You and Tim Fox with the Division of Water Quality were present. Mining Stormwater Permit (NCG020794) condition and stream standard violations were noted. I. General Permit NCG020000 Condition Violation Part I Section B - Discharges shall not cause or contribute to violations of water quality standards. H. Stream Standard Violation- Turbidity 15A NCAC 02B .0211 (3)k. "The turbidity in the receiving water shall not exceed 50 Nephelometric Turbidity Units (NTUI) in streams not designated as trout waters and 10 NTU in streams, lakes or reservoirs designated as trout waters; for lakes and reservoirs not designated as trout waters, the turbidity shall not exceed 25 NTU". At this time Feldspar Corp. needs to direct its attention in the Pine Mountain mine to the road system. Portions of the road system are shared by the Feldspar Corporation and Unimin. Stormwater (SW) discharges from the road system into an unnamed tributary (UT) to the North Toe River are contributing to elevated turbidity levels. Both companies are required to evaluate what stormwater control measures can be used to reduce turbidity levels in the tributary. Turbidity sampling in the tributary during each rain event will gauge the progress of the actions taken to resolve turbidity violations. Toe River at Shannon Dr. Required Actions Turbidity sampling during all discharging rainfall events shall be conducted on the West arm of the Tributary. The West arm drains both mines and the road system. It is suggested that you sample at Shannon Drive just upstream of the confluence with the East arm. If you chose to sample elsewhere please let me know. The West arm will also be sampled during each rain event by Unimin personnel to determine compliance with their improvement actions. Please keep in mind the distance between the stormwater discharges at the mine and the sampling location. There will be a time delay in the stormwater discharge flows from the mine getting downstream. Sample accordingly to get proper representation of the mines' impacts. Sampling according to permit requirements (Part III, Section B, regarding the Representative Storm Event and Footnote #2) are suspended at this time. Please send a Compliance Plan response within 30 days of this inspection letter describing the companies' plan of action to improve water quality in the Tributary. If there is to be a sizable delay in the remedial actions contact me to discuss reducing or altering the sampling events. Otherwise sampling at noted above is required until further notice. The area at this time that requires attention to reduce turbidity impacts is the road system. Direct stormwater discharges from the road system shared by the Feldspar -Quartz Corporation and Unimin are occurring. Both companies shall work together to resolve the road system issues in order to achieve reduced turbidity levels in the UT or will have to monitor every SW outfall from the road system monthly to show the permit benchmarks can be met consistently without a treatment device. The road system runoff should be directed to a treatment device (basin,trap) prior to discharging to the stream wherever feasible. The inspector believes this to be feasible in several locations. If the treatment devices are operated and maintained properly the discharge from these devices should yield a reduced level of the turbidity in the stream. Turbidity sampling during each rainfall event shall be instituted on the west arm of the UT until further notice. Sample results shall be submitted to DWQ Asheville Regional Office monthly. Toe River) during rain events exceeds class "C" stream standard of 50 NTUs. The receiving stream is actually classified a Tr stream with a 10 NTU standard. However, the inspector is going to work with the mines to achieve a 50 NTU level instream of the Unnamed Tributary (UT). If the mines can get a level at or below 50 NTU in the UT then the confluence with the N Toe should not cause levels be greater than 10 NTUs in the N Toe.
