A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 16. Additional conditions are: 1.) that the disposal area shall be lined with a 6 mil thick polyethylene liner. The polyethylene shall be folded together so that one foot "interlocks" are made. The seams shall then be secured with a compatible tape. The liner shall proceed up the dike to a minimum height that will be above the level of the dredge spoil. 2.) that the soil obtained for the construction of the berm shall be obtained from outside the disposal area and be from a clean upland source. 3.) that all debris inside the spoil area that could puncture the liner shall be removed prior to placement of the liner. 4.) that a water control outlet shall be installed as part of this disposal system. The outfall shall be at an area as close as possible to an existing ditch. 5.) that the permittee shall notify the Groundwater Section Supervisor 24 hours in advance of the placement of the liner. At that time issues concerning SAV or shellfish resources in the area were unresolved. It is my understanding the channel width has been reduced and will avoid SAV and shellfish resources. Per the attached memo from the Groundwater Section it is recommended that the 401 Certification for dredge spoil dewatering be issued and that it contain the following conditions: 1. We looked at the CWA and decided that since the 401 was to be based on 303 standards , then we would have trouble claiming that groundwater standards would be violated. He agreed with me that groundwater standards were not developed in response to the CWA. The CWA does have provisions for protecting groundwater but I'm not aware of reference to standards. Someone in the GW program might shed more light on that. He agreed with me that if the lagoon were occurring in a wetland, then we might could say that the wetlands standards (that are being developed) would apply. Now we could say that this certification is actually a permit under 143-215.1 and we can't issue a state permit "cause or permit any waste to be discharged or intermixed with the waters of the State in violation of WQ standards" (143-215.1(6) and since this refers to groundwater standards, then 401 applies to GW. We could also use 143-215.1(b)(1) with says the Commission "shall act on all permits so as to prevent ... any significant increase in pollution of the waters of the state". Of course, there is some disagreement as to whether the 401 is a permit covered under this power of the commission. Other than those, I would question using groundwater to deny the activity. Of coarse, the Corps uses migratory fowl to deny permits, therefore it seems that they could use groundwater too. You might push them into helping us stretch this one. These restrictions follow 15 NCAC 2B. 0216 (c) (2) for ORW-classified waters. Once these data are available, DEM will be able to comment to DCM. It is unknown at this time to what extent submerged aquatic vegetation (SAV) occurs in the proposed impacted area. However, the area adjacent to the existing kicked channel is been mapped as SAV habitat by the National Marine Fisheries Service. It is also unknown at this time to what extent shellfish resources occur in the project area. 15A NCAC 2B .0216 (c)(2) (Outstanding Resource Waters) States that no dredge or fill activities will be allowed where significant shellfish or SAV bed resources occur, except for maintenance dredging. Until surveys are conducted to determine the extent of such resources in the area, this Office cannot provide recommendations concerning the dredging portion of this project, however if no shellfish or SAV resources exist within the bounds of the current kicked channel, this Office would have no objection to dredging within this area already impacted. Per the attached Memo from the Groundwater Section, the use of the proposed spoil disposal area will likely result in contravention of groundwater standards. A site meeting was held on October 12, 1993, along with Charles Jones (DCM), Bruce Reed (Groundwater Section), Frank Adkins (County Engineer), and J.C. Davis (Owner of spoil disposal site). As a result of the meeting, Frank Adkins will submit groundwater and soil data for the spoil disposal site for review by the Groundwater Section. PROJECT SUMMARY: Carteret County is proposing to excavate a navigational access channel in Core Sound which will provide improved access to Core Sound from the community harbor in Davis. FIELD INVESTIGATION REPORT: CARTERET COUNTY PAGE #2 9. NARRATIVE DESCRIPTION: Carteret County is proposing to maintain a navigational channel in Core Sound which provides access to a community boat harbor and fish house facility in the community of Davis. The present channel is used primarily by commercial fishermen who tie-up their boats in the existing boat harbor and to those who tie-up at different locations but sell their catch to the fish house that is also located in the harbor. Over the years a channel has been created and maintained by propeller wash from the larger trawlers which use the channel. There has apparently always been some "bumping" of the bottom with the larger boats which has created some problems during certain wind and tidal conditions. These problems were however greatly compounded after the March Storm of '93 since the channel has shoaled-in at several locations. It is estimated that the existing channel is approx. 20' to 30' wide and -1.8 to -5.25' MLW deep. Directly adjacent to the channel it is estimated that there is an approx. 10 to 20' wide "impact" area where suspended sediment from the channel falls out. The waters of Core Sound have been designated as "SA" and "ORW" by the Division of Environment Management and are open to the harvesting of shellfish except for the harbor and an area of Core Sound directly adjacent to the harbor entrance. The areas adjacent to the existing channel has been mapped as Submerged Aquatic Vegetation (SAV) Habitat by the National Marine Fisheries Service (NMFS). Core Sound is widely known for its fisheries and shellfish resources. It can be assumed, however, that shellfish resources within the existing channel and adjacent impacted areas would be limited. Carteret County is proposing to improve the access channel by hydraulically excavating a navigational channel which will have a bottom width dimension of approx. 53' with a top width of approx. 75'. The length of the proposed channel is approx. 1600 linear feet and is proposed to be excavated to a depth of -5.25' MLW deep. The majority of the excavated material should be sand and is proposed to be pumped underneath US Highway 70 (via an existing culvert) to an approx. 2.5 acre agricultural field which is located approx. 1300' west of the Highway. Effluent water from the diked disposal area is proposed to be discharged into an existing farm field ditch which ultimately discharges into the Highway's drainage canal. The applicant has provided documentation from the US Soil Conservation Service which states that the spoil disposal area would qualifies as a prior converted wetlands if need be. 10. ANTICIPATED IMPACTS: The project as proposed will result in approx 120,000 sq. ft. of bottom area being excavated to a depth -5.25' MLW deep. Approx. 10,000 cu. yds. of primarily sand material would be excavated by hydraulic dredge and pumped to a diked disposal area which is located some distance away in an approx. 3 acre agricultural field(s). Until a more detailed site analysis is preform, it is not known whether any impacts will occur to either SAV or shellfish habitats. Increased levels of turbidity may also be expected during the dredging operation but should be short-termed in duration. PROJECT SUMMARY: Carteret County is proposing to excavate a navigational access channel in Core Sound which will provide improved access to Core Sound from the community harbor in Davis. FIELD INVESTIGATION REPORT: CARTERET COUNTY PAGE #2 9. NARRATIVE DESCRIPTION: Carteret County is proposing to maintain a navigational channel in Core Sound which provides access to a community boat harbor and fish house facility in the community of Davis. The present channel is used primarily by commercial fishermen who tie-up their boats in the existing boat harbor and to those who tie-up at different locations but sell their catch to the fish house that is also located in the harbor. Over the years a channel has been created and maintained by propeller wash from the larger trawlers which use the channel. There has apparently always been some "bumping" of the bottom with the larger boats which has created some problems during certain wind and tidal conditions. These problems were however greatly compounded after the March Storm of '93 since the channel has shoaled-in at several locations. It is estimated that the existing channel is approx. 20' to 30' wide and -1.8 to -5.25' MLW deep. Directly adjacent to the channel it is estimated that there is an approx. 10 to 20' wide "impact" area where suspended sediment from the channel falls out. The waters of Core Sound have been designated as "SA" and "ORW" by the Division of Environment Management and are open to the harvesting of shellfish except for the harbor and an area of Core Sound directly adjacent to the harbor entrance. The areas adjacent to the existing channel has been mapped as Submerged Aquatic Vegetation (SAV) Habitat by the National Marine Fisheries Service (NMFS). Core Sound is widely known for its fisheries and shellfish resources. It can be assumed, however, that shellfish resources within the existing channel and adjacent impacted areas would be limited. Carteret County is proposing to improve the access channel by hydraulically excavating a navigational channel which will have a bottom width dimension of approx. 53' with a top width of approx. 75'. The length of the proposed channel is approx. 1600 linear feet and is proposed to be excavated to a depth of -5.25' MLW deep. The majority of the excavated material should be sand and is proposed to be pumped underneath US Highway 70 (via an existing culvert) to an approx. 2.5 acre agricultural field which is located approx. 1300' west of the Highway. Effluent water from the diked disposal area is proposed to be discharged into an existing farm field ditch which ultimately discharges into the Highway's drainage canal. The applicant has provided documentation from the US Soil Conservation Service which states that the spoil disposal area would qualifies as a prior converted wetlands if need be. 10. ANTICIPATED IMPACTS: The project as proposed will result in approx 120,000 sq. ft. of bottom area being excavated to a depth -5.25' MLW deep. Approx. 10,000 cu. yds. of primarily sand material would be excavated by hydraulic dredge and pumped to a diked disposal area which is located some distance away in an approx. 3 acre agricultural field(s). Until a more detailed site analysis is preform, it is not known whether any impacts will occur to either SAV or shellfish habitats. Increased levels of turbidity may also be expected during the dredging operation but should be short-termed in duration.
