According to information provided, approximately .027 acre of waters and wetlands would be temporarily disturbed by the proposed work within a 20-foot-wide corridor. For the purposes of the U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits (NWP). Authorization, pursuant to Section 404 of the Clean Water Act, was provided for the discharge of material for back€ill or-bedding for utility lines, including outfall and intake structures, provided 1) there is no change in pre-construction contours, 2) in wetlands the top 6 inches to 12 inches of the trench is backfilled with topsoil, 3) excess material is removed to upland areas, and 4) any exposed slopes and streambanks are stabilized immediately upon completion of the utility line. Your work is authorized by this NWP provided it is accomplished in strict accordance with the enclosed conditions. You are reminded that all wetlands must be restored to their original pre-project contours. This NWP does not authorized any permanent access road construction. Restored wetlands areas should not be seeded with upland vegetation but rather should be mulched and left to revegetate naturally or seeded with wetland plant species. This NWP does not relieve you of the responsibility to obtain any required State or local approval. We note that a water quality certification for this project has been approved by the NC Division of Environmental Management. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Also, this verification will remain valid for the 2 years if, during that period, 1 -2- the NWP authorization is reissued without modification or the activity complies with any subsequent modification of the NWP authorization. If during the 2 years, the NWP authorization expires or is suspended or revoked, or is modified, such that the activity would no longer comply with the terms and conditions of the.NWP, activities which have commenced (i.e., are under construction) or are under contract to commence in reliance upon the NWP will remain authorized provided the activity is completed within 12 months of the date of the NWP's expiration, modification or revocation, unless discretionary authority has been exercised on a case-by-case basis to modify, suspend, or revoke the authorization. As a matter of record this same area was reviewed in July/92 as it pertained to a wastewater subaqueous utility line on the east side of Stafford Street. U.S. Fish and Wildlife, National Marine Fisheries and the State Historic Preservation Officer made no comments pertinent to this crossing. Material resulting from trench excavation will be temporarily sidecast for approximately 7 days. Appropriate erosion control features will be utilized to prohibit dispersion by currents or other forces. The wetland fringe itself will be backfilled with 12" of topsoil from the trench excavation. A coffer dam will be located upstream, banks will be stabilized, erosion control measures utilized and construction completed within 7 days. This raw water line extension is vital to the City of Monroe. With the recent dry weather there is an imminent need for this connection.
