A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 26. Johnston Post Office Box 1452 North Wilkesboro, North Carolina 28659 Dear Mr. Johnston: Q d r ?_- 3 'C, ETLANDS S; FLAIB ?WUALIjY Y Please reference the meeting of September 11, 1992, between Mr. John Thomas of my staff and Mr. Dick Johnson (consultant for project) at the site for a proposed pond on the Leatherwood Development property located off S.R. 1162 adjacent to an unnamed tributary of Elk Creek, east of Darby, Wilkes County, North Carolina. The purpose of this meeting was to discuss plans for construction of a small pond and to inspect the site for waters and wetlands subject to Department of the Army permitting authority. The meeting revealed that the proposed site is located adjacent to, and above the headwaters of, an unnamed tributary to Elk Creek. The review of the proposed development plans provided by Mr. Johnson (engineering consultant for the site) indicates that construction of the pond will involve adverse modification to 31,500 square feet (0.72 acre) of wetlands on the aforementioned tributary. Reference is also made to Mr. Joe Mickey's letter of November 25, 1992, in which the North Carolina Wildlife Resources Commission (WRC) expressed no objections to the pond based on the fact that this project will not impact waters supporting trout. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits (NWP). Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters provided: a. The discharge does not cause the loss of more than 10 acres of waters of the United States; b. The permittee notifies the District Engineer if the discharge would cause the loss of waters of the United States greater than one acre in accordance with the "Notification" general condition. For discharges in special aquatic sites, including wetlands, the notification must also include a delineation of affected specific aquatic sites, including wetlands; and -2- c. The discharge, including all attendant features, both temporary and permanent, is part of a single and complete project. Special conditions of this regional general permit state that before discharging dredged or fill material into waters of the United States occurring within the twenty-five mountain counties of North Carolina that contain trout waters, the applicant will obtain a letter of approval from the WRC. Review of the information you have provided, and the comments submitted by the WRC, reveals that your proposed work, involving adverse modification to less than an acre (0.72 acre) of waters of the United States located above the headwaters of the aforementioned tributary, is authorized by NWP provided it is accomplished in strict accordance with the enclosed conditions and the recommendations set forth by the WRC. This NWP does not relieve you of the responsibility to obtain any required State or local approval. You should contact Mr. John Dorney, North Carolina Division of Environmental Management, (919) 733-5083, to obtain the necessary Section 401, Water Quality Certification prior to starting work. This verification will be valid for 2 years from the date of this letter unless the NWP authorization is modified, reissued, or revoked. Also, this verification will remain valid-for the 2 years if, during that period, the NWP authorization is reissued without modification or the activity complies with any subsequent modification of the NWP authorization. If during the 2 years, the NWP authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the NWP, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the NWP will remain authorized provided the activity is completed within 12 months of the date of the NWP's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. This particular project is a small impoundment (about 0.9 acre surface water area) in the Leatherwood development in western Wilkes County. The site is located along the upper reaches of an unnamed tributary of Elk Creek (see accompanying map) and is proposed as an integral part of the recreational and aesthetic experience of this low-density residential area. Mr. John Thomas of the Corps of Engineers has visited the site and determined the extent of wetlands. Also, since Wilkes is one of the 25 mountain counties that are required to have the Wildlife Resources Commission's review and approval, Mr. Joe Mickey, District 7 Fisheries Biologist, has also visited the site and determinedthat the project will not impact trout waters (see accompanying letter). The earthen dam and impounded waters will 'impact about 0.7 acre of above headwaters wetlands, according to Mr. Thomas' review. This particular project is a small impoundment (about 0.9 acre surface water area) in the Leatherwood development in western Wilkes County. The site is located along the upper reaches of an unnamed tributary of Elk Creek (see accompanying map) and is proposed as an integral part of the recreational and aesthetic experience of this low-density residential area. Mr. John Thomas of the Corps of Engineers has visited the site and determined the extent of wetlands. Also, since Wilkes is one of the 25 mountain counties that are required to have the Wildlife Resources Commission's review and approval, Mr. Joe Mickey, District 7 Fisheries Biologist, has also visited the site and determined that the project will not impact trout waters (see accompanying letter). The earthen dam and impounded waters will impact about 0.7 acre of above headwaters wetlands, according to Mr. Thomas' review. We believe that due to the size, location, and nature of this impoundment that it can function without resulting in degradation of water quality. Please call if you have any questions or comments.
