Alsmeyer and Dorney:_ The purpose of this letter is to request Nationwide Permits 12, 14, 26, and a Section 401 Water Quality Certification for the project to be known as Brookstone. These delineations have'been'approved-by Mr. Eric Alsmeyer of the U.S. Army Corps of `Engineers. Fill-in the wetlands will be required to utilize the property fot' a residential subdivision including lots, roads, utilities etc. (see Attached Map). As you can see, available upland have been utilized as much as possible so that high.•quality.wet and fills have been minimized. It will be necessary to fill 1..3 acres (see map) of urisdictional wetlands above headwaters for placement of the propo ed facilities utilizing Nationwide 26. An additional- 03 acres (see map) will be filled for one road crossing under Nationwide Permit 14 and 140 ft2 for -a sewer lane crossing under Nationwide 12. I previously met with Ron Ferrel of DEM to discuss this project. The client could potentially develop the site utilizing less thAn 1/3 acre of impacts under Nationwide 26, however from a water quality/environmental standpoint it actually appears it would be better to "impact" a larger area. This is mainly due to the nature of the area to be "impacted". Most proposed impacts are within a recently drained/unvegetated farm pond that has not beer. breached long enough to elude jurisdiction. Overtime even less area than shown would remain jurisdictional`. The client desires to impact the upper edge of the remaining "wet" area of the pond forT lots and a group of narrow channels for Soil/Site Evaluation ¦ Mapping and Physical Analysis ¦ Wetlands Mapping and Mitigation ¦ Environmental Audits On-Site Waste Treatment Systems, Evaluation and Design future development which total 13,66oft2. However, we believe that the remaining area within the old pond would be better off if it was tapered amended with topsoil to render it plantable, grassed and planted with native tree species (e.g. willow oak, water oak, red `maple, etc._) so that it would have the opportunity. to revert to an area similar.-,to:.that upstream of the pond (see , wetland data sheets: and wetland.:ratng.,worksheet). If this:.,:-,,. planting and stabilization of the old pond bed and stream channel is not performed the area will likely continue-to erode and . contribute excess sediment loads to White Oak Creek. once stabilized this area will -remain:undisturbedsince it is within Cary Is stream buffer. We do-not believe the, pond., bottom can be stabilized without performing the-activities- above -which constitute "fill" under 40`4 regulation even though the intent is not to make this area non-jurisdictional. The highest quality wetlands on-site are upstream of the pond and will remain undisturbed (see wetland rating sheet). Box 5249 Cary, North Carolina 27511 Dear Mr. Swain: Reference your application of April 23, 1993, for Department of the Army authorization to discharge fill material within waters of the United States, impacting a total of 1.333 acres of wetlands (0.03 for road crossings, 0.003 for sewer line, and 1.3 other) adjacent to, and above the headwaters of, an unnamed tributary to White Oak Creek, for construction of the proposed Brookstone residential subdivision, on the south side of White Oak Creek, west of S.R. 3011 (Jenks Carpenter Road), north of Apex, Wake County, North Carolina. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters provided: a. the discharge does not cause the loss of more than 10 acres of waters of the United States; b. the permittee notifies the District Engineer if the discharge would cause the loss of waters of the United States greater than one acre in accordance with the "Notification" general condition. For discharges in special aquatic sites, including wetlands, the notification must also include a delineation of affected specific aquatic sites, including wetlands; and c. the discharge, including all attendant features, both temporary and permanent, is part of a single and complete project. Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was also provided for fills for roads crossing waters of the United States (including wetlands and other special aquatic sites) provided: -2- a. The width of the fill is limited to the minimum necessary for the actual crossing; b. The fill placed in waters of the United States is limited to a filled area of no more than one-third acre. Furthermore, no more than a total of 200 linear feet of the fill for the roadway can occur in special aquatic sites, including wetlands; C. The crossing is culverted, bridged or otherwise designed to prevent the restriction of, and to withstand, expected highflows and the movement of aquatic organisms; d. The crossing, including all attendant features, both temporary and permanent, is part of a single and complete project for crossing of a water of the United States; and e. For fills in special aquatic sites, including wetlands, the permittee notifies the District Engineer in accordance with the "Notification" general condition. Authorization, pursuant to Section 404 of the Clean Water Act, was also provided for the discharge of material for backfill or bedding for utility lines, including outfall and intake structures, provided there is no change in pre-construction contours. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management. This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, the nationwide permit authorization is reissued without modification or the activity complies with any subsequent modification of the nationwide permit authorization.
