Box 609 303 North Goldsboro Street Wilson, NC 27893 Dear Mr. Sutton: v L11 L 'JUN i 1 i°93 This letter is in response to your request to evaluate the potential effects of proposed stream channel modifications on adjacent wetlands. The channel is on the southeast side of the Woodridge Addition (property of Ligniappe Associates II) in the city of Wilson, NC. I visited the site with you on June 9, 1993. It is proposed to deepen and widen the existing channel beginning just west of the intersection of Queensbury Drive and Berkshire Drive and proceeding downstream in a southeastern direction about 1100 feet. The existing channel would be deepened about 1 ft. at the downstream end and about 2.75 ft. at the upstream end. Wetlands exist along both sides of the channel in the upper 200 ft and along the northeast side of the channel in the lower 900 ft. Based on the topography, soils and location, I believe this wetland is primarily caused by seepage from the higher land to the northeast. This is especially evident in the lower reaches of the area where the wetland width extends approximately 200 ft. The rise in land surface elevation over this 200 ft. width is 10 ft. above the bottom of the existing channel. That is, water seeping downslope from the land to the northeast has been sufficient to cause a 200 ft. wide strip adjacent to the existing channel to be a wetland--even though there is a 10 ft. fall in elevation within the 200 ft. width. In my opinion, deepening the channel by the planned 1 ft. in the lower section will have no significant effect on the wetland. There is already a 10 ft. fall in this section of the wetland. If lowering the channel bottom by 1 ft. would have a detrimental effect on the wetland, you would expect the land near the top of the slope, which has more than a 1 ft. fall to be upland. It isn't because of seepage from the adjacent field. Deepening the channel won't affect the wetland status in the lower reach of the channel for the same reason. The greatest potential for the channel modifications to affect the wetland status is in the upper reaches of the channel where the depth will be increased by about 2.75 ft and where the wetland width is small. Lowering the bottom of the ditch will affect the water table next to the ditch. However, based on soils and topography, the zone of influence will not likely be beyond the 45 ft. easement on the northeast side of the ditch. Again this wetland is fed by seepage from upslope which will continue when the ditch is deepened. In my judgement, lowering the ditch by 2.75 ft. would lower the water table at the edge of the 45 ft. easement by less than 1 ft. If that would remove wetland status, the land immediately adjacent to the present 1.5 ft. deep ditch should be upland. It isn't because it is continually fed by seepage from upslope. This seepage will continue after the proposed ditch modification, and will most likely maintain the adjacent land in its current wetland status. In particular the wetland status beyond the 45 ft. easement in the upper 200 ft. of the channel should not be affected. In summary, I believe the wetland status of the subject site is primarily caused by seepage from adjacent land of higher elevation to the northeast. Proposed channel modifications may slightly increase the seepage, but will not affect the wetland status of the adjacent strip. This is certainly true for the lower reaches of the channel. The greatest chance for an effect on the wetland is in the upper 200 ft. of the proposed modifications. However, in my judgement, the proposed changes will have minimal effects even there, and it is unlikely that the wetland status will be changed. The application for the Nationwide Permit from the U.S. Army Corps of Engineers has previously been submitted and we have been informed that it has been verbally approved by the Raleigh Regional Office of the Corps of Engineers. The Division of Environmental Management previously approved a portion of this request in a letter dated April 19, 1991. A copy of which is attached for your further information. For some time we have been working with the Corps of Engineers to obtain approval of a Nationwide Permit to cover roadway, drainage ditch construction and storm sewer construction and fill on lots. After much conversation and having Dr. Wayne Skaggs, P. E. to review the site to determine the effect of the proposed channelization on the remaining undisturbed wetlands, we prepared our permit application requesting that 3.70 acres of wetlands be either filled or excavated as suggested by the Corps of Engineers. This includes areas which were previously filled and covered under the State's April 19, 1991 approval letter. The application as currently presented provides for 0.70 acres of fill for roadways (already filled), 0.20 acres for storm sewer easement (already installed), 0.90 acres for residential construction fill or disturbance (already disturbed), 1.28 acres Mr. John Dorney November 22, 1993 Page 2 drainage ditch excavation and 0.62 acres drained. The major area of wetlands that we are attempting to permit is the channelization of an existing ditch that runs along the property's southwestern property line. The existing ditch has a capacity of approximately 15 CFS without leaving its banks. During a 10-year design storm, the flow in this channel is approximately 200 CFS. Approximately 100 acres of land drains through this area. The existing residences on the southwest side of the ditch have experienced flooding of their backyards over the years, more especially with the development of the upstream portion of the drainage basin. The City of Wilson has required that this ditch be channelized to handle a minimum 10-year storm as a condition for subdivision approval. We have already evaluated other alternatives to the channelization and find this to be the only practical feasible alternative. If necessary, we can provide a letter from the City of Wilson supporting the need for channelization and documenting its requirement. The channelization will leave narrow strips of wetlands on both sides of the channel that in the Corps of Engineers opinion would be affected by the channelization and they consequently were included in the total wetlands to be impacted. The wetlands to be impacted by and far are low quality and the drainage basin is not within an area covered by the new watershed protection rules which became effective July 1, 1993. This permit would allow the developer to proceed with needed drainage improvements that will improve the quality of life for adjacent existing residents by alleviating a reoccurring flooding problem. Also, approximately 2.0 acres of adjacent wetlands will be preserved that can be utilized as a natural area and open space. The wetlands in this area is being fed by seepage from higher elevation property. It should be noted that we have already redesigned the subdivision to reduce the impact on the wetlands at a cost of nine (9) residential lots. We respectfully request that you concur with the U.S. Army Corps of Engineers and grant the Water Quality Certification for the entire 3.70 acres. More urgently, we need permission to proceed with the channelization project immediately. Upgrade of 401 Certification issued April 19, 1991 Wilson County Mr. Ronnie Sutton of F.T. Green and Associates met with me on November 22, 1993 to discuss project modifications for the previously issued 401 certification for the above referenced project. The modification involves use of a ditch along the edge of the wetlands for outlet of stormwater. The Corps of Engineers has also requested of him to include, as impacted acreage, that area in the subdivision which may be altered hydrologically by the project. This modification will not substantially change the original intent of the project upon which the original 401 certification was issued. Therefore, the RRO recommends the certification be reissued for the new application to include the ditch and it's associated impacts.
