Also attending were Mr. Rodney Woolard of the U.S. Soil Conservation Service, and Ms. Deborah Sawyer and Mr. John Dorney of the North Carolina Division of Environmental Management. The meeting was to discuss your Department of the Army permit application dated July 27, 1993, for Nationwide Permit No. 26 (NWP 26) (Headwaters and Isolated Waters), to construct two (2) dams across the channel of Haw Branch, a primary tributary to Tranters Creek, off SR 1415, near Washington, Beaufort County, North Carolina. Each of the dams would include the placement of fill material into approximately one-half (1/2) acre each, flooding approximately another two (2) acres each. Total impacts to wetlands would be approximately 5 acres. As Mr. Sanders explained to you at the meeting, the National Marine Fisheries Service (NMFS) has reviewed your proposal and has expressed concerns regarding adverse impacts to anadromous fish. They recommend that this project be advertised on public notice to allow a full review by resource agencies. Mr. Sanders furnished you a copy of their letter for your review. Mr. Sanders informed you that we concur with NMFS in respect to concerns on fishery migration. Mr. Dorney also informed you that a State Water Quality Certification would not be issued for projects adversely impacting anadromous fisheries. Therefore, we have determined that the proposed irrigation ponds would not comply with the conditions of NWP 26, Headwaters and Isolated Waters. During the onsite portion of the meeting, you agreed to redesign the ponds, relocating them off the main channel, eliminating any direct impacts on anadromous fisheries. Should you wish to pursue the construction of the irrigation ponds at these locations, you should submit the revised drawings to the address at the top of this page. Upon receipt of your revised drawings, we will re-issue the pre-discharge notification to the appropriate agencies, to solicit comments in regard to the proposed work. -2- Thank you for your time and cooperation. Based upon our review, we have determined that the proposed activity is not inconsistent with the North Carolina Coastal Management Program provided the following conditions are met. 1. The activity described in the above application qualifies to receive one of the Nationwide Permits described in 33 CRF Part 3F0 with the exception of Numbers 17, 21, 24, and 34 which were found inconsistent with the North Carolina Coastal Management Program. 2. A 401 Water Quality Certification is received, where required, from the North Carolina Division of Environmental Management. 3. All fill material authorized by this permit must be obtained from an upland source. This letter does not relieve you of the responsibility to ensure that all other State authorization and/or permit requirements are met prior to implementation of the project.
