Reference your application of May 4, 1993, submitted on your behalf by
Soil And Environmental Consultants, Inc., for Department of the Army
authorization to discharge fill material within waters of the United States,
causing the loss of a total of 0.53 acre of wetlands (0.24 for road crossings
and 0.29 other) adjacent, and above the headwaters of, an unnamed tributary to
Crabtree Creek, for construction of the proposed Preston Village, Phase One,
residential development, on the west side of S.R. 1613 (Davis Drive), in
Morrisville,,,Wake County, North Carolina.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits (NWP).
Authorization was provided, pursuant to Section 404 of the Clean Water Act,
for discharges of dredged or fill material into headwaters and isolated waters
provided:
a. The discharge does not cause the loss of more than 10 acres of waters
of the United States;
b. The permittee notifies the District Engineer if the discharge would
cause the loss of waters of the United States greater than one acre in
accordance with the "Notification" general condition. For discharges in
special aquatic sites, including wetlands, the notification must also include
a delineation of affected specific aquatic sites, including wetlands; and
c. The discharge, including all attendant features, both temporary and
permanent, is part of a single and complete project.
Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899
and Section 404 of the Clean Water Act, was also provided for fills for roads
crossing waters of the United States (including wetlands and other, special
aquatic sites) provided:

a. The width of the fill is limited to the minimum necessary for the
actual crossing;
b. The fill placed in waters of the United States is limited to a filled
area of no more than 1/3 acre. Furthermore, no more than a total of 200
linear feet of the fill for the roadway can occur in special aquatic sites,
including wetlands;
C. The crossing is culverted, bridged or otherwise designed to prevent
the restriction of, and to withstand, expected highflows and the movement of
aquatic organisms;
d. The crossing, including all attendant features, both temporary and
permanent, is part of a single and complete project for crossing of a water of
the United States; and
e. For fills in special aquatic sites, including wetlands, the permittee
notifies the District Engineer in accordance with the "Notification" general
condition.
Your work is authorized by these NWPs provided it is accomplished in
strict accordance with the enclosed conditions. These NWPs do not relieve you
of the responsibility to obtain any required State or local approval. You
should contact Mr. John Dorney of the North Carolina Division of Environmental
Management at (919) 733-1786 regarding a State Water Quality Certification.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date of
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.

impacts of subsequent projects on this property would have to be considered
cumulatively with these, regardless of future subdivision or ownership of the

Dear Sirs:
Reference your application of May 14, 1993, submitted on behalf of Preston
Development Co., for Department of the Army authorization for prior and
proposed discharges of fill material within waters of the United States,
causing the loss of a total of 4.61 acres of wetlands (0.06 for road
crossings, .11 for utility line crossings, 1.14 for bank stabilization, and
3.30 other) in and adjacent to Crabtree Creek, its tributaries and their
wetlands. The completed and proposed activities are for construction of
roadways, utility lines, residential lots and golf course expansion associated
with the Preston P.U.D. east of S.R. 1613 (Davis Drive), in Cary and
Morrisville, Wake County,North Carolina. Reference is also made to the
letter dated May 17, 1993, from Preston's engineer, Withers and Ravenal,
describing various activities to be completed on the fairways for Holes 8B,
10B, 11B and 12B, on the east side of Crabtree Creek, to address sediment and
erosion needs, and water quality concerns expressed by the North Carolina
Division of Environmental Management and the Corps.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization was provided, pursuant to Section 404 of the Clean Water Act,

lines, including outfall and intake structures, provided there is no change in
pre-construction contours.
Authorization, pursuant to Section 10 of the Rivers and Harbors Act of
1899 and Section 404 of the Clean Water Act, was also provided for bank
stabilization activities provided:
a. No material is placed in excess of the minimum needed for erosion
protection;
b. The bank stabilization activity is less than 500 feet in length;
c. The activity will not exceed an average of one cubic yard per running
foot placed along the bank below the plane of the ordinary high water mark or
the high tide line;
d. No material is placed in any special aquatic site, including wetlands;
e. No material is of the type or is placed in any location or in any
manner so as to impair surface water flow into or out of any wetlands area;

f. No material is placed in a manner that will be eroded by normal or
expected high flows; and
g. The activity is part of a single and complete project.
Authorization, pursuant to Section 10 of the Rivers and Harbors Act and
Section 404 of the Clean Water Act, was provided for discharges of dredged or
fill material into all waters of the United States provided:
a. The discharge does not exceed 25 cubic yards;
b. The discharge will not cause the loss of more than 1/10 acre of a
special aquatic site, including wetlands. For the purposes of this nationwide
permit, the acreage limitation includes the filled area plus special aquatic
sites that are adversely affected by flooding and special aquatic sites that
are drained so that they would no longer be a water of the United States as a
result of the project;
C. If the discharge exceeds 10 cubic yards or the discharge is in a
special aquatic site, including wetlands, the permittee notifies the District
Engineer in accordance with the "Notification" general condition. For
discharges in special aquatic sites, including wetlands, the notification must
also include a delineation of affected special aquatic sites, including
wetlands' and;
d. The discharge, including all attendant features, both temporary and
permanent, is part of a single and complete project and is not placed for the
purpose of stream diversion..
Your completed and proposed work is authorized by these nationwide permits
provided it is accomplished in strict accordance with the submitted plans and
description of work, including the activities described in the May 17, 1993
letter, and the enclosed conditions. These nationwide permits do not relieve
you of the responsibility to obtain any required State or local approval. You
should contact Mr. Ron Ferrell of the North Carolina Division of Environmental
Management at (919) 733-1786 regarding a State Water Quality Certification.
This verification will be valid for 2 years from the date of this letter

Dear Mr. Martin:
Reference our letter of June 16, 1993, confirming nationwide permit (NWP)
authorization for discharges of fill material within waters in and adjacent
Crabtree Creek, its tributaries and their wetlands, associated with
development of the Preston P.U.D., north of High House Road, and east of Davis
Drive (S.R. 1613), in Cary and Morrisville, Wake County, North Carolina.
Reference also your application of September 9, 1993, submitted on behalf of
Preston Development Company, for additional Department of the Army
authorization to discharge fill material within waters of the United States,
impacting an additional 0.08 acre of wetlands [190 square feet for sewerlines,
1,135 square feet for road crossings, and 2,365 square feet (.05 acre) for lot
fills, for a total of 3.35 acres under Nationwide Permit No. 261, for
development of Preston Grove, Preston Oaks, and Preston Wynds residential
subdivisions, within Preston P.U.D.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,

these NWPs provided it is accomplished in strict accordance with the enclosed
conditions and provided you receive a Section 401 water quality certification
from the North Carolina Division of Environmental Management. These
NWPs do not relieve you of the responsibility to obtain other required State
or local approvals. You should contact Mr. John Dorney at telephone (919)
733-1786 regarding water quality certification.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the NWP authorization is reissued without modification or the activity

complies with any subsequent modification of the NWP authorization. If during
the 2 years, the NWP authorization expires or is suspended or revoked, or is
modified, such that the activity would no longer comply with the terms and
conditions of the NWP, activities which have commenced (i.e., are under

Upon review of your request for 401 Water Quality Certification to place fill material in 0.53
acres of wetlands or waters which are tributary to Crabtree Creek for residential development located
at SR 1613 in Wake County as described in your submittal dated 25 April 1993, we have determined
that the proposed fill can be covered by General Water Quality Certification Nos. 2671 & 2732 issued
January 21, 1992. Copies of the General Certifications are attached. These Certifications may be
used in qualifying for coverage under Corps of Engineers' Nationwide Permit Nos. 26 & 14.
If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon
written request within thirty (30) days following receipt of this Certification. This request must be in the
form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed
with the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

The application for a 401 Water Quality Certification for the subject project has been
received. As you were informed by Mr. Ron Ferrell in a meeting on April 21, 1993 this
application will not be processed until the violations associated with the expansion of Preston
Golf Course and adjacent residential developments have been addressed. A meeting has been
scheduled for 8:30 AM on May 17, 1993 to review the certification application for Preston
Golf Course. If all issues that have previously been discussed are addressed in this
application the certifications for the golf course and adjacent residential developments will be
issued within two weeks. The review of the application for Preston Village will begin at the
time that a decision has been made to issue the 401 Water Quality Certifications for Preston
Golf Course.

The purpose of this letter is to request Nationwide Permits 14 and
-26, and .a Section 401 Water Quality Certification for the project
to be known as Preston Village. The project is located near
Morrisville, NC (Wake County) and is bordered by an unnamed,
intermittent stream and S.R. 1613 as shown on the enclosed plans
and vicinity maps.

Ron Ferrel did not have any significant concerns about the project
and I believe he felt that impacts hadbeen avoided and minimized
as much as possible.
Fill in the wetlands will be required to utilize the property for
a residential subdivision including lots, roads, utilities etc.
(see Attached `Map). As you can see, available uplands have been -
utilized as much as possible so that wetland fil=ls have been
minimized.
