Dear Mr. Dulken:
The Division has reviewed your application for a No Exposure Certification for Exclusion (NEC)
from NPDES Stormwater Permitting for the subject facility.
Based on an inspection of your facility on July 9, 2019, Asheville Regional Office staff found that
industrial activities or materials on your site either are exposed, or have the potential to be
exposed to stormwater discharge.
The Division of Energy Mineral and Land Resources is unable to grant your requested
exemption from permit coverage when industrial activities or materials are exposed or have
the potential to be exposed. Please see attached inspection report.
This facility is disapproved at this time for No Exposure, but will be Re -Inspected. If the issues
listed in the report have not been addressed, and no application for coverage under a General
Industrial Stormwater Permit has been submitted, further action will be taken.

Inspection Summary:
On July 9, 2019 this facility was inspected to determine compliance with the No Exposure Certification requested for the
facility. During the inspection, the following items were noted:
1) Industrial equipment and material was observed outside, exposed to precipitation.
2) Used Pallets were observed outside exposed to precipitation.
3) Above ground storage tanks were observed having a combined capacity to require secondary containment.
Due to the above issues, No Exposure in not granted at this time. However, a re -inspection is planned to take place on or
after August 22, 2019. If the above issues are not addressed, or coverage under a General Industrial Permit applied for,
further action will be taken.
