Upon review of your request for 401 Water Quality Certification
to place fill material in 0.77 acres of wetlands or waters which are
tributary to Brier Creek for development of solid waste transfer
station located at Kittyhawk Industrial Park in Cary in Wake County as
described in your submittal dated 29 November 1993, we have determined
that the proposed fill can be covered by General Water Quality
Certification No. 2671. A copy of the General Certification is
attached. This Certification may be used in qualifying for coverage
under Corps of Engineers, Nationwide Permit No. 26.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

Dear Mr. Dorney:
Enclosed are seven copies of an Application for 401 Water Quality Certification for
draining a small farm pond and placement of fill in wetlands associated with the
development of a solid waste transfer station, in Wake County. On August 5, 1993, Mr.
Karl Shaffer visited the site to evaluate the wetlands and discuss proposed project plans.
Also enclosed is a copy of a letter from the current landowners providing permission to
obtain the necessary permits for development of the transfer station.

The pond is 0.73 acres in size, and it will be drained and filled. Additionally, 0.04 acres of
intermittent stream will be filled. Therefore, a total of 0.77 acres will be filled.
ITEM 14
The pond is located in the middle of the site. Development of the site is not possible
without draining and filling the pond. A stormwater detention basin was designed to help
control site runoff and help protect the water quality of downstream wetland areas. The
proposed site plans were modified several times to reduce the amount of wetlands impacted.
As the current plans show, the wetland area on the southwest corner of the property has
been completely avoided.
