On March 7, 1997, DWQ issued a 40 1 Water Quality Certification for your project
(Little River Farm) located near Wads Creek and Little River in Moore County. We
wrote to you on August 5, 1997 discussing concerns that we have regarding the required
mitigation plan and placing it on hold until those concerns are addressed. As of today,
we have not received a response to our earlier letter. Unless we receive a written
response from you by November 1, 1999, we will consider that you have withdrawn this
application and are not interested in pursuing the project at this time.

We are very concerned with activities taking place on the property that runs from the end
of Cobia Street east on E. North Shore Drive. These lots are on a feeder canal. It is
owned by Sunset and Twin Lakes Inc.. Application numbers for percing are 9953458
through 9953472. The health department has taken soil samples from these 15 lots
readying them for percing.

Mrs. Flugel, Town Manager, was specifically asked on October 13 by Joan Cox what the
right ofwuy is on E. North Shore Drive. Mrs. Flugle assured her that the right of way on
the entire North Shore Drive is 60 feet. She was very possitive on this point. because she
had verified this with the town attorney.

This 60 foot right of way between these lots and the lots across the street has not been
included in the plotting of the lots as they are staked, and we feel that you are
inadvertently collecting samples on the right of way. This mistake in the plotting can also
lead to development Oil the right of way if the inaccuracy is not corrected.

The lots cannot be 4500 square feet as required for single family dwellings without 30 feet
of the right of way in the measurements. Even with the 30 feet of right of way
included in the plot, it is questionable if they will meet the 4500 foot requirement. There is
also some very significant question as to whether t1us property is within the hazardous
inlet line. If this is the case, the footage requirement per lot would be 5000 square feet per
lot.

We also question that this might also be affected by the CAMA rule that only 30% of
impervious surfaces can be covered within 75 feet ofMHW. These lots are very shallow
to say the least, and we fear that right of ways are included in the lot size in order to
allow developers to sell and build on the property along the feeder canal.

Your help in investigating this matter would be very much appreciated. We would very
much appreciate it if you could inform us of your findings. Ifit is possible, we would also
appreciate it if you could send us the results of the findings of samples taken on these lots
for testing.

please address your plans to deal with onsite stormwater (e.g. no curb and gutters and
numerous outlets that dissipate/spread out stormwater throughout the wetland).

This Office is considering recommending to the Director that an enforcement
action be pursued for the violations noted above. Please clearly detail the above items in

Dear Mr. Brown:

In response to a complaint and the United States Army Corp of Engineers'
Unauthorized Activity Notification, Mr. Ken A veritte of the Fayetteville Regional Office
conducted a site visit/investigation of the subject project, located along Hwy 211 near
Pinehurst. It was determined that this tract contains both an unnamed tributary to Joes
Fork Creek, a WS III watershed. Also, as determined by the Corp of Engineers,
jurisdictional wetlands are also located on this tract.

The Corp of Engineers determined that approximately 0.99 acres of jurisdictional
wetlands were impacted on this tract prior to the receipt of Corp of Engineer's 404 Permit
and a State 401 Water Quality Certification. Specifically, wetland impacts (fill) which
resulted from the ecavation of a pond, the placement of the respective pond spoil, and
back fill near the wetland edges have occurred. Further, the Corp determined that
additional impacts occurred from ditching/grubbing activities in the wetlands. The total
impact determined by the Corp was 0.99 acres of jurisdictional impacts.

The above mentioned impacts to wetlands without the receipt of a State issued
401 Certification are a violation of 15A NCAC 2H .0501 pursuant to the requirements of
Section 401 of the Clean Water Act. This, violation and any future violations are subject
to Civil Penalty Assessment of $10,000 per day for every day the violation continues.

On June 29, 1999, you met with Mr. A veritte of this office and Mr. Smith of the
Central Office to discuss issues related to the after-the-fact Pre-construction Notification
(This application was placed on hold June 9, 1999). As a result of this meeting, it was
requested that you provide revised plans indicating the minimization of wetland impacts.
Namely, the building and road footprints must be adjusted such that impacts to wetlands
are minimized. Further, it was recommended that the perpendicular road crossing, as
depicted in your current plans, be revisited to investigate the possibility of adjusting this
road crossing such that wetland impacts are further reduced. Subsequent to the DWQ
review and approval of your new site plans, all wetlands that were previously impacted

residential Insufficient evidence is present in our files to conclude that your project must be built as
planned in waters and/or wetlands in accordance with 15A NCAC 2H .0506. .Therefore, unless
modifications of th.e proposal are made as described below, we will have to move toward denial of your
401 Certification as required by 15A NCAC 2H .0507(e) and will place this project on hold as incomplete
until we receive this additional information, we are requesting (by copy of this letter) that the U.S. Army
Corps of Engineers place your project on administrative hold.
Please provide us with information supporting your position that states your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters and/or
wetlands. Specifically can you development by minimizing wetland fill to one- third acre or less? We are
also concerned that additional impacts will occur in the future based on this site plan. Finally you should be
aware that DWQ may pursue penalties for this after-the- fact fill. Any documentation such as maps and
narrative that you can supply to address alternative designs for your project may be helpful in our review of
your 401 Certification.
Please respond within three weeks of the date of this letter by sending a copy of this information
to me and one copy to Mr. Ken A veritte Wilmington Regional Office at 127 Cardinal Drive Extension
Wilmington, N.C. 28405-3900. Ifwe do not hear from you in three weeks, we will assume that you no
longer want to pursue this project and we will consider the project as withdrawn. I can be reached at 919-

Comments:

This is a nearly 100% disturbed site, beyond what is included in the application Based on the
drawings, there has apparently been little or no consideration given to avoidance and/or
minimization It is difficult to believe that the impacts would be limited to those shown on the
drawings IF all the apartments are built as proposed This drainage area is connected to a WSIII
stream If this project is completed as proposed, there would be hardly any room left for storm water
management of any kind Virtually all of the 2+ acres of wetlands have be cleared or degraded to
some extent Among other things, any eventual approval should require at least a basic restoration
plan Also, the numbers in the application don't add up I have talked with the consultant identified
on COE notice, Mr Harold Brady Apparently, the applicant took it upon himself to complete the
application after Mr Brady completed the delineation Alan Davis estimated the impacts at 99 acre
I believe this to be shy of the realistic total impact, although it is less than the amount requested
Until these Questions are resolved, the project should be put on hold or denied
