CERTIFICATION
THIS CERTIFICATION is issued in conformity with the requirements
of Section 401 Public Laws 92-500 and 95-217 of the United States and
subject to the North Carolina Division of Environmental Management
Regulations in 15 NCAC 2H, Section .0500 to Riverlink, Inc in Buncombe
County pursuant to an application filed on the 13th day of December,
1993 to construct a canoe and kayak practice course in the French
Broad River.
The Application provides adequate assurance that the discharge of
fill material into the waters of French Broad River in conjunction
with the proposed development in Buncombe County will not result in a
violation of applicable Water Quality Standards and discharge
guidelines. Therefore, the State of North Carolina certifies that this
activity will not violate Sections 301, 302, 303, 306, 307 of PL
92-500 and PL 95-217 if conducted in accordance with the application
and conditions hereinafter set forth.
Condition(s) of Certification:
1. that the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of construction or construction
related discharge (increases such that the
turbidity in the stream is 25 NTU's or less are
not considered significant).
2. wet (live) concrete shall not be placed -in waters.
Violations of any condition herein set forth shall result in
revocation of this Certification. This Certification shall become null
and void unless the above conditions are made conditions of the
Federal or Coastal Area Management Act Permit.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 2761.1-7447. Unless such
demands are made, this Certification shall be final and binding.

Department of the Army permit modification TO CHANGE THE SCOPE AND
CONSTRUCTION METHODOLOGIES USED TO CONSTRUCT A CANOE AND KAYAK PRACTICE COURSE
AT MILE 147 ON THE FRENCH BROAD RIVER BETWEEN HAYWOOD AND SMITH STREET BRIDGES
in Asheville, Buncombe County, North Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative of the Corps of Engineers. Revised plans submitted with the
modification request show the construction of twelve cast in place concrete
obstacles within a 110-foot-wide by 400-foot-long area along the western
riverbank. The dimensions of the project area have been reduced from the
originally permitted 110-foot-wide by 800-foot-long area. The obstacles are
to be 10-foot-long, 4-foot-wide, and vary from 8-10-feet high depending on the
foundation elevations. Each obstacle is to be anchored by steel bars grouted
into holes drilled into bedrock. Since the obstacles are now to be cast in
place, the applicant proposes to dewater the project area by constructing a
temporary cofferdam, consisting of crusher-run gravel, around the entire
perimeter. Pumps will be used to dewater the interior of the work area in
order to perform the work in-the-dry. The cofferdam, which will involve the
discharge of approximately 1,350 cubic yards of material, is to be completely
removed upon completion of construction of the obstacles. The locations of
the obstacles are to be marked by suspended warning signs and/or a pole marker
atop each one to alert navigators during high flow periods in the river. All
other aspects of the originally permitted project are to remain the same.
Plans showing the work are included with this public notice.
The State of North Carolina will review this public notice to determine
the need for the applicant to obtain any required State authorization. No
Department of the Army permit will be issued until the coordinated State
viewpoint on the proposal has been received and reviewed by this agency, nor
will a Department of the Army permit be issued until the North Carolina
Division of Environmental Management has determined the applicability of a
Water Quality Certificate as required by PL 92-500.

This application is being considered pursuant to Section 10 of the River
and Harbor Act of 1899 (33 U.S.C. 403) and Section 404 of the Clean Water Act
(33 U.S.C. 1344). Any person may request, in writing within the comment
period specified in this notice, that a public hearing be held to consider
this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksite is not registered property or property listed as being eligible
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the requested permit.
The District Engineer, based on available information, is not aware that
the proposed activity will affect species, or their critical habitat,
designated as endangered or threatened pursuant to the Endangered Species Act
of 1973.
The decision whether to issue a permit modification will be based on an
evaluation of the probable impacts, including cumulative impacts, of the
proposed activity and its intended use on the public interest. Evaluation of
the probable impacts which the proposed activity may have on the public
interest requires a careful weighing of all those factors which become
relevant in each particular case. The benefits which reasonably may be
expected to accrue from the proposal must be balanced against its reasonably
foreseeable detriments. The decision whether to authorize a proposal, and if
so the conditions under which it will be allowed to occur, are therefore
determined by the outcome of the general balancing process. That decision
should reflect the national concern for both protection and utilization of
important resources. All factors which may be relevant to the proposal must
be considered including the cumulative effects thereof. Among those are
conservation, economics, aesthetics, general environmental concerns, wetlands,
cultural values, fish and wildlife values, flood hazards and flood plain
values (in accordance with Executive Order 11988), land use, navigation, shore
erosion and accretion, recreation, water supply and conservation, water
quality, energy needs, safety, food and fiber production, mineral needs,
considerations of property ownership, and, in general, the needs and welfare
of the people. For activities involving the placement of dredged or fill
materials in waters of the United States, a permit will be denied if the
discharge that would be authorized by such permit would not comply with the
Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the
preceding sentence and any other applicable guidelines or criteria, a,permit
will be granted unless the District Engineer determines that it would be
contrary to the public interest.

The Corps of Engineers is soliciting comments from the public; Federal,
State and local agencies and officials; Indian Tribes and other interested
parties in order to consider and evaluate the impacts of this proposed
activity. Any comments received will be considered by the Corps of Engineers
to determine whether to issue, modify, condition or deny a permit for this
proposal. To make this decision, comments are used to assess impacts on
endangered species, historic properties, water quality, general environmental
effects and the other public interest factors listed above. Comments are used
in the preparation of an Environmental Assessment and/or an Environmental
Impact Statement pursuant to the National Environmental Policy Act. Comments
are also used to determine the need for a public hearing and to determine the
overall public interest of the proposed activity.
Generally, the decision whether to issue this Department of the Army
permit will not be made until the North Carolina Division of Environmental
Management (DEM) issues, denies, or waives State certification required by
Section 401 of the Clean Water Act. The DEM considers whether or'not the
proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the Department of
the Army permit serves as application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, North
Carolina Division of Environmental Management, Salisbury Street, Archdale
Building, Raleigh, North Carolina. Copies of such materials will be furnished
to any person requesting copies upon payment of reproduction costs.
The North Carolina Division of Environmental Management plans to take
final action in the issuance of the Clean Water Act certification on or after
January 14, 1994.

Water Act certification should do so in writing delivered to the North
Carolina Division of Environmental Management, Post Office Box 27687, Raleigh,

Dear Mr. Dorney:
Enclosed is the application of Riverlink, Inc., for Department of the Army
authorization and a State Water Quality Certification to modify their permit
for construction of a canoe and kayak practice course at rivermile 147 on the
French Broad River in Asheville, Buncombe County, North Carolina. Your
receipt of this letter verifies your acceptance of a valid request for
certification in accordance with Section 325.2(b)(ii) of our administrative
regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification may be required under the provisions of Section 401 of the same
law. A Department of the Army permit will not be granted until the
certification has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days
after receipt of a request for certification is a reasonable time for State
action. Therefore, if you have not acted on the request, or asked for an
extension of time, by February 7, 1994, the District Engineer will deem that
waiver has occurred.

Mile 147 French Broad River Between Haywood and Smith Bridges
Dear Dave and Bob,
This letter supplements our last letter submission dated November 16, 1993, and
responds to items and questions raised during the meeting held on November 19,
1993, at your offices.
Location of Obstacles
The proposed "obstacles" will all be located within the 400 foot by 110 foot area
delineated on the sketch provided to you with our letter dated November 16, 1993.
We would like to retain some flexibility as to the precise location of the "obstacles";
Gold Medal Kayak champion Dr. Winford (Windy) Gordon will be on hand during
the construction phase to choose locations which he deems will produce the most
favorable kayaking conditions. Our contractor Bill Hobson will also be on hand
and we will utilize his extensive knowledge and experience on the river bed to guide
us as to the best and most secure location for each "obstacle."
We propose to locate a pair of "obstacles" as close as is possible to the upstream end
of the delineated area. These will be angled at approximately 45 degrees to the river
flow. They will be located approximately 30 (thirty) feet apart, and on either side of
the channel so as to create a funnel effect. The remaining "obstacles" will be
spotted individually within the course area, and also skewed to the stream flow.
Cofferdam
The temporary cofferdam which will surround the project area will be constructed of
crusher-run rock fill, so as to obtain a relatively impermeable barrier. As shown on
the attached sketch, the top width of the cofferdam will be approximately 10 (ten)
feet, and the side slopes will be 1 1/2 Horizontal : 1 vertical. The top elevation will
be approximately one foot above river level during the construction period.

All "obstacles" will be submerged during flood flow in the river. If necessary, their
locations could be marked by signs hanging from cross wires. It would also be
relatively easy to cast a sleeve into the top of the some or all of the "obstacles", into
which a pole marker could be placed. These poles would be subject to bending or
breaking if hit by large floating debris, and would need to be expendable.
4. Ordinary High Water Level
As discussed with you, "ordinary high water level", is not subject to an exact
definition. It is at approximately elevation 1967 in the area of the course. The top
elevation of the obstacles would also be at approximately elevation 1967. We
understand the 10 year flood level is at elevation 1974.

Dear Dave and Robert,
Thank you for meeting with Dennis Hodgson and Bill Hobson to discuss the canoe
and kayak practice course. I am sorry that I was unable to join you for the meeting.
This is our formal request, on behalf of RiverLink, to modify the construction
method we will use to build the course.
Because the water level in the river is presently very low; we have been able to
examine the natural conditions of the river more thoroughly, and are now able to
propose an alternative construction technique which we believe will have significant
cost and installation advantages.
The modified method we now propose will enable the "obstacles" to be constructed
"in the dry", and will improve the foundation arrangements. Specifically we now
propose the following:

L To construct a temporary rock fill cofferdam around the entire area of the
course as shown on figure 1. This cofferdam will be removed completely when
construction of the "obstacles" is complete.
2. To dewater the area within this cofferdam, by means of pumps, to enable
the work to be performed in-the-dry.
3. To remove what is expected to be a thin layer of sedimentary materials at
the location of each obstacle, thus exposing bedrock, and providing improved
foundation conditions for the "obstacles."
4. To use a temporary wooden form for each "obstacle" into which
concrete will be pumped via a rubber hose from the East bank of the river.
5. To reduce the size of the "obstacles" since these can now be formed in
place and securely anchored to bedrock. Each "obstacle" will now not exceed 10
(ten) feet by 4 (four) feet in plan dimensions, and will be of simple rectangular
configuration, and will be from 8 (eight) to 10 (ten) feet high depending on the
foundation elevations. At least 4 (four) of these "obstacles" will be angled to the
direction of water flow thus providing a pointed upstream face which will more
easily deflect floating debris.
6. To further strengthen the stability of the "obstacles" each will be
anchored by at least two 1" or 1 1/8" steel bars grouted into holes drilled into
bedrock.
7. We also propose to shift the overall area of the course approximately
150 (one hundred and fifty feet) upstream (conditional upon approval from DOT to
allow the two upstream "obstacles" to be located within the bridge right-of-way. If
this approval is not forthcoming we would locate the two upstream "obstacles"
immediately downstream of the bridge right-of-way.) This proposed move is to take
advantage of the natural rock formations in the area. Furthermore, the overall
length of the course would be decreased from 800 (eight hundred) feet in the already
issued permit to not more than 400 (four hundred) feet.
8. All other matters in relation to the permit action I.D. # 199100325 to
remain the same
We hope that our permit modification request is clear and responsive to your

essence for this project. The river has such a low flow that building conditions now
are ideal. Also the NC Water Resource grant folks are concerned that if we don't
build the course now it will take another year to build which could jeopardize our
funding source.
I believe that we finally have all of the pieces of the puzzle put together and that this
course could be completed within a 30 day time frame once construction commences.
Your help and advise to this point has been invaluable, please help us move swiftly
through this modification process.

In keeping with your request, this office has circulated to interested state review agencies
U. S. Army Corps of Engineers Public Notice Action ID. 199100325 dated December 16, 1993
which describes a project proposed by Riverlink, Inc. of Asheville. The present request is to
modify an existing permit to reconfigure a canoe and kayak course on the French Broad River
at mile 147, in Asheville, in Buncombe County.
Based on a coordinated agency review, the state interposes no objection to this permit
modification. Important environmental recommendations were submitted by two key agencies
as follows:
Wildlife Resources Commission
1) If plaement of the obstacles results in erosion of river banks at the project site and
downstream, the applicant should protect banks where needed with paving stone
or riprap;
2) We reiterate that wet concrete is toxic to fish and other aquatic organisms and
stress that the cofferdam should be adequate to fully isolate the work area from
live river water so that a fish kill is avoided;
Division of Environmental Management - on February 28 issued the required Section
401 Water Quality Certification. Certification No. 2878, a copy of which was forwarded
to your office, includes important environmental safeguards.
