Subject: Response to Notice of Violation (Nov-2019-PC-0478)

Dear Mr. Aiken:
This requested response is to assure you these proposed violations have our
utmost and immediate attention. We have located documents such as site maps,
etc. that were not in hand upon Mr. Reed's visit. As stated earlier, we have never
witnessed a discharge at our retention pond prior to excavation activities on the
adjacent property. The pond previously percolated. The adjacent property is
lower in elevation (flood plane) than our own. Excavation activities included
clearing all trees and undergrowth. A ditch and berm was excavated along our
property line, then diverted directly to our retention pond and pond berm
creating an outfall. This was observed by Mr. Reed and myself.
We have responded immediately by placing absorbent socks at the newly created
outfall. As of 7/8/2019 the pond has percolated approximately 2' below outfall
level.
Upon the next stormwater event samples will be taken at the discharge, iced and
delivered to Pace Analytical for analysis. Qualitative monitoring will be conducted
and documented at this time and continue as dictated by rainfall.
We have retained Mr. Max Kimmel of Mountain Environmental Services to
consult, present training and proper documentation regarding our SWPP.
Any corrective actions needed to properly resolve the proposed violations will be
taken immediately by my staff and myself to be in compliance 100 %with our
SWPP. Please see enclosed photos.
