Our concurrence is conditional, as it was with Evangelical Lutheran Church, you must receive a 401 Water Quality Certification from the North Carolina Division of Environmental Management. We understand that you are primarily concerned with filling the two areas on your property denoted as a 40' by 50' diamond-shaped area and 20' diameter circle on the plat recently provided to our office. However, DCM staff observed during a recent site visit that, consistent with the Corps original wetland determination, the entire site is a wetland. Therefore, issuing a consistency concurrence or 401 Water Quality Certification for just the two small areas will not provide you with adequate state authorization for any development proposed on other parts of the property as any buildings or parking areas or driveways will involve wetland fill. Furthermore, insufficient evidence is present in our files to conclude that your project must be built as designed in wetlands. Until we receive this information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers and/or the N.C. Division of Coastal Management place your project on administrative hold since the application is not complete. Please provide us with information supporting your position that your project must be constructed as designed in wetlands. Specifically can you construct your storage buildings on a smaller portion of the site? In other words, does the entire site need to be cleared and filled for the storage buildings and related facilities Any documentation such as maps and narrative which you can supply to address upland alternatives may be helpful in our review of your 401 Certification.
