Dear Mr. Martin:
Reference your application of March 18, 1993, on behalf of Capital
Associates, and your subsequent letter of March 30, 1993, for Department of
the Army authorization to discharge fill material within waters of the United
States, impacting waters and wetlands, adjacent to, and above the headwaters
of, an unnamed tributary to Stirrup Iron Creek. The discharge is for the
proposed construction, including backfill and bedding, and riprap for pipe
protection, of the Concourse Sewer Line, west of I-40, north of Morrisville,
Wake County, North Carolina. Approximately 1,800 square feet (less than 0.1
acre) of waters would be permanently impacted by the riprap.
For the purposes of the U.S. Army Corps of Engineers, Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization was provided, pursuant to Section 404 of the Clean Water Act,
for discharges of dredged or fill material into headwaters and isolated waters
provided:
a. the discharge does not cause the loss of more than 10 acres of waters
of the United States;
b. the permittee notifies the District Engineer if the discharge would
cause the loss of waters of the United States greater than one acre in
accordance with the "Notification" general condition. For discharges in
special aquatic sites, including wetlands, the notification must also include
a delineation of affected specific aquatic sites, including wetlands; and
c. the discharge, including all attendant features, both temporary and
permanent, is part of a single and complete project.
Authorization, pursuant to Section 404 of the Clean Water Act, was also
provided for the discharge of material for backfill or bedding for utility
lines, including outfall and intake structures, provided there is no change in
pre-construction contours.

Your work is authorized by these nationwide permits provided it _JS
accomplished in strict accordance with the enclosed conditions. These
nationwide permits do not relieve you of the responsibility to obtain any
required State or local approval. You should contact Mr. John Dorney of the
North Carolina Division of Environmental Management at (919) 733-1786
regarding a State Water Quality Certification.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date of
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.

Upon review of your request for 401 Water Quality
Certification to place fill material in less than one acre of
wetlands or waters which are tributary to Stirrup Iron Creek for
sewer line construction located at SR 3015, SR 1641, and SR 1640
in Wake County as described in your submittal dated 30 March
1993, we have determined that the proposed fill can be covered by
General Water Quality Certification Nos. 2671 and 2664 issued
January 21, 1992. Copies of the General Certifications are
attached. These Certifications may be used in qualifying for
coverage under Corps of Engineers' Nationwide Permit Nos. 26 and
12.

The purpose of this brief note is to request a modification to our
previous submittal for Nationwide 18 and 12 permits to cover the
proposed concourse sewer line in Wake County, NC. We would still
like for you to process the Nationwide 12 as originally submitted
but request that you authorized the additional impacts under
Nationwide 26 rather than 18.
We are requesting this change because we have discovered the
impacts will exceed 25yd3 but the site is above headwaters.
Impacts in addition to those to be covered by Nationwide 12 are as
follows: (Station locations are shown on blueprints originally
submitted) (1) Station 44 + 85 = 1000ft2
(2) Station 10' x 20' = 200ft2
(3) Station 25 + 08 (Manhole 14) = 600ft2
Impacts 1, 2, and 3 should now be covered by Nationwide 26.
Please disregard our previous request for Nationwide 18 coverage.

causes all the other components to shift. I feel we have been
through every practical configuration and this one seems to have
the least impact from a wetland, wildlife and water quality
standpoint.
Based on site and/or office meetings with DEM and.Corps staff we
believe there are no significant objections to the project as
proposed. Since we are on a tight construction time table
anything you can do to expedite the permit process will be
appreciated. Please call if you have questions or require further
information.

This is to advise you that the Town of Morrisville will require that rip-rap
fill be placed in locations having approximate stations of 44+85 and 47+60 on
the attached sheets, as prepared by Withers & Ravenel.
The fill is required to be placed to raise the bed of the draws above the top
of the pipe to prevent the pipe from becoming a structural feature creating a
dam of water borne debris thereby adversely effecting the integrity of the
main itself.
A third area adjacent to the west side of Airport Boulevard will be required
to be stabilized rip-rap to prevent erosion of the disturbed area within the
existing swale.
If you need further explanation, please advise.
