Per your request, we agree to transfer the federal consistency concurrence
for project number DEM 93-076 originally provided to Evangelical Lutheran
Church of America dated 4/22/93 to you. Our concurrence is conditional,
as it was with Evangelical Lutheran Church, you must receive a 401 Water
Quality Certification from the North Carolina Division of Environmental
Management.
We understand that you are primarily concerned with filling the two areas
on your property denoted as a 40' by 50' diamond-shaped area and 20'
diameter circle on the plat recently provided to our office. However, DCM
staff observed during a recent site visit that, consistent with the Corps
original wetland determination, the entire site is a wetland. Therefore,
issuing a consistency concurrence or 401 Water Quality Certification for
just the two small areas will not provide you with adequate state
authorization for any development proposed on other parts of the property
as any buildings or parking areas or driveways will involve wetland fill.
This transfer does not relieve you of the responsibility to insure that
all other State authorization and/or permit requirements are met prior to
implementation of the project.

REFERENCE: DEM93-076 Nationwide Permit Application for an activity located in
Brunswick County, NC: Fill Wetlands for Site Development
Dear Ms. Bishop:
The NC Division of Coastal Management has reviewed the above referenced application for a
Nationwide Permit dated 02/04/93 pursuant to Section 307 of the Coastal Zone Management Act of 1972
as amended. Based upon our review, we have determined that the proposed activity is consistent with
the North Carolina Coastal Management Program provided the following conditions are met.
1. The activity described in the above application qualifies to receive one of the Nationwide Permits
described in 33 CFR Part 330 with the exception of numbers 17, 21, 24, and 34 which were found
inconsistent with the North Carolina Coastal Management Program.
2. A 401 Water Quality Certification is received, where required, from the NC Division of
Environmental Management.
This letter does not relieve you of the responsibility to insure that all other State authorization
and/or permit requirements are met prior to implementation of the project. Please feel free to contact Mr.

In response to our phone conversations on 26 and 29 March
1993, you are correct t-Aat my earlier letter was wrong when it
stated that you had requested to fill 8.83 acres of wetlands
rather than 1.83 acres.. However our questions still remain and
will require an answer before we can-permit this fill. If the
Corps of Engineers has determined that less than one acre of
wetland is present on your property, please enclose a copy of any
correspondence from them which indicates the amount of wetlands
on the site.

The Division of Environmental Mana ater Quality Section has
reviewed your plans for wetland fill fo 83 acre of wetlands at Hwy. 87 and
133 in Brunswick County for construction of s r ge building. Based on this
review, we have identified significant uses which would be removed by this
project. These are water stgrage and wildlife habitat. Furthermore,
insufficient evidence is present in our files to conclude that your project must
be built as designed in wetlands. Until we receive this information, we are
requesting (by copy of this letter) that the U.S. Army Corps of Engineers and/or
the N.C. Division of Coastal Management place your project on administrative hold
since the application is not complete.
Please provide us with information supporting your position that your
project must be constructed as designed in wetlands. Specifically can you
construct your storage buildings on a smaller portion of the site? In other
words, does the entire site need to be cleared and filled for the storage
buildings and related facilities Any documentation such as maps and narrative
which you can supply to address upland alternatives may be helpful in our review
of your 401 Certification. Please respond within two weeks of the date of this
letter. We are also uncertain as to the eventual buyer of the property. Since
the 401 Certification must be issued in his or her name, you will need to inform
us of the buyer's name and address.

for discharges of dredged or fill material into headwaters and isolated waters

activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date of

Dear Ms. Bishop:
On January 13, 1993, you met with Mr. Rudolf Schiener, of my Wilmington
Field Office staff on a property owned by Evangelical Lutheran Church of
America, ELCA Fund, and located on N.C. Highway 87, in Boiling Spring Lakes,
Brunswick County, North Carolina, to determine the presence of wetlands
subject to our regulatory jurisdiction pursuant to Section 404 of the Clean
Water Act. It was determined during this site visit that this 1.8 acre site
was located in wetlands.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization was provided, pursuant to Section 404 of the Clean Water Act,
for discharges of dredged or fill material into headwaters and isolated waters
provided:
a. the discharge does not cause the loss of more than 1 acre of waters o:
the United States; or
b. the permittee notifies the District Engineer if the discharge would
cause the loss of waters of the United States greater than one but less than
10 acres in accordance with the "Notification" procedures (see below). For
discharges in special aquatic sites, including wetlands, the notification must
also include a delineation of affected specific aquatic sites, including
wetlands; and
c. the discharge, including all attendant features, both temporary and
permanent, is part of a single and complete project.
It has been verified that your proposed work may be authorized under
paragraphs b. and c. above by this nationwide permit. Enclosed is a Pre-
Discharge Notification form which should be completed and returned with a
Section 401 Water Quality Certification from the North Carolina Division of
Environmental Management (DEM). Please contact Mr. Jim Gregson, DEM, at
telephone (919) 395-3900, for procedures on obtaining this certification.

Failure to obtain this authorization automatically results in a denial of your
proposal. once all necessary information is received a permit decision will
be reached within 30 days.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date of
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.
