On July 20, 2009, the Division of Water Quality (DWQ) received your application dated
July 2, 2009. The application indicated that you were requesting authorization to fill
wetlands on the subject property for the purpose of constructing a storage area and future
boat ramp.
On August 27, 2009 the DWQ received a copy of a letter issued to you from the US
Army Corps of Engineers (USACE) indicating that your request for permitting could not
be reviewed under the Nationwide (NW) process. The DWQ is required to process the
same application as the USACE, therefore we are withdrawing your application for 401
certification. Please contact the USACE for permitting guidance. Once a determination
has been made as to how you request for wetland impacts will be processed please
contact the DWQ. Please keep in mind that you are not authorized to impact any wetlands
or waters on the subject site.
This letter only addresses the application review and does not authorize any impacts to
wetlands, waters or protected buffers. Please be aware that any impacts requested within
your application are not authorized (at this time) by the DWQ. Please call Kyle Barnes
