A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 26. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Letters and a memo from Army Corps of Engineers concerning a Nationwide Permit No. 26 for the proposed apartment site. 2. Original site plan. 3. Revised and final site plan. 4. Permit application form. As you can see, our client has been working with the Corps since November of 1987 to try and place an apartment complex on this site. The original site plan impacted 0.65 acres of the total 1.65± acres of wetlands on the Caldwell property. Because of the wetlands and other soils considerations, by adding the Galimore property to the Caldwell property, our client has revised the site plan to eliminate any impacts to the wetlands on both pieces of property. It is my understanding that under a Nationwide Permit No. 26, for projects with less than 1/4 acre fill of wetlands, our site does not require a Section 401 Water Quality Certification. Post Office Box 1604 Concord, North Cacolina 28025 Dear Mr. Drys: On November 17, 1987, you and Mr. Dale Fink, Concord Engineering & Survey, Inc., met with Mr. Hugh Heine of my staff regarding your plans to develop property off an unnamed creek in North Concord, Cabarrus County, North Carolina. You plan to develop a 7.3-acre tract (the former L. M. Caldwell property), on a dirt road off North Carolina Highway 73. A significant-portion of this tract is wetlands which are adjacent to the creek. The wetlands have saturated soils and are vegetated with soft stem rushes, willow, cattails and red maple. Even though these wetlands are located within the streams' headwaters (drainage area is about 188 acres), the required Federal permits must be obtained before any fill material is placed in any waters or wetlands. During this meeting, the wetland contour was flagged and delineated on each side of the creek. You should have your engineering firm to determine the amount of wetlands located on this tract. Once this has been determined, please notify this office and we can discuss the pre- discharge notification for nationwide permit No. 26. As indicated, if dredged or fill material is placed in waters or wetlands without first obtaining the required Department of the Army permits, this activity will constitute a violation of Federal law. The parcel is traversed by an unnamed headwater tributary stream with a drainage area of 188 acres. The total area of streambed and adjacent wetlands was determined to be less than an acre in size. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330, published in the Federal Register on November 13, 1986, lists nationwide permits. Authorization was provided for discharges of dredged or fill material into non-tidal rivers, streams, and their lakes and impoundments, including adjacent wetlands, that are located above the headwaters and other non-tidal waters of the United States, including adjacent wetlands, that are not a part of a surface tributary system to interstate waters or navigable waters of the United States. This general authorization is valid only for work that causes the loss or substantial adverse modification of less than an acre of wetlands. Fill in waters or wetlands in conjunction with the development is authorized by nationwide permit provided it is accomplished in strict accordance with the enc sed r_ n1,d -tYions.
