Fourth Street Winston-Salem, N.C. 27101 Dear Mr. Leak: C) EHNF1 Subject: Proposed fill in Wetlands or Waters Seicor development site Forsyth County DEM Project # 93539 Upon review of your request for 401 Water Quality Certification to place fill material in 0.44 acres of wetlands or waters which are tributary to Fiddler's Creek for development of a commercial building site for the Seicor Corp. located at 311 Centre Industrial Park in Forsyth County as described in your submittal dated 23 June 1993, we have determined that the proposed fill can be covered by General Water Quality Certification No. 2671 issued January 21, 1992. A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 26. An additional condition is that a stormwater treatment system must receive final written DEM approval. The conceptual design of this system is to utilize the vegetated floodplain of Fiddler's Creek to disperse and treat the stormwater runoff from the entire site. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of. Administrative Hearings, P.O. The review of the development plans indic es tha the proposed stream relocation will involve adverse modification to 0.44 ac a of waters/wetlands on this aforementioned above headwaters tribut rv. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits (NWP). Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters provided: a. The discharge does not cause the loss of more than 10 acres of waters of the United States; b. The permittee.notifies the District Engineer if the discharge would cause the loss of waters of the United States greater than one acre in accordance with the "Notification" general condition. For discharges in special aquatic sites, including wetlands, the notification must also include a delineation of affected specific aquatic sites, including wetlands; and -2- c. The discharge, including all attendant features, both temporary and permanent, is part of a single and complete project. Your work is authorized by this NWP provided it is accomplished in strict accordance with the enclosed conditions and provided-you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management (NCDEM). You should contact Mr. John Dorney, telephone (919) 733-1786, regarding water quality certification. This NWP does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid for 2 years from the date of this letter unless-the nationwide authorization is modified, reissued, or revoked. The purpose of this meeting was to confirm wetland delineations conducted by Mr. Allen Conger of Law Engineering, and to inspect the site for waters and wetlands subject to Department of the Army permitting authority. The review of the proposed plans provided by Mr. Causey indicates that the construction of the temporary road will involve a single crossing of an unnamed tributary to Fiddlers Creek. Wetland limits located during the aforementioned site visit reveals that the proposed road crossing is located adjacent to the aforementioned tributary. Also, that the crossing impacts waters of the United States and would not include any impacts to special aquatic sites. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits (NWP). Authorization, pursuant to Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, was provided for fills for roads crossing waters of the United States (including wetlands and other special aquatic sites) provided: a. The width of the fill is limited to the minimum necessary for the actual crossing; b. The fill placed in waters of the United States is limited to a filled area of no more than one-third acre. Furthermore, no more than a total of 200 linear feet of the fill for the roadway can occur in special aquatic sites, including wetlands; -2- c. The crossing is culverted, bridged or otherwise designed to prevent the restriction of, and to withstand, expected high flows and the movement of aquatic organisms; d. The crossing, including all attendant features, both temporary and permanent, is part of a single and complete project for crossing of a water of the United States; and e. For fills in special aquatic sites, including wetlands, the permittee notifies the District Engineer in accordance with the "Notification" general condition. Your access road work for the aforementioned development is authorized by this NWP provided it is accomplished in strict accordance with the enclosed conditions. This NWP does not relieve you of the responsibility to obtain any required State or local approval. You should contact Mr. John Dorney telephone (919) 733-1786, regarding water quality certification. This site is part of the 311 Industrial Park that we found water flowing down a hill that was not jurisdictional but that the company later had to get several hundred thousand dollars ($650,000.00?) from the county due to "water problems" where the building was being built. (Possibly diverted flow from a spring previously but this could not be proven.) This is west of the site where we found up to 2' of sediment in a wetland a few years back from a W-S Business spec building. Everyone from the WSRO Regional Office Manager to Land Quality and 404/401 folks got involved. Anyway, remembering a conversation with JD that they did not want to build a detention pond but wanted to preserve floodplain (understandable since W-S involved and stormwater management is piping water ASAP to floodplain with them). Siecor apparently agreed that if they ever expanded that they would do stormwater management at that time. Not sure if 404/401 was issued to Siecor or to W-S Business or Forsyth Co. Dev. Mariam Wright and Ian Greveling, Plant Manager, from Siecor accepted the award at a special presentation luncheon at the Adam's Mark Winston Plaza Hotel. Siecor's Winston-Salem Cable Plant broke ground in the fall of 1993. In September 1994 this $35million state-of the art fiber-optic cable manufacturing facility opened its doors with about 30 employees. It shipped its first cable in June 1995 and turned its first profit in May 1996. Today, the Winston-Salem Cable Plant employs more than 300 people in a variety of technical, manufacturing and administrative positions and has shipped enough fiber to reach the moon and back seven times. Siecor embraces a total quality environment with emphasis on safety, superior customer satisfaction and exceptional value of its employees. John Thomas and John Cameron of my staff with Mr. Jeffrey Koontz (engineer for C_pEor Winston-Salem) at the site for the proposed Centre 311 facilit d off U.S. 311 adjacent to Fiddlers Creek, south of Winston-Salem, Orounty, North Carolina. The purpose of this meeting was to discuss p develop ment of the site, and to inspect the site for waters and wetlands subject to Department of the Army permitting authority. The meeting revealed that the site is located adjacent to Fiddlers Creek. A review of the proposed site plan (provided by Mr. Koontz on December 17, 1991) showed a single road crossing of an unnamed tributary of Fiddlers Creek and a single road crossing of Fiddlers Creek. All other proposed development was shown to be on high ground. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CPR), Part 330, published in the Federal Register on November 13, 1986, lists nationwide permits. Authorization was provided for minor road crossing fills including all attendant features, both temporary and permanent, that are part of a single and complete project for crossing of a non-tidal waterbody, provided that the crossing is culverted, bridged or otherwise designed to prevent the restriction of, and to withstand expected high flows and provided further that discharges into any wetlands adjacent to the waterbody do not extend beyond i00 feet on either side of the ordinary high water mark of that waterbody. Your proposed minor road crossings of the unnamed tributary of Fiddlers Creek and Fiddlers Creek are authorized by nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. Forsyth County On 16 February 1993, two DEM staff members (Eric Galamb and John Dorney) visited a location of offsite erosion into a bottomland hardwood forest wetland adjacent to your development site. Earlier Ron Linville of the Winston-Salem Regional Office had visited the site as well. They observed extensive areas of sediment deposited in the wetland from failure of sediment and erosion control measures on the site during construction. Our understanding is that the building is referred to as the "Shell Building and is part of the W-S Business, Inc. The U.S. Army Corps of Engineers had previously delineated wetlands on the site which were not to be filled during construction. From our conversations with Gray Hauser (Land Quality Section, Winston- Salem Regional Office) and on-site observations, we understand that the.sediment and erosion control measures that should have been implemented are now in place and generally operating properly. We also understand that Forsyth County operates the Sediment and Erosion Control Program for the County and has to date refused to take any action to remove the sediment which has been deposited in the wetland. My staff observed two areas of significant sediment deposition covering about one-half acre adjacent to the existing silt fences. In these locations sediment was from one to two feet deep. Other areas of the site had from one inch to five inches of sediment over several acres. We have determined that the deposition of greater than one foot of off-site sediment into these wetlands has resulted in violation of water quality standards - namely the Antidegradation Water Quality standard (15A NCAC 2B .0200). We also recommend that planting be done on the exposed sediment in the remainder of the wetland to prevent erosion. I urge the Land Quality Section to require Forsyth County to remove the sediments and stabilize the remaining sediments in this wetland. If your agency is unable to require Forsyth County to remove these sediments, I will need to pursue legal action through a Notice of Violation which Dan Oakley has advised me would be possible.
