Region Coo Habitat Conservation Program <v DATE: January 5, 1994 D7s U SUBJECT: U.S. Army Corps of Engineers Public Notice No. 199400870, Application by Hound Ears Club, LTD., for a permit to excavate sediment from two ponds on Lance Creek, Watauga County. The North Carolina Wildlife Resources Commission (NCWRC) has reviewed the information provided by the U.S. Army Corps of Engineers, and I conducted a site visit on August 5, 1993 with Mr. John Tester of the Hound Ears Club, LTD. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et seq.), and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d.). The applicant proposes to remove approximately 13,300 cubic yards of earthen material and leaves from a 35,000 square foot pond and a 25,000 square foot series of ponds situated on Lance Creek just above its confluence with the Watauga River. The ponds have accumulated sediment and organic debris to a depth of approximately 6 feet. In addition, a 320 square foot herbaceous wetland area will be excavated out of one of the ponds. The dredged material will be hauled away from the site and deposited in a contained, upland location. The project will be completed as follows: 1) sediment basins consisting of riprap, stone, and screening material are to be installed 50 feet below each dam in Lance Creek (if needed silt fences will be-installed across Lance Creek just below the basins); 2) ponds will be drained and fish captured and safely transported to other ponds on the property; 3) water in ponds will be channeled to one side; 4) after allowing drained areas to dry for 2 to 4 weeks, a font end loader will be placed in the ponds and sediment pushed to a track hoe which will be set up on the bank of the ponds; 5) sediment will be loaded by track hoe onto trucks and hauled away from the (?R+n9to a M I t F. 1' if Hound Ears Club Page 2 January 5, 1994 sites; 6) during excavation, sediment basins will be regularly cleaned out and maintained to prevent sediment from entering Lance Creek and the Watauga River; and 7) ponds will not be refilled until after all project excavation is completed and all areas of disturbed soil are stabilized. Lance Creek runs through the Hound Ears Golf Course in Shull's Mill before entering the Watauga River. According to Mr. Tester, the creek and associated ponds have been stocked with trout and bass. Habitat in the ponds is somewhat degraded from silt, although habitat in the creek itself is fair. The Watauga River is Hatchery Supported Designated Public Mountain Trout Water in this area and provides good habitat for trout. Our major concern with this project is preventing sedimentation of Lance Creek and the Watauga River. The applicant has addressed this issue to our satisfaction; therefore, we do not object to this permit application and have no further recommendations. The purpose of the work is to regain the water holding capacity of the ponds and to improve their aesthetic value. A sketch and a topographic map showing the location of the ponds and how they are situated in the Watauga River watershed are included in this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a Department of the Army permit be issued until the North Carolina Division of Environmental Management has determined the applicability of a Water Quality Certificate as required by PL 92-500. -2- Approval of this permit will give Federal authorization for maintenance dredging for a period of time not to exceed 10 years from the date of permit issuance. The permittee will be required to present plans to the District Engineer a minimum of 2 weeks prior to commencement of such maintenance work. All maintenance would be performed in accordance with Federal, State, and local permits and regulations governing such activities at the time the maintenance is undertaken. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may, request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal. must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a -3- permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies, 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of,the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation, shore erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or `fill materials in waters of the United States, a Y 4 -3- permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above.
