A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 12. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Edwards 4wo- "2V SUBJECT: Nationwide Permit Application for Section 401 Certification Response from the State Historical Preservation Officer, Mr. David Brook In the environmental review process for the 201 Facilities Plan Update for the Stokes-Danbury Planning Area, we received a memorandum from Mr. Brooks dated May 4, 1993, addressing Mr. Reginald Sutton of the Construction Grants and Loans Section of the DEM. In this memorandum, Mr. Brooks recommended "a comprehensive survey be conducted by an experienced archaeologist to identify the presence and.significance of archaeological remains that may be damaged or destroyed by the proposed project." (A copy of this memorandum has been enclosed for your review.) This survey must be performed before the initiation of any construction for the proposed project. We solicited proposals from several archaeological firms. Stokes County has chosen Coastal Carolina Research of Tarboro, NC to do the study and are in the process of a contract review at this time. This study should take place as soon as this review is complete. Results of this study will be forwarded to you upon completion. In addition to this memorandum, you will find enclosed a copy of a letter from the US Department of the Interior, Fish and Wildlife Service Acting Field Supervisor, Mr. Richard G. Biggins. This letter is a response to the Biological Assessment of the Stokes-Danbury Planning Area, prepared by Dr. J.H. Carter and Associates of Southern Pines, NC, in which "no effect" on endangered or threatened species was found. The Fish and Wildlife Service agreed with this finding. Also enclosed are the necessary plan and profile sheets and maps, all on 8 1/2 x 11 inch paper, as required. If you should have any questions or require any more information, do not hesitate to call. VVe recommend that potential affects to archaeological resources within and near the Danbury Historic District be considered. Although the 201 upgrade indicates "areas potentially affected by the selected alternative will be investigated" (page -32), Section 7.2G suggests "there is presently no indication that any areas of archaeological or historical value would be disturbed by the implementation of the proposed alternative" (page 7-78). We disagree with this assumption and recommend that potential adverse effects to archaeological remains be determined prior to construction. Specifically, we recommend that a comprehensive survey be conducted by an experienced archaeologist to identify the presence and significance of archaeological remains that may be damaged or destroyed by the proposed project. Potential effects on unknown resources should be assessed prior to the initiation of construction activities. Enclosed is a list of archaeological consultants who have conducted or expressed an interest in conducting contract work in North Carolina. Individual files providing additional information on the consultants may be examined at the State Historic Freservation Office's Office of State Archaeology, 421 North Blount Street, ;aleigh. If additional names are desired, you may consult the current listing of the members of the Society of Professional Archaeologists, or contact the society's current secretary/treasurer, David L. Carter- 111, Ms. Stephanie Wilds, and Ms. Tracy Ilippenstcol (received on May 13, 1993). We have completed a review ni this assessment and the following comments are provided ill dLtor•dance with the provisions of Section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act). The U.S. Fish and Wildlife Service believes that the assessment is thorough and accurate and agree with its finding of "no effect" on endangered or threatened species. In view of this, we !relieve the requirements of Section 7(e) of the Act, as amended, arc fulfilled. However, obligations under Section 7 of the Act must be reconsidered if: (1) new information reveals impacts of this identified actiuli that may affect endangered or threatened species or critical habitat in a manner not previously considered, (2) this action is subsequently modified in a manner not considered in this revfew, or (3) a new spet_ies is listed or critical habitat is determined that may be affected by the action.
