Upon review of your request for 401 Water Quality Certification
to place fill material in 0.25 acres of wetlands or waters which are
tributary to Crabtree Creek for road crossing, utility lines and lot
fill located at Preston Village, Phase III in Wake County as described
in your submittal dated 11 November 1993, we have determined that the
proposed fill can be covered by General Water Quality Certifications
Numbers 2664, 2732 and 2671. Copies of the General Certifications are
attached. These Certifications may be used in qualifying for coverage
under Corps of Engineers' Nationwide Permit Numbers 12, 14 and 26.
If this Certification is unacceptable to you, you have the right
to an adjudicatory hearing upon written request within thirty (30)
days following receipt of this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

Dear Messrs. Dorney and.Alsmeyer:
The purpose of this letter is to request Nationwide Permits 12,
14, 26, and a Section 401 Water Quality Certification for the
project to be known as Preston Village. The project is located
near Morrisville, NC (Wake County) and is bordered by an unnamed,
intermittent stream and Davis Drive (S.R. 1613) as shown on the
enclosed plans and vicinity maps.

The Corps approved detailed wetland delineation is shown on the
.attached map. These delineations have been approved by Mr.. Eric
Alsmeyer of the U.S..Army. Corps of Engineers. The Corps and DEM
previously issued authorizations for Nationwide Permits 12, 14,
and 26 for Phases I and II of this project. The enclosed
.application is for Phase III.
Fill in the wetlands will be required for road crossings,
sewerlines, and one lot in a residential subdivision (see attached
map). Available uplands have been utilized as much as possible so
that wetland fills have been minimized. Roads crossings are
perpendicular to wetlands to minimize impacts as well.
It will be necessary to impact a total of 0.25 acres (see map) of
jurisdictional wetlands for placement of the proposed facilities.
Previous wetland impacts from Phases I and II of this project
total 0.66 acres.
Wetlands A, D and F (as labeled on the attached plans) are to be
permitted under Nationwide 12. Wetlands B is to be permitted
under Nationwide 14, and wetlands C, E, G are to be permitted
under Nationwide 26. Proposed impacts from this phase of
development are to be: Nationwide 12,0.07 acres; Nationwide 14,
0.07 acres; Nationwide 26, 0.11 acres.
To expedite the permitting process and to ease the process for
on everyone involved, the following individuals/agencies have been
provided with a complete copy of this entire application package:
