A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers, Nationwide Permit No. 26. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such demands are made, this Certification shall be final and binding. 1786. Town of Cary POTW DATE ITEM 11 The pond is 0.73 acres in size, and it will be drained and filled. Additionally, 0.04 acres of intermittent stream will be filled. Therefore, a total of 0.77 acres will be filled. ITEM 14 The pond is located in the middle of the site. Development of the site is not possible without draining and filling the pond. A stormwater detention basin was designed to help control site runoff and help protect the water quality of downstream wetland areas. The proposed site plans were modified several times to reduce the amount of wetlands impacted.
