We are in the process of securing the necessary permits for the
construction of an alum sludge lagoon decant system at our Water
Treatment Plant. The system will decant water from our alum
sludge lagoon through a six inch discharge pipe into the Tar
River. The system piping will extend approximately 100 feet
through wetlands, therefore, we are required to obtain a general
permit from the Army Corps of Engineers. In order to obtain this
permit we must first secure a 401 water quality certification
from the DEM.
Please find herewith, a completed 401 certification application
and the required supporting data. Please consider this letter
and application a request for 401 certification for this project.

SUBJECT: 401 Water Quality Certification for Greenville
Utilities Commission, SR 1401 Water Treatment Plant,
Greenville, Pitt County, North Carolina.
We have reviewed the subject permit application and
biologists on our staff are familiar with habitat values of the
project area. An on-site investigation was conducted on January
26, 1993 for the purpose of assessing construction impacts to
wildlife and fisheries resources. Our comments are provided in
accordance with provisions of the Fish and Wildlife Coordination
Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.).
The applicant, Greenville Utilities Commission, proposes to
decant excess water from an alum sludge lagoon at its water
treatment plant through a 6 in. discharge pipe into the Tar
River. The pipe is to be buried through approximately 100 ft. of
river flood plain wetlands vegetated with river birch, ironwood
and cypress (numerous cypress knees). The wetlands have a well
established root mat that contains the soil and prevents erosion.
On February 2, 1993 the site was revisited with the plant
engineer. The engineer stated the ditch would be excavated 2 ft.
wide by approximately 2 ft. deep with a tracked hydraulic
backhoe.
We are concerned that the ditch cannot be effectively
backfilled and stabilized with vegetation due to the erosive
forces of frequent flooding, the ditch being located on the
outside of a sharp bend in the river. We therefore request the
project be modified in the following manner: suspend the
discharge pipe a minimum of 1 ft. above the floor of the flood
plain and extend the discharging end well out into the river so
the effluent stream will not erode the bank. If the modification
cannot be carried out, we recommend that certification be denied.

Dear Mr. Langley:
Please reference your December 8, 1992 meeting with Mrs. Laura Fogo of my
staff, at the Greenville Water Treatment Plant located off S.R. 1401,
adjacent to the Tar River, Greenville, Pitt County, North Carolina. Also in
attendance were Messrs. Bud Greer and Wayne Meads, of the Greenville Utilities
Commission. The purpose of this meeting was to discuss your plans to install
a 6-inch pvc pipe from the alum sludge disposal lagoon to the Tar River for
the purpose of discharging water into the river.
On April 1, 1988, we renewed general permit no. 198100049, (copy enclosed)
that authorizes the maintenance, repair and installation of aerial and
subaqueous utility lines with attendant structures and the discharge of
excavated or fill materials, within construction/access corridors, associated
with utility line maintenance, repair and installation in navigable waters and
waters of the United States in the State of North Carolina.
For the purposes of the U.S. Army Corps of Engineers'. Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization, pursuant to Section 10 of the Rivers and Harbors Act and
Section 404 of the Clean Water Act, was provided for construction of outfall
structures and associated intake structures where the effluent from the
outfall is authorized, conditionally authorized, or specifically exempted, or
is otherwise in compliance with regulations issued under the National
Pollutant Discharge Elimination System (NPDES) program.
You propose to bury approximately 98 feet of the pipe within Section 10
waters of the Tar River for the purpose of installing the 6-inch discharge
pipe. Trench excavation is approximately 2 feet wide by 3 feet deep. The
terminal end of the pipe will be exposed, and extend approximately 2 feet into
the waters of the Tar River. Your work is authorized by this nationwide
permit and the enclosed general permit provided it is accomplished in strict
accordance with the enclosed conditions. Please read the enclosed general
permit to prevent an unintentional violation of Federal law. The
aforementioned permits do not relieve you of the responsibility to obtain any
required State or local approval.

This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date of
the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.

Upon review of your request for 401 Water Quality
Certification to place fill material in 0.02 acres of wetlands or
waters which are tributary to Tar River for alum sludge decant
discharge pipe located in Pitt County, we have determined that
the proposed fill can be covered by General Water Quality
Certification No. 2664 issued January 21, 1992. A copy of the
General Certification is attached. This Certification may be
used in qualifying for coverage under Corps of Engineers'
Nationwide Permit No. 12.
