Based on this review, we have determined that the proposed fill is covered by General Water Quality Certification No. 2671. A copy of the General Certification is attached. This Certification is necessary for coverage under Corps of Engineers' Nationwide Permit No. 26. This action completes DEM's review under Section 401 of the Clean Water Act. Culver_ting (piping) of stream channels shall not exceed 200 feet in any one location. Adequate sediment and erosion control measures shall be taken and maintained to prevent offsite erosion into protected wetlands. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Subject: Hideaway Farms Golf Course - Proposed Larry Wagoner 940000041 Graham, NC (Alamance County) Date: 940228 A site visit was conducted on 940224 of this proposed golf course. The site appeared to be suited for this type of recreational development. Generally, the most wetland impacts from the project will be caused by impounding streams. The area appears to have been agriculturally drained years ago so there are no apparent or remaining extensive wetlands in the immediate vicinities of the proposed crossings or proposed impoundments. The WSRO recommended on site that the extent of piping for fairways and crossings be minimized to the fullest extent possible in the intermittent streams which are to be piped and covered for fairways. The extent of any wetlands was bank to bank, more or less. The developer concurred with trying to reduce these distances as much as possible. Essentially, this will mean that piping on these intermittent streams will not extend further than 200 feet per pipe section or stream crossing. The Region rated the wetland area downstream and associated with stream crossings (#s 3 & 4) at the Number 3 fairway. These wetlands (BHD) appear to be providing significant water quality and habitat functions. Although not scheduled for any impacts, the area should be afforded protection from fairway grading and sedimentation losses. These wetlands should be able to provide for significant long-term pollutant removal and golf course run-off buffering especially during and after heavy rainfall events (see attached map). Any suggested protection for these areas that the 401 permit could provide would probably be helpful to the land designer and/or the developer. These wetlands are shallow and cannot withstand much if any sediment loading. This project should be revisited WQ and LQ. This project consists of developing an 18-hole golf course, clubhouse/parking area, entry road, and maintenance area. Construction is scheduled to begin in the spring of 1994 with the anticipated completion 12 - 14 months later. Certification is requested for wetland discharge fills of less than one-acre under NWP #26 (.9 AC). The majority of this fill is for a golf course irrigation pond. In addition, four (4) temporary construction crossings (NWP #33) and one (1) utility crossing (NWP #12) are included in the applications. All proposed crossings are located over unnamed tributaries of the Haw River and are positioned to minimize the amount of wetland fill. Only four (4) of the total 18 golf holes require wetland filling in order to build fairways. In each case crossings are perpendicular to the wetland in order to decrease the amount of filling, and all conditions are bank to bank. The irrigation pond is centrally located to serve the entire golf course, and is located in a bank to bank condition-up stream from the Haw River. In all cases, Best Management Practices will be employed to minimize wetland impacts during golf course contraction and operation.
