A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 26. This Certification does not allow fill in this location but does allow restoration of the prexisting pond. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. As a result of extensive field work on Texasgulf property in Aurora this past May, some significant revisions were made. Please note the changes made in the pollutant removal section of this rating system. There are now three levels of scores for this function with no explicit reference to hydrological connectivity. The highest range of scores now refers to wetlands within 600 feet of linear depressions with evidence of surface flow. Linear depressions are defined as any classified surface waters and unnamed tributaries, or canals which appear as solid lines on a 1:24,000 U.S.G.S. topographic map. Many of these features are also often drainage channels which appear as V- shaped topographic lines. This range of scores pertains to those wetlands which were formerly referred to as hydrologically connected. These wetlands can theoretically receive particulate and soluble pollutants from the surrounding landscape as well as soluble pollutants in the groundwater and rainfall. The second range of scores is an addition to earlier flow charts and includes those wetlands within 600 feet of linear depressions with no evidence of surface flow. This category represents wetlands where there is groundwater flow. These wetlands could receive a maximum score of 4 since they would have the opportunity to receive soluble pollutants from the groundwater and rainfall but would not receive particulate pollutants. Copies of the General Certifications are attached. These Certifications may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No.s 14 & 12. This concurrence does not include wetland fill for playfield. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. Based on this review, we have identified significant uses which would be removed by this project. These uses are bank stabilization and aquatic life. Furthermore, insufficient evidence is present in our files to conclude that your project must be built in wetlands. Therefore, we are moving toward denial of your 401 Certification. Until we receive additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers and/or the N.C. Division of Coastal Management place your project on administrative hold.. Please provide us with information supporting your position that your project must be constructed as planned. Specifically can you construct your playfield on nearby uplands or prior converted farmland? Any documentation such as maps and narrative which you can supply to address upland alternatives may be helpful in our review of your 401 Certification.
