Upon review of your request for 401 Water Quality Certification
to place fill material in 0.18 acres of wetlands or waters which are
tributary to Jones Creek for sewer line installation located at Anson
County Regional WWTP in Anson County as described in your submittal
dated 6 January 1993, we have determined that the proposed fill can be
covered by General Water Quality Certification No. 2664. A copy of
the General Certification is attached. This Certification may be used
in qualifying for coverage under Corps of Engineers' Nationwide Permit
No. 12.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative

Upland portions of the outfall relocation situated within road right-of-way are
unlikely to contain important archaeological remains. However, areas near the Pee
Dee River may contain potentially significant archaeological resources. Please
send us additional information concerning the nature, depth, and width of pipeline
construction activities in the area adjacent to SR 1827 and the Pee Dee River.
Upon receipt of this information we will continue our review.
We have conducted a search of our files and are aware of no structures of
historical or architectural importance located within the planning area.

BIOLOGICAL ASSESSMENT FOR ANSON COUNTY
TREATED WASTEWATER FORCE MAIN
INTRODUCTION
The Anson County Regional Wastewater Treatment Plant is currently
operating under the terms of a Special Order of Consent (SOC) from the North
Carolina Division of Environmental Management (DEM). The SOC resulted from
significant restrictions in discharge limits of heavy metals and toxicity at the
treatment plant. These limits resulted from a DEM model that classified the stream
receiving the treated effluent as "no flow".
In an effort to address this situation in a cost wise manner, it was decided,
with DEM's concurrence, to pump the treated effluent in a new force main to the
Pee Dee River, where adequate dilution exists. This assessment was written to
address potential impacts of the force main construction on species listed as
threatened or endangered, or proposed for such listing, by the U.S. Fish and
Wildlife Service (USFWS) or the State of North Carolina.
PROJECT AREA
The project area is located in southeastern Anson County in the transition
zone between the Sandhills and southeastern Piedmont of North Carolina (Figure
1). The topography is hilly, varying from 350 feet to 90 feet above mean sea level at
the Pee Dee River. The ridges tend to be broad and relatively flat, and slope, in
places steeply, into broad stream floodplains. The steepest topography is located
around the Regional Wastewater Treatment Plant, north of the Town of Morven.
Soils are clays, sands, and silt loams characteristic of this transition area between the
Sandhills and Piedmont.
The dominant land uses are forestry and agriculture. Considerable timber
harvesting has occurred in recent years in the immediate project corridor, and a
large acreage remains in pine plantations of various ages, particularly east of N.C.
Highway 145.

PROJECT DESCRIPTION
The project will be approximately 8.6 miles long, nearly all located along
State Roads 1121, 1812, 1829, and 1827 (Figure 1). The 24 inch diameter main will
be constructed in existing, mostly cleared, road right-of-ways from the existing
Regional Wastewater Treatment Plant located approximately 2.25 miles north of
Morven, to an outfall on the Pee Dee River, 5.25 miles east-southeast of Morven.
Most of the pipe will be laid within 5 to 15 feet of existing roads. Though the actual
trench will only be approximately 3 feet wide, the area disturbed by temporary spoil
and machinery may be up to 20 feet wide. Some limited clearing of vegetation may
be required on roads with narrow right-of-ways. One pipeline section that crosses a
large wetland near the Pee Dee River will be buried beneath an existing dirt road
(SR 1827). Where the pipeline crosses streams, it will be buried beneath the
streambed using best management practices. The outfall at the Pee Dee River will
be a concrete raceway that will discharge directly into the river.
METHODS
Protected species that potentially occur in the project area are listed in Table
1. Of these, the red-cockaded woodpecker ( Picoides borealis ) (RCW) and
Sweinitz's sunflower (Helianthus sweinitzii) were judged to be the most likely to
occur.
The project site was surveyed between 6-13 October 1993 by wildlife
biologists and botanists familiar with the species of concern and their habitats.
Survey methods involved walking and driving the proposed right-of-way, and
investigating appropriate habitats on foot. Surveys for RCW cavity trees extended
up to one-half mile off either side of the right-of-way in appropriate habitats (pine
or pine-hardwood stands more than 25 years old). Young pine stands were ground-
truthed for residual mature pines that could contain RCW cavities. Plant surveys
were generally restricted to the immediate area of the right-of-way in appropriate
habitats. Roadsides and abandoned fields were carefully searched for Sweinitz's
sunflower since this species can occur in these previously disturbed habitats.
Another species of concern, the short-nosed sturgeon ( AciWnser
brevirostris) could occur in the Pee Dee River. Due to the difficulty of sampling for
this anadromous species, no specific surveys were conducted for it. There are

historical records for this species in this portion of the Pee Dee, and it could still
occur up to Blewett Falls Dam.
RESULTS AND DISCUSSION
No listed species were found during our surveys. Little habitat exists in the
project corridor for RCWs or other protected species other than Sweinitz's
sunflower. Nearly all pine stands in the project corridor are less than 30 years old.
Potential habitats for the sunflower were thoroughly searched at the appropriate
time of the year with negative results ( Helianthus resinosus and H. tuberosus were
found).
The bald eagle ( Halieetus leucocephalus ) could occur in the project area, but
no nesting or foraging habitat will be directly impacted.
Potential impacts to the short-nosed sturgeon are harder to assess. Jones
Creek, the current recipient of the treated effluent, empties into the Pee Dee River
at a point approximately 4 miles north of the new proposed discharge point. The
effluent discharged at the new outfall will not benefit from the filtering effect of
several miles of streambed, as is currently the situation. However, DEM apparently
feels the new discharge will not have a negative effect on the Pee Dee River
because of the large dilution factor (note that the City of Rockingham is moving
their wastewater discharge into the Pee Dee River just upstream from Anson
County's proposed site for essentially the same reason). Anson County's modest
discharge projection of 2 MGD is considered unlikely to adversely effect the
sturgeon, which is not known with certainty to still occur in the immediate project
area.
Secondary impacts of this project are considered to be minimal. The project
area is sparsely developed, and the presence of the force main is not likely to
stimulate new development. In addition, the force main would be difficult to tap.
The primary secondary impact will be the improvement of water quality in Jones
Creek, and eventual recovery of its aquatic communities.
There should be no negative impacts to wildlife habitats. The force main will
be buried in existing, mostly cleared, road right-of-ways. No significant clearing of
forested habitats is anticipated in conjunction with this project, with the possible
exception of a small area for the outfall itself. The removal of the serious pollution
source from Jones Creek will have positive wildlife and fishery impacts.

Impacts to jurisdictional wetlands and waters will be limited to crossings of 3
named creeks (North Fork, Jones, and Mill) (143 linear feet), 6 small jurisdictional
waters (167 linear feet), and a freshwater marsh near the Pee Dee River (851 linear
feet). Impacts to the marsh will be minimized or avoided by burying the pipe
beneath an existing dirt road (SR 1827). Best management practices will be
employed to limit the extent and duration of turbidity associated with construction
activities.
CONCLUSIONS
This project, as designed, will not adversely effect any species listed as
threatened or endangered, or proposed for such listing, by the USFWS or the State
of North Carolina.

BIOLOGICAL ASSESSMENT FOR ANSON COUNTY
TREATED WASTEWATER FORCE MAIN
INTRODUCTION
The Anson County Regional Wastewater Treatment Plant is currently
operating under the terms of a Special Order of Consent (SOC) from the North
Carolina Division of Environmental Management (DEM). The SOC resulted from
significant restrictions in discharge limits of heavy metals and toxicity at the
treatment plant. These limits resulted from a DEM model that classified the stream
receiving the treated effluent as "no flow".
In an effort to address this situation in a cost wise manner, it was decided,
with DEM's concurrence, to pump the treated effluent in a new force main to the
Pee Dee River, where adequate dilution exists. This assessment was written to
address potential impacts of the force main construction on species listed as
threatened or endangered, or proposed for such listing, by the U.S. Fish and
Wildlife Service (USFWS) or the State of North Carolina.
PROJECT AREA
The project area is located in southeastern Anson County in the transition
zone between the Sandhills and southeastern Piedmont of North Carolina (Figure
1). The topography is hilly, varying from 350 feet to 90 feet above mean sea level at
the Pee Dee River. The ridges tend to be broad and relatively flat, and slope, in
places steeply, into broad stream floodplains. The steepest topography is located
around the Regional Wastewater Treatment Plant, north of the Town of Morven.
Soils are clays, sands, and silt loams characteristic of this transition area between the
Sandhills and Piedmont.
The dominant land uses are forestry and agriculture. Considerable timber
harvesting has occurred in recent years in the immediate project corridor, and a
large acreage remains in pine plantations of various ages, particularly east of N.C.
Highway 145.

PROJECT DESCRIPTION
The project will be approximately 8.6 miles long, nearly all located along
State Roads 1121, 1812, 1829, and 1827 (Figure 1). The 24 inch diameter main will
be constructed in existing, mostly cleared, road right-of-ways from the existing
Regional Wastewater Treatment Plant located approximately 2.25 miles north of
Morven, to an outfall on the Pee Dee River, 5.25 miles east-southeast of Morven.
Most of the pipe will be laid within 5 to 15 feet of existing roads. Though the actual
trench will only be approximately 3 feet wide, the area disturbed by temporary spoil
and machinery may be up to 20 feet wide. Some limited clearing of vegetation may
be required on roads with narrow right-of-ways. One pipeline section that crosses a
large wetland near the Pee Dee River will be buried beneath an existing dirt road
(SR 1827). Where the pipeline crosses streams, it will be buried beneath the
streambed using best management practices. The outfall at the Pee Dee River will
be a concrete raceway that will discharge directly into the river.
METHODS
Protected species that potentially occur in the project area are listed in Table
1. Of these, the red-cockaded woodpecker ( Picoides borealis ) (RCW) and
Sweinitz's sunflower (Helianthus sweinitzii) were judged to be the most likely to
occur.
The project site was surveyed between 6-13 October 1993 by wildlife
biologists and botanists familiar with the species of concern and their habitats.
Survey methods involved walking and driving the proposed right-of-way, and
investigating appropriate habitats on foot. Surveys for RCW cavity trees extended
up to one-half mile off either side of the right-of-way in appropriate habitats (pine
or pine-hardwood stands more than 25 years old). Young pine stands were ground-
truthed for residual mature pines that could contain RCW cavities. Plant surveys
were generally restricted to the immediate area of the right-of-way in appropriate
habitats. Roadsides and abandoned fields were carefully searched for Sweinitz's
sunflower since this species can occur in these previously disturbed habitats.
Another species of concern, the short-nosed sturgeon ( Aci_pgnser
brevirostris) could occur in the Pee Dee River. Due to the difficulty of sampling for
this anadromous species, no specific surveys were conducted for it. There are

historical records for this species in this portion of the Pee Dee, and it could still
occur up to Blewett Falls Dam.
RESULTS AND DISCUSSION
No listed species were found during our surveys. Little habitat exists in the
project corridor for RCWs or other protected species other than Sweinitz's
sunflower. Nearly all pine stands in the project corridor are less than 30 years old.
Potential habitats for the sunflower were thoroughly searched at the appropriate
time of the year with negative results ( Helianthus resinosus and H. tuberosus were
found).
The bald eagle ( Halieetus leucocWhalus ) could occur in the project area, but
no nesting or foraging habitat will be directly impacted.
Potential impacts to the short-nosed sturgeon are harder to assess. Jones
Creek, the current recipient of the treated effluent, empties into the Pee Dee River
at a point approximately 4 miles north of the new proposed discharge point. The
effluent discharged at the new outfall will not benefit from the filtering effect of
several miles of streambed, as is currently the situation. However, DEM apparently
feels the new discharge will not have a negative effect on the Pee Dee River
because of the large dilution factor (note that the City of Rockingham is moving
their wastewater discharge into the Pee Dee River just upstream from Anson
County's proposed site for essentially the same reason). Anson County's modest
discharge projection of 2 MGD is considered unlikely to adversely effect the
sturgeon, which is not known with certainty to still occur in the immediate project
area.
Secondary impacts of this project are considered to be minimal. The project
area is sparsely developed, and the presence of the force main is not likely to
stimulate new development. In addition, the force main would be difficult to tap.
The primary secondary impact will be the improvement of water quality in Jones
Creek, and eventual recovery of its aquatic communities.
There should be no negative impacts to wildlife habitats. The force main will
be buried in existing, mostly cleared, road right-of-ways. No significant clearing of
forested habitats is anticipated in conjunction with this project, with the possible
exception of a small area for the outfall itself. The removal of the serious pollution
source from Jones Creek will have positive wildlife and fishery impacts.
Impacts to jurisdictional wetlands and waters will be limited to crossings of 3
named creeks (North Fork, Jones, and Mill) (143 linear feet), 6 small jurisdictional
waters (167 linear feet), and a freshwater marsh near the Pee Dee River (851 linear
feet). Impacts to the marsh will be minimized or avoided by burying the pipe
beneath an existing dirt road (SR 1827). Best management practices will be
employed to limit the extent and duration of turbidity associated with construction
activities.
CONCLUSIONS
This project, as designed, will not adversely effect any species listed as
threatened or endangered, or proposed for such listing, by the USFWS or the State
of North Carolina.
