Upon review of your request for 401 Water Quality Certification to place fill material in
2.22 acres of wetlands or waters which are tributary to Williams Creek for residential
development and stormwater ponds located between SR 1435 & SR 1010 in WakeCounty, as
described in your submittal dated 11 May 1993, we have determined that the proposed fill
can be covered by General Water Quality Certification No. 2671 issued January 21, 1992. A
Copy of the General Certification is attached. This Certification may be used in qualifying for
coverage under Corps of Engineers' Nationwide Permit Nos. 26.

Dear Messrs. Alsmeyer and Dorney:
The purpose of this letter is to request a Nationwide Permit and ,a
Section 401 Water Quality Certification for the project to be
known as Taminary Farm. The project is located near Apex, NC
(Wake County) and is bordered, to the south by S.R. 1010,as shown
on the enclosed.plans and vicinity maps.
The Corps approved detailed wetland delineation'is shown on the
attached map. These delineations,-have been approved; by Mr. Eric
Alsmeyer of the U.S. Army Corps of Engineers.
Fill in the wetlands will be re_ to construct roadways and a'.
residential development.
It will be necessary to fil 2.05 ac s (see map.) of
jurisdictional waters above headwat s for placement of the
proposed facilities utilizin N onwide 26.
In addition to 3 ,natural wetlands, two old farm ponds currently
exist on-site. We propose to fill.-one of the ponds, the-smallest
wetland area., and portions of the remaining pond and' wet1ands, .for
a total of 2=.05.acres of fill in Waters of the U".S. However, the
three wetland' areas impacted by partial fill will be'reworked,
creating two new ponds and adding .44 acres of waters to the site.
.17 acres; of wetland will be flooded. The, -Ponds will be'us'ed to
retain and treat_stormwater, which will help protect water, quality
in the watershed.
Based on conversations with DEM and the Corps staff, under current
"policy" non-vegetated area of Waters of the U.S. to be'"inundated
by creation of lakes or other impoundments are not considered to
be adversely impacted,' except for the dam area. Since the old
farm pond to be reworked meets the criteria for exclusion, the
area that is"to remain flooded has not been. included as a negative
impact. Areas to be filled are included as negative impacts.
