CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements of Section 401 Public
Laws 92-500 and 95-217 of the United States and subject to the North Carolina Division of
Environmental Management Regulations in 15 NCAC 2H, Section .0500 to Roger Davis resulting in
no more than 1980 square feet of water in Carteret County pursuant to an application filed on the
6th day of September of 1994 to replace a bulkhead with riprap.
The Application provides adequate assurance that the discharge of fill material into the waters
of North River in conjunction with the proposed development in Carteret County will not result in a
violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of
North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-
500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set
forth.
Condition(s) of Certification:
That the activity be conducted in such a manner as to prevent significant
increase in turbidity outside the area of construction or construction
related discharge (increases such that the turbidity in the stream is 25 NTU's
or less are not considered significant).
The area to be filled in front of the bulkhead shall be no more than eight feet
from the base of the bulkhead.
Violations of any condition herein set forth shall result in revocation of this Certification. This
Certification shall become null and void unless the above conditions are made conditions of the
Federal 404 and/or Coastal Area Management Act Permit.
If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon
written request within thirty (30) days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and
filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. Unless
such demands are made, this Certification shall be final and binding.

I have your- letter, dated September 20, 1994, concerning my CAMA
permit application to place riprap material in front of my
existing bulkhead on 1`,lorth Riper. According to your letter,
there is insufficient information in your file to sripport my
project and you are movinq toward a denial of the /+01 plater
Quality Certification.
If you have visited my property, you Quill realize that my
existing bulkhead is old and can easily be destroyed should high
wave action occur. I note that I have just prirchased this
property and that the last maintenance must have been performed
years ago. Therefore, I desperately need to rrrrdertake emergency
restoration work to prevent erosion of my upland area.
In talking with various people roho are involved with the marine
environment and construction trades, I have h:reen convinced that
ripr ap is far superior to a ,,vertical bulkhead structure, both in
terms of stability and in providing additional habitat ar-ea.s for
marine resources. It is because of this that I have chosen this
type of material to protect my upland property and feel that it
is the best practical aIterrrat ive. I could perhaps limit the
amount of ar-e be filled in front of the bulkhead from a 12'
ide. Hovaever that is about the minimum tjidth
\ that would provide a stable base for the riprap structure and
thus prop; ide adequate protection for my property.
I hope this information is of assistance and will permit yorr to
approve the project and issue the Certification.
If you need any additional information please call (919 728 2487)
or write to me. Meanwhile, if you have not, made a site visit to
my property, please feel welcome to do so and qet a first hand
feeling for the situation. If ,ou do make a visit, I feel sure
you will realize that this project will riot effect the
environment significantly and in fact may increase the habitat
available for marine resources.
I will add that once the riprap is in place, we r'aoul.d like to
reestablish marsh grass, or some such vegetation, at the water
line if that is possible. Perhaps you or F>omeone in ?,,our-
organization could advise ns what to plant and how to instire that
it survives.

RECORD ENDED CONDITIONS OR PERMIT RESTRICTIONS: A site visit was
conducted on September 15, 1994. The applicant proposes to place riprap fill material
approximately 12' waterward of an existing bulkhead. The bulkhead appeared to be very old
and the deadmen were starting to fail. Some minor erosion was noted on the landward side of
the structure. The applicant's proposal to stab' "'6 t structure with riprap will result in the
filling of 1980 sq. ft. of shellfish habitat in S Ope aters. Such a proposal is inconsistent
with 15A NCAC 2B.0201. It is recommended t existing structure be repaired or replaced
along its present alignment to prevent any additional fill requirements in shellfishing waters.
It was also noted that there was a shellfish lease sig approximately 100' waterward of the
applicant's bulkhead.

of an existing bulkhead.

9. NARRATIVE DESCRIPTION: The applicant's property is located at 175 Shore
Drive in the Shell Landing Subdivision, which is located approx. 5 miles north of the
Town of Beaufort, on US HWY 70. Shore Drive is located at the end of NCSR 1301
(Shell Landing Road). The property borders North River and a house has been
constructed on the property. A garage is currently under construction which is located
outside of any Area of Environmental Concern. The property is bulkheaded with
approx 165 linear feet of wooden material and waterward of this structure broken
pieces of concrete material have been placed in North River ranging in widths from 3
to 5'.
The waters at the project site are classified as SA by the Division of Environmental
Management and are open to shellfishing. There is a clam and oyster lease
approximately 100' offshore from the project site which is leased by another land
owner other than the applicant.
The applicant is proposing to place additional pieces of broken concrete in front of the
bulkhead which would be approx 12' waterward of the wooden structure. An approx.
6' wide area landward of the existing bulkhead would be also be filled with dirt and
grassed.
10. Anticipated impacts: The applicant proposes to place approx. 165 linear feet of broken
concrete material approx. 12' waterward of an existing bulkhead. Approximately 150
cubic yards of concrete material would be placed below the Mean HIGH Water Line
(MHW), resulting in approx. 1980 sq. ft. of shallow bottom habitat being filled by the
proposed project. The project would also impact approx. 990 sq. ft. of highground
directly adjacent to the water. This area will need to be immediately stabilized to
prevent sediment runoff from entering adjacent waters.

8 ADDITIONAL INFORMATION
In addition to the completed application form, the follow-
ing items must be submitted:
A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written permission from the owner to carry out
the project.
An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8
1/2 x l l white paper. (Refer to Coastal Resources
Commission Rule 7J.0203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a pan
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
site. Include county road (SR) numbers, landmarks, and
the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.

The Division of Environmental Management, Water Quality Section has reviewed your plans for the
discharge of fill material into 1980 square feet of waters located at 175 Shore Drive along the North River in
Carteret County for shoreline stabilization. Based on this review, we have identified significant aquatic life uses.
Which would be removed by this project. Furthermore, insufficient evidence is present in our files to conclude
that your project must be built as planned in waters and/or wetlands. Therefore, we are moving toward denial of
your 401 Certification as required by 15A NCAC 2B.0109. Until we receive additional information, we are
requesting (by copy of this letter) that the U.S. Army Corps of Engineers and/or the N.C. Division of Coastal
Management place your project on administrative hold.
Please provide us with information supporting your position that your project must be constructed as
planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically
can you construct your bulkhead along its existing alignment in order to minimize fill of these waters? Any
documentation such as maps and narrative that you can supply to address alternative designs for your project

Army authorization and a State Water Quality Certification to place riprap
material waterward of a bulkhead on the North River, Shell Landing, Carteret

of a valid request for certification in accordance with Section 325.2(b)(ii)
of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days
after receipt of a request for certification is a reasonable time for State
action. Therefore, if you have not acted on the request, or asked for an
extension of time, by October 31, 1994, the District Engineer will deem that
waiver has occurred.

9. NARRATIVE DESCRIPTION: The applicant's property is located at 175 Shore
Drive in the Shell Landing Subdivision, which is located approx. 5 miles north of the
Town of Beaufort, on US HWY 70. Shore Drive is located at the end of NCSR 1301
(Shell Landing Road). The property borders North River and a house has been
constructed on the property. A garage is currently under construction which is located
outside of any Area of Environmental Concern. The property is bulkheaded with
approx 165 linear feet of wooden material and waterward of this structure broken
pieces of concrete material have been placed in North River ranging in widths from 3
to 5'.
The waters at the project site are classified as SA by the Division of Environmental
Management and are open to shellfishing. There is a clam and oyster lease
approximately 100' offshore from the project site which is leased by another land
owner other than the applicant.
The applicant is proposing to place additional pieces of broken concrete in front of the
bulkhead which would be approx 12' waterward of the wooden structure. An approx.
6' wide area landward of the existing bulkhead would be also be filled with dirt and
grassed.
10. Anticipated impacts: The applicant proposes to place approx. 165 linear feet of broken
concrete material approx. 12' waterward of an existing bulkhead. Approximately 150
cubic yards of concrete material would be placed below the Mean HIGH Water Line
(MHW), resulting in approx. 1980 sq. ft. of shallow bottom habitat being filled by the
proposed project. The project would also impact approx. 990 sq. ft. of highground
directly adjacent to the water. This area will need to be immediately stabilized to
prevent sediment runoff from entering adjacent waters.

instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the

sectional drawings) drawn to scale in black ink on an 8
1/2 x 11 white paper. (Refer to Coastal Resources

Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's

of plat requirements and it must be sufficiently detailed

The Department of Environment, Health and Natural Resources hereby gives public
notice as required by NCGS 113A-119(b) and 143-215 3(a)(1)(c) that Roger J. Davis of
Carteret County, filed an application on August 12, 1994, for a permit from the Division of
Coastal Management to develop in an Area of Environmental Concern and for certification
from the Division of Environmental Management that a discharge of fill material in project
wetlands will not violate applicable water quality standards.
According to said application, the applicant is proposing to place riprap along the
shoreline waterw rd of an existing bulkhead at 175 Shore Drive, in Shell Landing
Subdivision, on North River, Carteret County.
A copy of the entire application and additional information may be examined (or
copies furnished upon request and payment of reproduction costs) during normal business

8 ADDITIONAL INFORMATION
In addition to the completed application form, the follow-
ing items must be submitted:
A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written permission from the owner to cant' out
the project.
An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8
1/2 x l l white paper. (Refer to Coastal Resources
Commission Rule 7J.0203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
site. Include county road (SR) numbers, landmarks, and
the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit comments
on the proposed project to the Division of Coastal

9 CERTIFICATION AND PERMISSION
