division of Water Quality (DWQ) conducted a
site visit at the tract known as Preston Village North, located in Cary,Wake County,
North Carolina. The inspection and site visit was coincident to a vested rights request for
Preston Village North. Accordingly, the site visit and respective file review associated
with Preston Village North revealed impacts to approximately 2.81 acres of wetlands or
waters was previously authorized during the November 18,1994, 401 Water Quality
Certification. However, after comparing impacts approved under this certification to the
actual impacts, verified during the April 12, 2002 field inspection, it was determined that
impacts have occurred on this tract that are in excess of that authorized in the 401 Water
Quality Certification.
As a result of this Compliance Evaluation Inspection of Preston Village North
(Phase V WQC Project # 94705) the following observations, information requests, and
violations of the 401 Water Quality Certification are provided:
1) Parmalee Court
-Lot located opposite from lot 243 (not indicated on plans) contains wetlands and
may have fill deposited within wetland near the front of the lot.
-Lot 243 - the wetlands and stream is piped and filled beyond what was approved in
the 401 Water Quality Certification.
-Lots 237 through 238 - impacts approved within 401 Certification
-Lots 248, 247, and 236- minor rip-rap on bank of small channel, not depicted in
401 Certification
-Lot 248 deck and concrete pad observed in Zone II of the protected Neuse
Riparian Buffer

shall be done as described in the 28 October 1994 letter from Soil and
Environmental Consultant, Inc. Please discuss your compliance status with respect
to mitigation requirements as set forth in the 401 Water Quality Certification.
This Office requires that violations, as detailed above, be abated
immediately. Also please note, these violations and any future violations are
subject to civil penalty assessment of up to $25,000.00 per day for each violation.
This Office requests that you respond to this letter in writing, within 20
days of the receipt of this Notice, to both the DWQ Raleigh Regional Office at the
letterhead address and the DWQ Wetland/401 Unit at 2321 Crabtree Blvd.,
Raleigh, NC 27699-2260. Your response should specifically address the
following items:
1) Provide a written response that addresses each of the above bulleted items.
2) Please provide a clear explanation of the status of your mitigation efforts.
3) As noted above, please provide documentation of a deed restrictions for the

erosion and sediment plan approvals, and plan modifications from the Town

Dear Messers. Dorney and Alsmeyer:
The purpose of this letter is to submit the "final version' of plan revisions for
Preston Village North as requested in a 9/8/94 DEM letter. The project is
located near Morrisville, NC (Wake County) and is bordered by Phase IV of
Preston Village. Our original application was submitted on 8/1/94 and is DEM
Project No. 94705.
Fill in wetlands will be required for road crossings, sewerlines, and lots in a
residential subdivision. The attached map shows only changes made to the
original application or clarifications. Wetland impacts that were not in question
are the same as those in the original application.
Our client originally requested to impact a total of 2.81 acres of jurisdictional
wetlands for placement of the proposed facilities.
Since the required changes involved a redesign of the lot layout, lot numbers
referenced in DEM's 9/8/94 letter do not correspond to the current plan. To
clarify things the attached map has a tabular listing of previous lot numbers and
new lot numbers for lots that are to contain deed restrictions. These lots are also
highlighted. We would like to point out that DEM listed lot 238 (currently Lot
228) as one which had no proposed impacts and required a deed restriction.
S&EC did request impacts to this lot and an adjacent lot originally and would
like these proposed impacts to remain which alleviates the need for such a deed
restriction. Original impacts proposed for lots 182 and 183 have been omitted as
requested.
The revision resulted in a few new minor impacts being necessary (see attached
map). Overall impact acreage was unchanged but the locations were revised
with the final acreages being-

met with Mr. Randy Smith for the purpose of a site review for the
above named project. After the site review was completed, Mr.
Smith met with Mr. Kevin Martin on September 2, 1994 in order to
address some remaining questions and concerns with the subject
project. As a result, written correspondence addressing the
following issues or concerns is required:
-As per your permit application you have requested 0.49 acres
under a Nation Wide 12 (utility easements).
Therefore, impacts to wetlands (noted on your site plans) on
Lot #s 7, 8, 12, 13, 14, 22, 23, 25, 26, 27, 28, 30, 31, 39,
54, 55, 56, 57, 58, 60, 61, 62, 63, 64, 65, 66, 83, 84, 85,
86, 87, 88, 89, 90, 91, 92, 93, 94, 95, 96, 134, 135, 136,
141, 271, 272, 273, 274, 275, 296, 297, 298, 299, 300 are only
permitted for utility line easements, which are required to be
returned to grade after construction is completed. No
additional impacts to wetlands on these lots are approved and
no additional wetland impacts have been requested. As a
result this office will require a deed restriction which
prohibits respective home owners from additional wetland
impacts to the aforementioned lots.
-Lot #s 169, 170, 238, 247, 248, 249 house wetlands which
have not been proposed to be impacted. A deed restriction,
prohibiting respective home owners from impacting these
wetlands will also be required.
-Wetland impacts to lots 182 and 183 are required to be
avoided and respective deed restriction prohibiting future
impacts will also be required.

Tlie Corps approved detailed wedand delineation is shown on die attached snap. These
delineations have been approved by Mr. Eric Alsmeyer of die U.S. Anny Corps of Engineers. Tlie
Corps and DEM previously issued auduorizations for Nationwide Permits 12, 14, and 26 for
Phases I, II and III and IV of this project. The enclosed application is for Preston Village Nordi.
Fill in wetlands will be required for road crossings, sewerlines, and lots in a residential subdivision
(see attached map). Roads crossings are perpendicular to wedands to minuiuze impacts as well.
It will be necessary to unpact a total of 2.8I acres (see map) of jurisdictional wetlands for
placement of die proposed facilities. (See attached Joint Application forni for acreage impacts by
peruut type). Previous wedand impacts from Phases I, II, III, and IV of this project total 3.00
acres.
Most of die Nationwide 26 permit unpact acreage is to an old faun pond (see plans).
To expedite die permitting process and to case die process for on everyone involved, die following
individuals/agencies have been provided widi a complete copy of this entire application package:

APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Smith:
You have our approval to place fill material in 2.81 acres of wetlands or waters for the purpose of
residential development at Preston Village, Phase V, as you described in your application dated I August and
28 October 1994. After reviewing your.applir:aion, we have decided that this fill is covered by General Water
Quality Certification Numbers 2664, 2736 and 2671. These certifications allow you to use Nationwide Permit
Numbers 12, 14 and 26 when they are issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. For this approval to be
valid, you must follow the conditions listed in the attached certification. An additional condition is that
mitigation shall be done as described in the 28 October 1994 letter from a Soil and Environmental Consultants.
A detailed construction and monitoring plan shall be submitted for written DEM approval by 31 January 1995.
Fill shall not be placed on lots 182 and 183. Deed restrictions shall be placed on all lots with jurisdictional
wetlands is not approved for fill. In addition, you should get any other federal, state or local permits before you
go ahead with your project
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition
which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding
unless you ask for a hearing.

Dear Mr. Smith:
You have our approval to place fill material in 2.81 acres of wetlands or waters for the purpose of
residential development at Preston Village, Phase VI, as you described in your application dated 1 August and
28 October 1994. After reviewing your application, we have decided that this F!; is covered by General Water
Quality Certification Numbers 2664, 2732 and 2671. These certifications allow you to use Nationwide Permit
Numbers 12, 14 and 26 when they are issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. For this approval to be
valid, you must follow the conditions listed in the attached certification. An additional condition is that
mitigation shall be done as described in the 28 October 1994 letter from a Soil and Environmental Consultants.
A detailed construction and monitoring plan shall be submitted for written DEM approval by 31 January 1995.
Fill shall not be placed on lots 182 and 183. Decd restrictions shall be placed on all lots with jurisdictional
wetlands is not approved for fill. In addition, you should get any other federal, state or local permits before you
go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition
which conforms to Chapter 150B of the North Carolina General Statutes to l:re Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding
unless you ask for a hearing.
This letter completes the review of the Division of Environmental Manigement under Section 401 of the

United States and subject to the North Carolina Division of Envi-
ronmental Management Regulations in 15A NCAC 2H, Section .0500
and 15A NCAC 2B .0109 and .0201 for the discharge of fill mate-
rial to waters and wetland areas as described in 33 CFR 330
Appendix A (B) (12) of the Corps of Engineers regulations (i.e:,

This certification replaces Water Quality Certification Nt.:mber
1179 issued in January 15, 1977
The State of North Carolina certifies that the specified
category of activity will not violate Sections 301, 302,.303, 306
and 307 of the Public Laws 92-500 and 95-217 if conducted yn
accordance with the conditions hereinafter set forth.
Conditions of Certification:
1. Proposed fill or substantial modification of water or
wetlands under this General Certification requires
written concurrence from the Division of Environmental
panagement;
2. The construciton corridor is limited to 40 feet-in width
and must be.minimized to the maximum extent practicable.
3. Permanently maintained access corridors shall be
restricted to. the mimimum width practicable and may not
exceed 10 feet in width except in locations specified on
maos for vehicular access purposes or at manhole
locations;
4. That established sediment and erosion control practices
are utilized to prevent violations of the appropriate
turbidity water quality standard (50 NTUs in streams and
rivers not designated as trout waters by DEM;.25 NTUs in
all saltwater classes, and all lakes and reservoirs; and
10 NTUs in trout waters) ;
5. Work plans must be legible and sized to 8 1/2 by 11
inches;
6. Measures shall be taken t.o prevent live or fresh concrete
from coming into contact with waters of the state until
the concrete has hardened;
7. That additional site-specific conditions may be added to
projects proposed under this Certification in order to
ensure compliance with all applicable water quality and
effluent standards;
8. Concurrence from DEM that this Certification applies to
an individual project shall expire three years from the
date of the cover letter from DEM.
Non-compliance with or violation of the conditions herein set
fo_th by a specific fill project shall result in revocation of
this Certification for the project.
