The Application provides adequate assurance that the discharge of fill material into the waters of Nuese Riveer in conjunction with the proposed development in Wayne County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. that the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the stream is 25 NTU's or less are not considered significant). Violations of any condition herein set forth shall result in revocation of this Certification. This Certification shall become null and void unless the above conditions are made=conditions of the Federal or Coastal Area Management Act Permit. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Box 1890 Wilmington, NC 28402-1890 Subject: Modification to Permit No. Action ID. 199304749 for Removal of Quaker Neck Dam and Associated Work Dear Dr. Wright: The NC Department of Environment, Health and Natural Resources (DEHNR) respectfully requests that the above referenced permit be modified to reflect the following changes in the scope of the project. 1. As issued, the permit indicates that the sheet pile weir proposed to be installed in the bypass canal will be located adjacent to the short canal which contains the lake makeup pumps (shown in Sheet 2 of 5 on the permit). We request that the permit be modified to show the weir location near the mouth of the bypass canal as shown in Attachment 1. to this letter. 2. On the issued permit, attached sheet 5 of 5 showed that the elevation of the top of the sheet pile weir would be 56.2 feet. This elevation was based on a study conducted by the Corps to ensure that sufficient water would be available for operation of the Lee Plant makeup pumps during low river flow conditions. We are requesting that the permit be modified to show that the weir .height be increased to elevation 64.2 feet. This increased height will ensure that the weir is clearly visible to any recreational anglers or other boaters. 3. To ensure that sufficient water flow will be maintained in the bypass canal during low river flows, dredging of a small portion of the bypass canal will be required. We estimate that the amount of material to be dredged will be on the order of 500 cubic yards. We request that a provision for this dredging, as well as subsequent maintenance dredging of the bypass canal for a 10 year period, be added to the permit. All dredged material will be disposed of on high ground, except an estimated 150 cubic yards of material which will be placed adjacent to the sheet pile weir to prevent scour. P.O. There are several expedious ways for us to authorize such a structure (i.e., letter, general or emergency permits). Should a need arise for you to divert flow, especially to meet an operational emergency, authorization would be immediately available. It is anticipated that neither review by Federal agencies or the conditions of such authorizations would pose any obstruction to your timely installation of such a structure to met your needs. By copy of this letter we are informing the Albemarle-Pamlico Estuarine Study and State and Federal review agencies, that a request from you to install a temporary structure, such as you have proposed to satisfy an operational need, would have only minimal environmental impacts and would be met with our immediate approval. Considering this, there is no apparent need for the reference application for an individual permit to include a request for authorization to install the temporary, low flow dam. The public notice failed to describe the method of removal of the existing dam. The dam will be broken up by demolition charges set off on top of the dam and flood gates. All debris and riprap will be removed by crane and clamshell, with material removed to an upland landfill. Removal activities will be conducted by the United States Marine Corps, Marine Wing Support Squadron 274, Marine Wing Support Group 27, Cherry Point Marine Air Corps Station. The temporary low flow dam across the Neuse River, proposed by Carolina Power and Light (CP&L), has been eliminated from this announcement. In accordance with our administrative regulations, in most cases, 60 days after receipt of a request for certification is a reasonable time for State action. Approximately 475 cubic yards of concrete and sheet piling are to be removed from below the elevation of normal water. During the work, some excavated material will be inadvertently placed into suspension or redeposited within the river. Clamshell bucket, dump trucks, bulldozer, pile driver and excavator are to be used to accomplish the work. Excavated material is to be removed to the Wayne County Landfill or a suitable highground area on Carolina Power and Light Company's property. Only when made necessary by periods of drought or extreme low flows will the dam be temporarily installed in the bypass canal. For this construction, approximately 150 cubic yards of material would be placed in the canal. Subsequent installations and removals of this bypass canal dam would be authorized for the duration of an issued DA permit. The purpose of this work is to remove an obstruction to anadromous fish migration pursuant to the inter-agency Coastal America project. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army (DA) permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management (NCDEM) has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Presently, unknown archeological, scientific, prehistorical, or historical data may be lost or destroyed by work under the requested permit. -2- The District Engineer, based on available information, is not aware that the proposed activity will affect species, or their critical habitat, designated as endangered or threatened pursuant to the Endangered Species Act of 1973. The decision whether to issue a permit will be based on an evaluation of the probable impacts, including cumulative impacts, of the proposed activity and its intended use on the public interest. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive Order 11988), land use, navigation shor n, wa er onservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The U.S. Army Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interest8d parties in order to consider and evaluate the impacts of this proposed activity. During the work, some excavated material will be inadvertently placed into suspension or redeposited within the river. Clamshell bucket, dump trucks, bulldozer, pile driver and excavator are to be used to accomplish the work. Excavated material is to be removed to the Wayne County Landfill or a suitable highground area on Carolina Power and Light Company's property. Only when made necessary by periods of drought or extreme low flows will the dam be temporarily installed in the bypass canal. For this construction, approximately 150 cubic yards of material would be placed in the canal. Subsequent installations and removals of this bypass canal dam would be authorized for the duration of an issued DA permit. The purpose of this work is to remove an obstruction to anadromous fish migration pursuant to the inter-agency Coastal America project. Plans showing the work are included with this public notice. The State of North Carolina will review this public notice to determine the need for the applicant to obtain any required State authorization. No Department of the Army (DA) permit will be issued until the coordinated State viewpoint on the proposal has been received and reviewed by this agency, nor will a DA permit be issued until the North Carolina Division of Environmental Management (NCDEM) has determined the applicability of a Water Quality Certificate as required by PL 92-500. This application is being considered pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). Any person may request, in writing within the comment period specified in the notice, that a public hearing be held to consider this application. Requests for public hearing shall state, with particularity, the reasons for holding a public hearing. The District Engineer has consulted the latest published version of the National Register of Historic Places for the presence or absence of registered properties, or properties listed as being eligible for inclusion therein, and this worksite is not registered property or property listed as being eligible for inclusion in the Register. Consultation of the National Register constitutes the extent of cultural resource investigations by the District Engineer, and he is otherwise unaware of the presence of such resources. Evaluation of the probable impacts which the proposed activity may have on the public interest requires a careful weighing of all those factors which become relevant in each particular case. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. The decision whether to authorize a proposal, and if so the conditions under which it will be allowed to occur, are therefore determined by the outcome of the general balancing process. That decision should reflect the national concern for both protection and utilization of important resources. All factors which may be relevant to the proposal must be considered including the cumulative effects thereof. Among those are conservation, economics, aesthetics, general environmental concerns, wetlands, cultural values, fish and wildlife values, flood hazards and flood plain values (in accordance with Executive order 11988), land use, navigation, shore erosion and accretion, recreation, water supply an conservation, water quality, energy needs, sa y, production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. For activities involving the placement of dredged or fill materials in waters of the United States, a permit will be denied if the discharge that would be authorized by such permit would not comply with the Environmental Protection Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any other applicable guidelines or criteria, a permit will be granted unless the District Engineer determines that it would be contrary to the public interest. The U.S. Army Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects and the other public interest factors listed above. Comments are used in the preparation of an Environmental Assessment (EA) and/or an Environmental Impact Statement (EIS) pursuant to the National Environmental Policy Act (NEPA). Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Generally, the decision whether to issue this DA permit will not be made until the North Carolina Division of Environmental Management (NCDEM) issues, denies, or waives State certification required by Section 401 of the Clean Water Act. The NCDEM considers whether or not the proposed activity will comply with Sections 301, 302, 306, and 307 of the Clean Water Act. The application and this public notice for the DA permit serve as application to the NCDEM for certification.
